„Vor ziemlich genau zehn Wochen hat Bettina G. das Kinderbetreuungsgeld, auf das sie mehr als acht Jahre warten musste, per Höchstgerichtsurteil zuerkannt bekommen. Inzwischen wurde es auch ausgezahlt“, erinnert Volksanwalt Bernhard Achitz: „Die Frage ist aber, ob Familienministerin Susanne Raab mittlerweile endlich etwas unternommen hat, damit solche Fälle nicht mehr vorkommen, und entsprechende Richtlinien ausgegeben hat.“ Denn immer wieder melden sich betroffene Eltern bei der Volksanwaltschaft.

„Seit Jahren kritisieren die Volksanwaltschaft und auch die Arbeiterkammer die familienfeindliche und EU-rechtswidrige Vorgehensweise der Behörden, die auf Weisung der Frauenministerin Eltern massive Hürden in den Weg stellen. Eine Reform ist überfällig – sowohl bei der Vollziehung als auch auf gesetzlicher Ebene“, so Achitz.

Die Vorgeschichte: Die betroffene Mutter, Bettina G., hatte sich bereits 2017 an die Volksanwaltschaft gewandt, die seitdem mehrfach auf ihren Fall aufmerksam gemacht und sich intensiv um eine Lösung bemüht hat. Die Familie, die nun vom OGH Recht bekommen hat, wartete schon seit achteinhalb Jahren auf das Kinderbetreuungsgeld, obwohl sie mehrere Bestätigungen der ausländischen Behörde vorgelegt hatte, dass sie keinen Anspruch auf dortige Familienleistungen hat. Weil die Behörde auch nach der Kritik der Volksanwaltschaft nicht einlenken wollte, ist die Mutter mit Hilfe des AK Rechtsschutz vor Gericht gezogen. Trotz zweier vorinstanzlicher Urteile zu Gunsten der Familie ging die Behörde aber erneut in Berufung – der OGH hat Ende Juni rechtskräftig entschieden, dass sie das Kinderbetreuungsgeld nachbezahlt bekommen muss.

Anweisungen des Familienministeriums EU-rechtswidrig

Achitz: „Es ist dringend an der Zeit, hier etwas zu ändern. Damit Familien mit dem Kinderbetreuungsgeld jene Unterstützung erhalten, die sie verdienen. Die Behörden müssen familienfreundlicher handeln, aber auch die gesetzlichen Grundlagen müssen verbessert und vereinfacht werden. Das Ministerium muss seine Weisungen ändern! Außerdem widerspricht der Vollzug des Kinderbetreuungsgeldgesetzes in mehreren Punkten EU-rechtlichen Vorgaben.“

„Aber nicht nur bei der AK, auch bei der Volksanwaltschaft häufen sich die Beschwerden, und im Gegensatz zu anderen Behörden ist die Lösungsbereitschaft bei Familienministerin Susanne Raab nicht sehr ausgeprägt“, kritisiert Volksanwalt Achitz.

Viele Problemfelder in der Familienpolitik

Aber nicht nur in diesem Punkt gibt es Probleme, auch sonst häufen sich bei der Volksanwaltschaft Beschwerden, die das Familienministerium betreffen. „Aber im Gegensatz zu anderen Behörden ist die Lösungsbereitschaft bei Familienministerin Susanne Raab nicht sehr ausgeprägt“, kritisiert Volksanwalt Achitz. Einige der wiederholt auftretenden Beschwerdeanlässe:

• Mutter-Kind-Pass-Bestätigung nicht eingeschickt – 1.300 Euro Kinderbetreuungsgeld weg
• Langes Warten auf Familienbeihilfe in Zeiten der Teuerung
• Hauptwohnsitzmeldung vergessen – kein Kinderbetreuungsgeld
• Bedenkliche Ablehnung des einkommensabhängigen Kinderbetreuungsgelds – bis zu 12.000 Euro weniger
• Ein Tag zu lang krank – kein einkommensabhängiges Kinderbetreuungsgeld

Auf einen weiteren Kritikpunkt der Volksanwaltschaft hat der Gesetzgeber bereits reagiert: Nachdem eine alleinerziehende Mutter nach dem Tod des Vaters kein Kinderbetreuungsgeld erhalten hatte, wurde die Einführung einer Härtefallklausel beschlossen.

