El Síndic de Greuges se incorpora a la red de infancia y al grupo de trabajo sobre mediación de la institución

Es necesario un trabajo conjunto y coordinado de las defensorías para afrontar los retos inminentes
 

Representantes del Síndic de Greuges de Cataluña han participado esta semana pasada en la XXVIII Asamblea y el XXVII Congreso de la Federación Iberoamericana del Ombudsperson (FIO), celebrados en Barranquilla, Colombia.

La FIO, creada hace veinte años, está constituida por más de 100 defensores de 22 países iberoamericanos con la idea de fomentar la cooperación, el intercambio de experiencias, la promoción, la difusión y el fortalecimiento de las instituciones defensoras de los derechos de la ciudadanía.

La adjunta de infancia y responsable de igualdad del Síndic de Greuges de Cataluña, Aida C. Rodríguez, participó en la reunión de la Red de Mujeres, como coordinadora de la región europea. Esta red nació en 1997 como órgano interno, con la voluntad de que la perspectiva de género se incorporara a la institución y a todas las defensorías miembros, y con la voluntad de luchar para que en todas estas instituciones existieran instancias específicas para la defensa, promoción y ampliación de los derechos de las mujeres. Durante la jornada se presentó el informe de actividades de 2023 y se aprobó el plan de trabajo para 2024.

Durante la semana se aprobó también que la institución del Síndic de Greuges pase a formar parte de la Red de Infancia y Adolescencia, y las representantes de la institución ya participaron en su primera reunión. Se aprobó un posicionamiento conjunto con la Red de Movilidad Humana y Tráfico de Personas, con el objetivo de trabajar por la protección y la integración de la infancia y la adolescencia migrante y refugiada.

El Síndic de Greuges se ha integrado asimismo en el Grupo de trabajo sobre mediación en las instituciones de defensa de los derechos de las personas, puesto que la institución apuesta por promover la mediación como uno de los mecanismos de resolución de conflictos, dentro del concepto de justicia restaurativa.

Por último, durante la asamblea general se aprobó que la síndica de greuges, Esther Giménez-Salinas, se incorporase como representante en el comité ejecutivo de los defensores autonómicos españoles. La síndica se muestra ilusionada con esta nueva responsabilidad y ha manifestado que pone "la institución del Síndic al servicio de la defensa de los derechos humanos en el mundo". Hasta ahora, este cargo había sido ocupado por el defensor del pueblo andaluz, Jesús Maeztu. En la clausura de la Asamblea, el defensor del pueblo de Colombia, Carlos Camargo Assis, fue elegido presidente de la FIO para los próximos doce meses.

La Asamblea cerró con el compromiso de los defensores por un trabajo conjunto, coherente y coordinado ante los retos inminentes, tales como la contaminación del medio ambiente, el tráfico de personas, los flujos migratorios, la violencia de género o la conflictividad social.

La institución ha abierto una actuación de oficio para analizar la situación de la salud mental en Cataluña

El riesgo de tener una depresión se ha incrementado un 59 % desde el año 2019

Los problemas de salud mental afectan especialmente a la población más vulnerable
 

Con motivo del Día Mundial de la Salud Mental, la institución del Síndic de Greuges ha querido hacer balance de las actuaciones que se han llevado a cabo en materia de salud mental durante los últimos años y de los principales problemas que la afectan, especialmente tras el impacto que supuso la pandemia de la covid-19.

La sindica de greuges constata con preocupación que algunos recursos en salud mental son insuficientes desde hace tiempo, y que a raíz de la pandemia se han evidenciado aún más estas carencias. En este sentido, en los últimos años la institución ha recibido más quejas y consultas relacionadas con esta cuestión. Concretamente, desde 2018 este tipo de quejas se han incrementado un 41 %, y muchas de ellas exponen problemas de accesibilidad y demoras de las listas de espera para acceder a la primera visita con profesionales de los centros de salud mental. En alguno de los últimos casos que hemos estudiado, el centro de atención primaria calificó la derivación como preferente, pero sin embargo no se dio hora para la atención especializada de psiquiatría hasta cuatro meses después.

