Ombudswoman Requests Constitutional Review of the Mandatory Health Insurance Act Amendments

As previously announced, Ombudswoman Tena Šimonović Einwalter submitted a request for a constitutional review of certain provisions of the amendments to the Mandatory Health Insurance Act to the Constitutional Court last week. According to these provisions, some citizens are required to personally visit the Croatian Institute for Health Insurance every three months to maintain their health insurance coverage.

If one is to assume that these amendments were intended to determine the number of insured persons and prevent abuse, this could have been achieved in a different way. Personal visits every few months should not be the only means of verifying the citizens’ life circumstances in the 21st century. Moreover, no exceptions have been specified in the law, for example for the persons with mobility issues, and the law does not require the Croatian Institute for Health Insurance to issue decisions in cases in which the citizens health insurance is terminated due to failure to personally visit its offices on a quarterly basis, which is a precondition for the filing of an appeal.

The Ombudswoman emphasizes that all legislative solutions, in line with the principles of legal certainty and the rule of law, should be thoroughly planned out, clearly defined, and justified in advance, and the failure to take these steps cannot be compensated by subsequently allowing individual exceptions. When designing new legislative solutions, it is always necessary to consider the effects on different groups of citizens, not forgetting the most vulnerable.

Instead of the periodic personal visits, the Ministry of Health could have utilized data exchange between various public bodies and facilitated their stronger cooperation. For example, it would have been possible to enhance the cooperation between the Croatian Institute for Health Insurance and inspections and to use the records of the Ministry of Finance – Tax Administration (regarding tax residency) and the Ministry of the Interior (to control the status of Croatian citizens residing and working abroad without registering a change or cancellation of residence in Croatia).

This solution is problematic when it comes to individuals with mobility issues or those undergoing treatment in healthcare facilities, who therefore cannot appear at the Institute’s offices in person. An additional problem arises if they live in areas with no public transportation or with poorly organized transportation to the nearest Croatian Institute for Health Insurance office. Citizens in these situations will be at risk of being discriminated against based on disability, health condition, and financial status, and put in an unequal position before the law.

The issue of mandatory health insurance when it comes to students studying outside of Croatia and the European Union is currently unclear, even though the Republic of Croatia has a constitutional obligation to protect the youth, and it would thus make sense for the government to support young people pursuing education, to maintain a connection with them during their studies, and to then encourage their return to Croatia after completing their studies.

A particular problem lies in the fact that the Croatian Institute for Health Insurance currently does not have the obligation to issue decisions to citizens confirming their cancellation of health insurance unless they specifically request it. However, it is questionable how many of them will be aware of this possibility, and since it is not possible to file an appeal without a decision, they will, consequently, not be able to do so.

In her request for constitutional review the Ombudswoman proposed that the Constitutional Court issue a temporary suspension of the implementation of these provisions until a final decision is reached. Furthermore, given the various types of information available in the public domain regarding this topic, she proposed that the Constitutional Court decide on the matter based on a public debate in which representatives of the Ministry of Health, as the expert body responsible for the amendments to the Mandatory Health Insurance Act and of the Croatian Institute for Health Insurance, as the implementing body, would be invited to participate. This is particularly important taking into account the fact that the amendments to this piece of legislation failed to clearly define the intended objective and to specify whether less burdensome measures, such as data exchange between public bodies, were considered and, if so, why they were not chosen.

It should be noted that the Ombudswoman has been raising these issues even before the aforementioned law was sent to the parliamentary procedure.

Control de la contaminación acústica

La institución Defensor del Pueblo recibe todos los años cientos de quejas, sobre todo en verano, por el ruido y las molestias que generan las actividades aire libre: festivales de música, espectáculos diversos o las fiestas patronales que se celebran, junto a núcleos urbanos, en pueblos, barrios y ciudades.

A través de las quejas que tramita, el Defensor recuerda a los ayuntamientos que la Ley 37/2003, de 17 de noviembre, del Ruido atribuye a las corporaciones locales la labor de prevención, vigilancia y reducción de la contaminación acústica en su territorio y que deben buscar el equilibrio entre las actividades –económicas, festivas, culturales o lúdicas– y los derechos de los vecinos.

Según la institución, solo una regulación adecuada, y la supervisión efectiva del cumplimiento de las condiciones en las que estas actividades deben realizarse, evitará que los centros urbanos o sus inmediaciones se conviertan en lugares inhabitables, por la imposibilidad de que los vecinos desarrollen una vida normal, conforme a los derechos que la Constitución les garantiza.

“No se trata de imposibilitar el desarrollo de actividades ligadas a eventos lúdicos o culturales. Lo que se pretende es que sean compatibles con el respeto al derecho al descanso que asiste a los residentes en áreas cercanas a los lugares donde tengan lugar acontecimientos de este tipo”, señala el Defensor del Pueblo, Ángel Gabilondo.

El Defensor del Pueblo recomienda, entre otras medidas, que se exija a los organizadores la utilización de limitadores de sonido en altavoces y megafonía, además de determinar horarios razonables y reducidos cuando se celebren actos y espectáculos en la vía pública que utilicen música amplificada.

La institución reclama, además, a los ayuntamientos que realicen las mediciones acústicas y los controles necesarios y que, ante emisiones por encima de los valores máximos establecidos, adopten las medidas necesarias para lograr que se acomoden a la normativa, llegando a aplicar, en su caso, sanciones que deben resultar disuasorias.

Asimismo, desde el Defensor del Pueblo se recuerda que los ciudadanos pueden y deben exigir a los ayuntamientos que realicen las mediciones acústicas cuando sientan que se están viendo afectados por alguna actividad molesta, y les insta a quejarse en esta institución si consideran que las administraciones no están protegiendo adecuadamente sus derechos.

