“I remain seriously concerned about the humanitarian situation in Nagorno-Karabakh and the human rights of its population following the blocking of the road running through the Lachin Corridor since December 2022. I reiterate the call I made at that time to restore free movement along that road” said today Council of Europe Commissioner for Human Rights, Dunja Mijatović. 

“Despite my calls and those of numerous other international stakeholders, the humanitarian and human rights situation in the area has reportedly further deteriorated, affecting particularly the most vulnerable, due to the prolonged disruption in the movement of people and access to food supplies and urgent medical care. The International Committee of the Red Cross (ICRC), which is for the moment the only international humanitarian organisation operating across the Lachin Corridor, indicated that the population was facing a lack of life-saving medication and essentials.

The relevant stakeholders should immediately find a solution to avoid any further deterioration of the very dangerous situation the local population is facing and guarantee safe and free passage to those providing humanitarian assistance and those ensuring human rights protection. As indicated in my 2021 Memorandum, efforts should be made by Armenia and Azerbaijan to move forward on the path towards reconciliation and ensure lasting peace for all people.

I confirm my commitment and readiness to engage with all the relevant interlocutors and to travel to Nagorno Karabakh to assist in overcoming the existing human rights challenges.”

On 30-31 August representative of the Ombudsman’s Office Ms Ruta Silina participates in the meeting on “Taking stock of rule of law challenges in Europe – perspectives from National Human Rights Institutions”. The meeting was part of the Partner’s get-together of the Project “Supporting National Human Rights Institutions in Monitoring Fundamental Rights and the Fundamental Rights Aspects of the Rule of Law” under EEA and Norway Grants Fund for Regional Cooperation 2022-2024.

Ms Ruta Silina shared the experience of the Ombudsman’s Office of Latvia in the preparation and contribution of the country rule of law report, and about recent changes in the Ombudsman’s Annual Report on the implementation of recommendations.

Participants of the meeting also shared their experience and challenges in the implementation of the project on strengthening of the role of national human rights institutions in the application of the EU Charter of Fundamental Rights at the national level.

Sozialsprechstunde: Bürgerbeauftragte berät in Harrislee

Probleme beim Bürgergeld, wie zum Beispiel mit der Übernahme der Kosten für Miete oder Heizung, mit der Hilfe zum Lebensunterhalt, dem Wohngeld oder auch mit Leistungen der Krankenkassen oder Schwierigkeiten beim Kindergeld – die Bürgerbeauftragte für soziale Angelegenheiten des Landes Schleswig-Holstein, Samiah El Samadoni, hilft bei allen Fragen rund um das Sozialrecht. Darüber hinaus berät die Bürgerbeauftragte auch als Leiterin der Antidiskriminierungsstelle des Landes und als Ombudsperson in der Kinder- und Jugendhilfe im Rahmen dieser Sprechstunde. Zudem ist die Bürgerbeauftragte auch Beauftragte für die Landespolizei und damit Ansprechpartnerin für Beschwerden von Bürger*innen und Eingaben von Polizist*innen.

The Commissioner for Environment and Planning takes action on residents’ concerns

The Office of the Ombudsman investigated a matter of public concern by residents of Qala as reported by The Times of Malta on the 29th of August 2023 in an article titled ‘Residents report missing site notice at Qala project’. A site notice for a new construction project, specifically application PA/04643/23, reportedly went missing during its representation period. The application involves the construction of nine farmhouses with garages and swimming pools in an alley on Triq il-Wardija.

The issue

Residents noticed that the site notice, which provides information on the planned construction project, was missing during its active representation period. This period allows the public to express concerns or approvals about new projects and is crucial for transparency and public participation. The representation period for this specific application is currently active and will remain open until September 18, 2023.

Action taken

Following the report, Perit Alan Saliba, the Commissioner for Environment and Planning in the Office of the Ombudsman, took immediate action by communicating with the Planning Authority.

Planning Authority’s response

The Planning Authority has informed the Commissioner that they have issued a letter to the applicant. The letter directs the applicant to promptly place a site notice in a location visible from the public road. It also emphasises that photographic evidence should be kept to prove compliance with this legal requirement. The Planning Authority made it clear that failure to comply could result in the re-publication of the application, subsequently extending the legislative processing time-frame by six weeks.

Der Bürgerbeauftragte begrüßt die jetzt gefundene Übergangsregelung, damit nun der Entlastungsbetrag i.H.v. 125,- € für Nachbarschaftshilfe zunächst ohne Pflegekurs in Anspruch genommen werden kann. „Damit ist Nachbarschaftshilfe für Pflegebedürftige endlich auch tatsächlich möglich. Ich frage mich aber wirklich, warum diese Lösung nicht bereits vor 6 Monaten hätte gelten können.“

Zuvor hatte Herzberg auf einen eklatanten Missstand aufmerksam gemacht: In Thüringen waren zwar per Verordnung die Voraussetzungen dafür geschaffen worden, dass der Entlastungsbetrag auch für Angebote der Unterstützung im Alltag durch Nachbarn oder ehrenamtliche Helferinnen und Helfer eingesetzt werden kann. Dies aber nur nach vorheriger Absolvierung eines Pflegekurses. Diese Pflegekurse haben die Pflegekassen aber bis heute nicht anbieten können.

Die jetzt gefundene Übergangsregelung ermöglicht, dass die Pflegehelfer den Kurs bis Ende 2024 absolvieren, aber schon vorher tätig werden können. Erste Kurse sollen ab September angeboten werden.

Herzberg: „Das ist ein wichtiger Schritt. Die Zeit bis Ende 2024 sollte aber auch genutzt werden, um das Verfahren weiter zu vereinfachen und lebensnäher, bürgerfreundlicher und bürokratieärmer auszugestalten.“
