The letters concerns the complaints we have received and considered about these organisations during the year.

Through these letters, we want to help local councils and Health Boards improve their complaint handling and the services that they provide.

UNO prüft Österreichs Einhaltung der Behindertenrechtskonvention

Österreich hat bei der Umsetzung der UN-Behindertenrechtskonvention (UN-BRK) noch viel Arbeit vor sich. In der kommenden Woche wird die österreichische Umsetzung vom UN-Fachausschuss in Genf geprüft. Volksanwalt Bernhard Achitz wird dort auf den Handlungsbedarf hinweisen: „Österreich hat die UN-Behindertenrechtskonvention unterschrieben, aber bei weitem nicht vollständig umgesetzt.“

Das erfährt die Volksanwaltschaft häufig direkt von den Betroffenen: „Viele Menschen mit Behinderungen beschweren sich bei uns, entweder über schlechte Gesetze oder aber über die Verwaltungspraxis der Behörden. Das beginnt bei Bahnhöfen, die nicht barrierefrei sind, persönliche Assistenz wird nicht oder nicht im benötigten Ausmaß bewilligt. Es gibt weder einen Rechtsanspruch auf Rehabilitation noch darauf, dass der behinderungsbedingte Mehrbedarfs bezahlt wird. Stattdessen müssen sich die Betroffenen bei unterschiedlichsten Stellen um Förderungen anstellen. So wird jeder Rollstuhl, jedes Pflegebett, jeder barrierefreie Umbau zu einem bürokratischen Hürdenlauf. Die Menschen werden zwischen Bund, Land, Sozialversicherung und weiteren Akteuren hin- und hergeschickt, anstatt dass sich eine einzige koordinierende Stelle mit den Anliegen der Betroffenen befasst.“

Selbstbestimmtes Leben statt Unterbringung in Einrichtung

Bei der Präventiven Menschenrechtskontrollen in Einrichtungen für Menschen mit Behinderungen und in Pflegeeinrichtungen muss die Volksanwaltschaft zuletzt eine steigende Zahl von Freiheitsbeschränkungen feststellen. In einem Punkt wird die UN-BRK faktisch ignoriert: „Die Deinstitutionalisierung ist in Österreich erst schwach ausgeprägt. Es herrscht immer noch die Idee vor, dass Menschen mit Behinderungen in Einrichtungen untergebracht werden, und dort wird man schon wissen, was sie brauchen. Das ist aber nicht das, was die UN-BRK unter einem selbstbestimmten Leben versteht“, so Achitz. Auch Arbeit für ein Taschengeld in Behindertenwerkstätten muss durch entlohnte Arbeit ersetzt werden, wenn nötig, unterstützt durch Persönliche Assistenz.

Fehlende Unterstützung ist Diskriminierung

Achitz: „Selbstbestimmung muss bedeuten, dass auch Menschen mit Behinderungen in einer eigenen Wohnung leben können, wenn sie das möchten. Oder arbeiten. Und wenn ein beinamputierter 15-Jähriger schwimmen möchte, dann muss ihm das auch ermöglicht werden, in dem Fall mit einer Schwimmprothese. Auch wenn die viel Geld kostet, muss er sie bekommen. Alles andere wäre nicht Inklusion, sondern Diskriminierung.“

Handlungsbedarf gibt es auch im Bildungsbereich, so Achitz: „Eltern von Kindern mit Behinderungen müssen sich immer wieder rechtfertigen, wenn ihre Töchter und Söhne mit Gleichaltrigen den örtlichen Kindergarten, Schulen oder Horte besuchen wollen, diese aber auf ihre Befürfnisse nicht ausgerichtet sind.“

Achitz betont, wie wichtig es sei, zusammen mit dem Monitoringausschuss, der Behindertenanwaltschaft und natürlich mit Vertreterinnen und Vertretern der Community wie etwa dem Behindertenrat und Selbstbestimmt Leben an der Staatenprüfung teilzunehmen: „Gemeinsam werden wir den Druck auf die Politik erhöhen, damit sie die UN-BRK in Österreich endlich vollständig umsetzt.“

NEW ZEALAND | United Nations concerned at high rates of juvenile and Māori imprisonment

The United Nations Committee against Torture has called on the New Zealand Government to reduce the disproportionately high number of Māori in prisons and to improve the conditions of people in detention, noting that transformational change is needed. It also expressed concern about the use of pretrial detention, and lack of time limits for pretrial detention. Chief Ombudsman Peter Boshier says the UN’s findings echo the concerns he has repeatedly raised in many of his inspection reports, including in prisons and health and disability facilities.