Además, en las respuestas que el Departamento de Salud da a las peticiones de información de la institución relacionadas con la salud mental, se reconoce un “déficit de profesionales, que hace que se estén dilatando de forma significativa los tiempos de espera”.

Con la voluntad de ir más allá de los casos concretos, la institución ha abierto una actuación de oficio para analizar la situación de saturación de la salud mental comunitaria en Cataluña.

La Encuesta de salud de la población muestra que actualmente el 24 % de la población mayor de quince años sufre malestar emocional, y que el 11 % manifiesta tener una depresión moderada o grave. Del análisis de los datos se desprende que los problemas de salud mental afectan especialmente a la población más vulnerable: la prevalencia de sufrir una depresión moderada o grave entre la población socialmente desfavorecida dobla la de la población socialmente más favorecida (12,8 % frente a 6,6%).

La síndica se muestra preocupada porque algunos de estos indicadores han empeorado si los comparamos con años anteriores a la pandemia de la covid-19: mientras que en 2019 el porcentaje de la población que manifestaba sufrir depresión moderada o grave era del 7,2 %, en 2022 esta cifra asciende hasta el 10,9 %, lo que representa un incremento del 59 %.

En consecuencia, la síndica trabajará para que todas las administraciones implicadas lleven a cabo las actuaciones necesarias para garantizar el bienestar emocional y la salud mental de las personas.

Human Rights Ombudsman Peter Svetina participated at the general assembly and conference of the European Network of National Human Rights Institutions (ENNHRI) in Brussels. This year, ENNHRI, of which the Slovenian institution of the Human Rights Ombudsman has been a long-time member, celebrates the 10th anniversary of operation. The celebration was attended by more than 200 representatives of national institutions for human rights and other organisations or institutions, including the European Commission, Council of Europe, OECD, OSCE, and UN, while the participants were addressed by the Council of Europe Commissioner for Human Rights Dunja Mijatović. The red thread of the conference was the vision for the next 10 years and in the forefront of talks was the issue of how to inspire and encourage countries to more persistently strive and fight for human rights and for a just, tolerant, and safe society.

Invited by the organiser, Ombudsman Svetina participated at the conference as a speaker at a roundtable discussion about challenges in the field of human rights, primarily in the fields of digitalisation, artificial intelligence, and climate change. He emphasised the importance of an open dialogue and said that there will be no efficient solutions without concerted efforts. He also shed light on the role of the institution of Human Rights Ombudsman of the Republic of Slovenia as the national institution for human rights and its work in the mentioned fields.

Ombudsman Svetina highlighted the significance of ENNHRI’s operation and its efforts for the promotion of human rights in the field of artificial intelligence on the European level. He added that this organisation has made an important step in this field by adopting a common position – the EU Act on Artificial Intelligence. Svetina estimated the collaboration between the ENNHRI and the Slovenian Human Rights Ombudsman as excellent and announced that at the end of November they will host an expert event together in Ljubljana intended for the strengthening of knowledge in the field of artificial intelligence.

“The Human Rights Ombudsman has not encountered any concrete examples of abuse of artificial intelligence on the national level, yet we stay cautious since with numerous benefits of artificial intelligence in this field, there also exist a plethora of potential dangers for human rights,” said Svetina. He especially stressed that the institution of the Ombudsman supports the efforts of the Council of Europe for arrangement of the development and use of artificial intelligence based on the standards of human rights, democracy, and the rule of law.

He also warned about the importance of inclusive digitalisation, the key components of which are the protection of privacy, the fight against online fraud and violence, and digital literacy. The Human Rights Ombudsman supports non-governmental organisations which bring awareness and educate about digital tools, said Svetina and stood for the accessibility of information for all, including those who are not skilled in digital technologies. Related to this he also mentioned the so-called Ombudsman’s Corners, which are installed in Slovenian municipalities by the institution of the Ombudsman and thus provides accessibility of information about the work of the Ombudsman for all people, regardless of their literacy level, in analogue and digital forms.