El Defensor destaca el trabajo realizado en el Cerro del Moro como ejemplo de colaboración

El Defensor del Pueblo andaluz, Jesús Maeztu, ha destacado hoy el trabajo realizado en el barrio del Cerro del Moro de Cádiz como ejemplo de la colaboración institucional en beneficio de las necesidades de la ciudadanía. Maeztu ha asistido hoy como Hijo Predilecto de la Provincia al pleno de constitución de la nueva corporación de la Diputación provincial de Cádiz, que presidira Almudena Martínez del Junco.

El Defensor del Pueblo andaluz se ha interesado en numerosas ocasiones en los últimos años por la remodelación del barrio, que ha visitado acompañado de los vecinos, así como ha mantenido diversas reuniones con las autoridades responsables de la programación y ejecución de las obras.

En ese sentido Jesús Maeztu se ha congratulado de que este impulso por parte de la Institución se haya concretado y que esta semana la Consejería de Fomento, Articulación del Territorio y Vivienda, a través de la Agencia de Vivienda y Rehabilitación de Andalucía (AVRA), haya presentado en el Ayuntamiento de Cádiz la solicitud de licencia de obras para acometer la construcción de las 67 viviendas proyectadas para la séptima fase de la intervención en la barriada. A esta reunión asistieron entre otros la consejera de Fomento de la Junta de Andalucía, Rocío Díaz, y el alcalde de Cádiz, Bruno García.

La presentación de esta documentación supone un paso importante en el proceso para finalizar la operación de rehabilitación integral de la barriada, que se inició la década de los 90. Resta la construcción de 67 viviendas para realojar a otras tantas familias, que aún permanecen en los últimos edificios en pie desde que se construyeran en 1940 y que se encuentran muy degradados.

« Tout a changé » : quand l’arrivée d’un nouveau chef dégrade les conditions de travail

« Pendant trente ans, j’ai été salariée dans la même entreprise et je n’ai jamais rencontré de difficultés. Mais tout a changé à l’arrivée d’un nouveau supérieur hiérarchique. Il me retire tous les projets sur lesquels je travaille en les motivant par mon manque d’expérience et mon incompétence.

Je contacte l’inspection du travail qui demande des précisions à mon supérieur. Il revient alors sur ses déclarations mais ne me confie pourtant aucun projet. À l’occasion de ce problème, je constate que ma rémunération est inférieure à celle de mes collègues masculins sans qu’aucune explication objective ne me soit donnée.

Accord amiable

J’alerte ma direction, les ressources humaines et les représentants du personnel. En vain. Je suis très choquée par cette situation. Mon état de santé se détériore et je suis arrêtée de longs mois. Je me décide alors à prendre contact avec les services du Défenseur des droits en espérant qu’il pourra trouver une solution. Ils sont intervenus auprès de ma direction à plusieurs reprises afin de trouver un accord amiable pouvant me convenir ainsi qu’à mon employeur.

Finalement, nous avons signé un protocole et j’ai perçu une indemnité forfaitaire pour le préjudice subi. Je remercie vivement le Défenseur des droits pour son intervention efficace qui m’a sortie d’une grande détresse. »

The European Parliament Adopts its Position on the EU AI Act
On 14 June, within its plenary session in Strasbourg, the European Parliament adopted its negotiating position on the Artificial Intelligence Act (AI Act), with 499 votes in favor, 28 against and 93 abstentions. This legislation would ensure, through a risk-based approach, that Artificial Intelligence developed and deployed in Europe is in line with EU rights and values, including transparency, safety, human rights, and equality. Now the European Parliament is negotiating with the Council for the adoption of the Act.

The European Cancer Pulse: Data Visualisation on Cancer Inequalities in Europe 
The European Cancer Pulse is a data visualisation tool developed by the European Cancer Organisation, which gathers the currently fragmented data on cancer inequalities in Europe in a single easy-to-navigate and accessible platform, aimed at policymakers, health professionals, patients and everyone interested in getting informed on the topic. The tool aims to gather data across all remits of cancer care and social inequalities in care affecting marginalised communities such as racialised people, the LGBTQI+ community, refugees, currently homeless people and others. 
 
Given the fragmentation of the data, the European Cancer Organisation  is looking for submissions of data in this topic from organisations, researchers, and healthcare providers. To submit or know more, please contact: norbert.couespel@europeancancer.org.

The 2022 annual report for the Equal Opportunities Ombudsperson, recently published in English, provides an overview of the equal opportunities situation in Lithuania and the results of the office's work. The report features recent amendments to the national Law on Equal Treatment, which strength the country’s protection against discrimination.


Fundamental Rights Report 2023
The annual report by the European Union Agency for Fundamental Rights (FRA) reviews the major developments concerning fundamental rights in 2022. Let’s Get Loud! The FRA’s EU LGBTIQ Survey is Online
The European Union Agency for Fundamental Rights (FRA) launched their third EU-wide LGBTIQ survey, aiming at assessing the status of LGBTIQ equality in Europe and capturing the lived experiences of LGBTIQ people aged 15 or older in 30 countries: the 27 EU Member States plus Albania, North Macedonia, and Serbia. The survey closes at the end of July.

Call for Inputs: Mid-Term Review of the LGBTIQ Equality Strategy (2020-2025)
The European Commission has launched a questionnaire for civil society and all relevant stakeholders to gather their input on the current situation of LGBTIQ people in the Europe and the state of implementation of the LGBTIQ Equality Strategy, with a special focus on intersectionality, mainstreaming, and supporting Member States. The deadline for submitting your answers to the questionnaire is 17 July.