Commenting on the verdict in the trial of Lucy Letby, Parliamentary and Health Service Ombudsman Rob Behrens said:

“We know that, in general, people work in the health service because they want to help and that when things go wrong it is not intentional. At the same time, and too often we see the commitment to public safety in the NHS undone by a defensive leadership culture across the NHS.

“The Lucy Letby story is different and almost without parallel, because it reveals an intent to harm by one individual. As such, it is one of the darkest crimes ever committed in our health service. Our first thoughts are with the families of the children who died.

"However, we also heard throughout the trial, evidence from clinicians that they repeatedly raised concerns and called for action. It seems that nobody listened and nothing happened. More babies were harmed and more babies were killed. 

"Those who lost their children deserve to know whether Letby could have been stopped and how it was that doctors were not listened to and their concerns not addressed for so long. Patients and staff alike deserve an NHS that values accountability, transparency, and a willingness to learn.   

“Good leadership always listens, especially when it’s about patient safety. Poor leadership makes it difficult for people to raise concerns when things go wrong, even though complaints are vital for patient safety and to stop mistakes being repeated.

"We need to see significant improvements to culture and leadership across the NHS so that the voices of staff and patients can be heard, both with regard to everyday pressures and mistakes and, very exceptionally, when there are warnings of real evil.”

Oggi si è tenuto un incontro bilaterale in modalità online di grande importanza tra Italia e Brasile, focalizzato su temi cruciali come la difesa civica, la trasparenza e i diritti umani. Questo incontro segna un importante traguardo nell’approfondimento delle relazioni tra i due paesi, gettando solide basi per futuri momenti di condivisione di idee e rapporti.

L’incontro ha visto la partecipazione di Marino Fardelli, Presidente del Coordinamento Nazionale dei Difensori Civici italiani e Difensore Civico della Regione Lazio che ha portato l’esperienza e la prospettiva italiana e regionale in merito ai temi affrontati. Dall’altro lato, per la delegazione brasiliana hanno partecipato Fernando Mauro Barbosa, Vice Procuratore Generale della Difesa Federale, Daniella Brauner, Procuratore Generale Federale della Difesa, e Aline Larroyed, Responsabile per le Relazioni Internazionali. Ha preso parte ai lavori l’interprete Dana Voiat che ha facilitato la conversazione italiano/inglese. La presenza di tali figure di spicco ha sottolineato l’importanza di questo incontro e l’impegno di entrambi i paesi verso la collaborazione internazionale.

Durante l’incontro, sono state condivise prospettive e strategie riguardo alla difesa civica, alla trasparenza delle istituzioni e alla promozione dei diritti umani. La difesa civica è emersa come un obiettivo comune, sottolineando l’importanza della partecipazione attiva dei cittadini nella costruzione di società resilienti. La trasparenza istituzionale è stata discussa in dettaglio, con l’obiettivo di promuovere una maggiore apertura e responsabilità nell’operato delle istituzioni pubbliche. I diritti umani, fondamentali per entrambi i paesi, sono stati al centro delle conversazioni, evidenziando l’impegno a tutelare e promuovere la dignità di tutte le persone.

L’incontro bilaterale non rappresenta solo un singolo momento, ma è parte di un impegno continuo alla cooperazione internazionale. Italia e Brasile si sono impegnati a continuare a condividere esperienze, conoscenze e strategie per affrontare le sfide globali. La collaborazione tra le due Istituzioni mira a costruire un patto di amicizia a medio lungo termine.

La presenza di rappresentanti di alto livello da entrambi i paesi riflette l’importanza di creare un dialogo significativo e costruttivo su questioni di rilevanza globale. Momenti come questi dimostrano il potenziale della cooperazione internazionale nel promuovere soluzioni innovative e nel difendere valori universali.