El Defensor del Pueblo, Ángel Gabilondo, ha asistido este sábado al acto conmemorativo del 40 Aniversario del Consejo de la Juventud de España (CJE) que se ha celebrado en el auditorio de Caixa Forum.

El acto fue inaugurado por Andrea González, presidenta del CJE y por la ministra en funciones de Derechos Sociales y Agenda 2030, Ione Belarra. Posteriormente se celebró una mesa redonda en la que participaron ex responsables del Consejo General de la Juventud que reflexionaron sobre la evolución de la juventud en los 40 años de actividad de Consejo.

Asistieron a la celebración del 40 aniversario del CJE, entre otras personalidades, el director general del Instituto de la Juventud (Injuve), David Veloso; la secretaria de Estado en funciones de Migraciones, Isabel Castro; la secretaria de Estado en funciones para la Agenda 2030, Lilith Verstringe; la presidenta del Consejo Escolar del Estado, Encarna Cuenca, y la presidenta del Foro Europeo de la Juventud, María Rodríguez.

El CJE está formado por más de 60 entidades y organizaciones juveniles y por los Consejos de Juventud de las comunidades autónomas.

Why judge the dress, not the actions of women?

In view of the hostile attitude towards women in publicly visible positions, the Ombudsman calls on everyone to evaluate their prejudices and how they unconsciously influence the ‘consumption’ of news and the perception of women’s public activities and reminds that there is criminal liability for gender-based hate speech.

Subjectively offensive information does not immediately mean hate speech

Using the criteria for assessing hate speech, the Ombudsman conducted an analysis of the Ukrainian artist group “TIGOIS project” poster saying “Pусский оккупант. Лучшее удобрение” (Eng. Russian Occupant. Best Fertiliser) in the exhibition of contemporary sculpture and paintings at the National Library of Latvia. The work is the reaction of the Ukrainian artist to the current Russian military aggression in Ukraine using the metaphor of art. Accordingly, it can be concluded that the aim of the authors was to draw public attention to the ongoing hostilities and to counter the violence perpetrated by the occupying forces in Ukraine.

Ombudsman’s research shows shortcomings in the acquisition of learning materials

The Ombudsman received almost 1300 messages on the purchase of learning materials from almost all regions of Latvia. Lists of learning materials are welcome as they provide clarity about necessary things and who buys them. It is essential that there is no obligation to purchase learning materials that should according to the law be provided by the educational institution rather than parents. The Ombudsman asked the local authorities and their educational institutions to review their lists of learning materials and, if necessary, to update them. By 16 August, the information received from 30 municipalities in Latvia.

The Ombudsman has received information that the Council of Salaspils Secondary School No. 1 has decided on learning materials that, according to the Education Law, are not provided by parents. The Ombudsman has asked Salaspils municipality to immediately ensure that Salaspils Secondary School No. 1 clarifies the information provided to students’ parents, considering children’s right to receive education free of charge.

Patient should be guaranteed the right to state-paid medicines also in atypical cases

The reimbursement mechanism for individual medicines needs to be improved. The Ombudsman therefore invites the Cabinet of Ministers to make amendments to the Cabinet Regulations by 31 October. This would make it possible for the National Health Service to ensure that people who, for individual and atypical reasons, require and for whom the use of certain medicinal products is strictly medically justifiable can receive reimbursement from the state.

Life in Rezekne Pensioner Social Services Centre is humiliating

The situation that the representatives of the Ombudsman’s Office, Ministry of Welfare and the Health Inspectorate identified in the on-site visit to the Social Service Centre supervised by the Social Service of Rezekne State Municipality confirms that there is an urgent need to find a solution on how to increase the qualification and remuneration of carers to attract knowledgeable and motivated employees. The Ombudsman calls on the local government and other responsible institutions to take immediate action to provide residents with living conditions that respect human dignity.