As the second important emerging challenge in the field of human rights Ombudsman Svetina sees the climate crisis. He recalled the consequences of recent meteorological disasters in Slovenia and around Europe and emphasised the urgency of decisive measures on all levels. “The consequences of inefficient environmental protection because countries often neglect their preventive role are borne, both in the economic and healthcare sense, by the present and future generations. Climate change is hidden in the background of a major part of economic and war migrations, therefore we should already have shifted from the theoretic search for solutions and dialogue about the importance of green transition to measures that are visible and have the effect in practice,” he observed. In his speech, Ombudsman Svetina praised the participation of ENNHRI in three historical cases in the field of the environment before the European Court for Human Rights and added that a clean, harmless to health, and safe environment is a fundamental human right deriving from the right to human dignity and is thus a foundation for the implementation of all other rights. “We must come united before the challenges presented by the combination of digitalisation, artificial intelligence, and climate change so that we can protect the inviolability of human rights. We are at a crossroads, which on the one side offers unlimited potential and on the other unimagined traps, since irresponsible use of technologies can endanger our fundamental freedoms. If we want to protect the rights of all, regardless of age, background, or circumstances, we must put ethics and dignity on a pedestal. This must be our clear goal, since I believe that on this developmental path we want to leave nobody behind,” concluded Ombudsman Svetina.

El Defensor del Pueblo, Ángel Gabilondo, ha presidido este martes, en la sede de la institución, una nueva reunión del Consejo Asesor del Mecanismo Nacional de Prevención de la Tortura y otros Tratos o Penas Crueles, Inhumanos o Degradantes (MNP).

En la reunión se ha analizado la actividad que realiza la unidad del MNP, cuyo trabajo está centrado en la inspección y supervisión de los lugares de privación de libertad de todo el territorio nacional.

El Consejo Asesor del MNP es un órgano de cooperación técnica y jurídica que está formado por profesionales especializados en la defensa de los derechos de las personas privadas de libertad, representantes de organizaciones de la sociedad civil y de colegios profesionales de abogados, médicos y psicólogos.

Actualmente, componen el Consejo Asesor del MNP: Luis F. Nieto, abogado; María Castellano, catedrática emérita de Medicina Legal y Forense; Vicenta Esteve, psicóloga; Maite Parejo Sousa, abogada; Luis Andrés Cucarella, catedrático de Derecho Procesal en la Universidad de Valencia; Mª Dolores Galovart, magistrada; Mª José García-Galán, magistrada, y Jesús López Medel, abogado del Estado.

Al encuentro también asistieron la adjunta primera del Defensor del Pueblo, Teresa Jiménez-Becerril; la adjunta segunda, Patricia Bárcena; el director del MNP, Fernando Herrero, y el secretario general del Defensor del Pueblo, José Manuel Sánchez Saudinós, que actúa como secretario del Consejo Asesor.

The Office of the Ombudsman has welcomed the decision by the Planning Authority to revoke a permit for a concrete structure intended to house an ATM and ticket booth along the St Julian’s promenade. This decision aligns with a recommendation made by the Commissioner for Environment and Planning over a year ago.

Perit Alan Saliba, the Commissioner for Environment and Planning, investigated a complaint regarding the Planning Authority’s (PA) acceptance of a Development Notification Order for the erection of an ATM and booth in St Julians.

Following this investigation, on 3rd October of last year, the Commissioner for Environment and Planning found the allegations against the Planning Authority – which had approved the development in St Julian’s despite it being three times the size allowed by the Development Notification Order – to be justified.

The Commissioner recommended that the PA invoke Article 80 of the Development Planning Act to revoke the permit in question. This was due to evident errors in the record and the submission of a plan (section) that did not accurately represent the on-site situation. Additionally, the Commissioner advised the PA to take enforcement action against constructions that were either below street level or above the existing floor level without permission.

Despite the clear directive from the Office of the Ombudsman, the Planning Authority did not heed the Final Opinion and failed to implement the recommendations set out by the Commissioner for Environment and Planning. Consequently, the Commissioner informed the Prime Minister, and the report was subsequently forwarded to Parliament in January of this year.

Had the Planning Authority heeded the recommendations from the Office of the Ombudsman promptly, it would have prevented the visual disruption that has been in place for the past year, especially since the recommendation was made prior to the structure’s completion.
