Chaired by the Commissioner for Fundamental Rights of Hungary, Dr. Ákos Kozma, the meeting of the Disability Advisory Board, which consists of the representatives of the organisations active in various fields of disability in Hungary was held at the General Directorate of Disability of the Office of the Commissioner for Fundamental Rights of Hungary in Debrecen on 15 November 2023. This board assists the Commissioner for Fundamental Rights of Hungary in performing his tasks related to the independent mechanism under the UN Convention on the Rights of Persons with Disabilities (CRPD). 

At the meeting, Dr. Kozma presented the experience gained from his inquiries in the area of disability and provided information on the activity of the General Directorate of Disability to date. After the meeting, the members of the board visited the complaint offices of the General Directorate of Disability and the Debrecen, Hungary field office and they were provided detailed information on the work done here.

(PETI) Ombudsman’s work in 2022: access to documents, conflicts of interest and other areas

The Ombudsman’s work in 2022 improved administrative practices, promoted accountability and improved the accessibility of documents for EU citizens, argue MEPs.

In their annual report on the activities of the European Ombudsman, MEPs praised the Ombudsman’s Office for promoting high accountability and transparency standards for the EU’s administration. The draft report was adopted unanimously by the Petitions Committee with 28 votes in favour, 0 against and 0 abstentions.

MEPs underline that the participation of citizens in EU decision-making is important for its legitimacy, and appreciate the Ombudsman’s commitment to foster accountability in EU decision-making, especially in the area of environmental decisions. In its strategic work in 2022, the Ombudsman opened new strategic inquires on ethical issues such as conflicts of interest, ‘revolving doors’, accountability in decision making, access to documents, and fundamental rights.

In 2022, the Ombudsman continued to investigate how the EU administration deals with so-called ‘revolving doors’ situations of staff moving from EU institutions to the private sector. They also continued a strategic inquiry into how the Commission handles such situations, and an own-initiative inquiry into how the European Central Bank manages them, asking for stricter rules. MEPs encourage the Ombudsman to continue to monitor the Commission’s handling of such cases.


Inquiries concerning the European Commission


In the past year, the largest percentage of the Ombudsman’s inquiries concerned the Commission, whose administrative activities receive considerable public attention. The Ombudsman opened an own-initiative inquiry to assess how the Commission ensures that its interactions with tobacco industry representatives are transparent, and worked to improve transparency in environmental information related to decision-making. MEPs also underline the importance of thoroughly assessing the conflicts of interest of appointed experts, and ask the Commission to follow the Ombudsman’s suggestions of adopting stronger rules to prevent conflicts of interest.

Following the Ombudsman’s inquiry into the Commission’s handling of text messages exchanged between the Commission President and the CEO of a pharmaceutical company on purchasing COVID-19 vaccinesMEPs welcome the resulting recommendations on handling work-related text and instant messages. They also stress that EU institutions must fully comply with these recommendations in order to bring the practices of the EU administration into line with modern communication methods, and find that the failure to subsequently find such text messages amounts to maladministration, as did the Ombudsman.

On public access to documents, MEPs urge the European Commission to improve administrative practices so that it respects the timelines set out by legislators and to demonstrate that transparency is the rule in handling document access requests. They also support the Ombudsman’s call for the Commission to set up a new and separate complaint handling portal for alleged human rights abuses.

In 2022, the Ombudsman also investigated the monitoring of fundamental rights compliance at the Croatian border, and asked European Border and Coast Guard Agency (Frontex) to improve its accountability after conducting a strategic inquiry into its fundamental rights compliance. MEPs urge Frontex to adequately follow up with the Ombudsman’s recommendations.

The resolution will be tabled for a future plenary session of the European Parliament.


Background


The Ombudsman’s top three concerns in the inquiries closed in 2022 were transparency and accountability (access to information and documents) (32 %), culture of service (20 %) and respect for fundamental rights (15 %).

In 2022, 16.569 citizens called on the Ombudsman’s services for help, of whom 13.313 were given advice through the Interactive Guide on the Ombudsman’s website, while 1.038 remaining requests for information were replied to by the Ombudsman’s services and 2.238 were handled by the Ombudsman as complaints.

Principio de equidad

La institución Defensor del Pueblo ha recomendado a la Comunidad de Madrid que revise los criterios de renta establecidos en su normativa reguladora para la concesión de becas y ayudas al estudio con la intención de que éstas cumplan la finalidad de compensar al alumnado con desigualdades socioeconómicas desfavorables.

El Defensor del Pueblo, tomando en consideración la limitación de recursos disponibles y la obligación legal de garantizar el derecho a la educación de estudiantes de familias con rentas más bajas, señala “la falta de adecuación al principio de equidad que supone facilitar el acceso a ayudas para estudios a alumnado con rentas altas y negar el acceso a becas de comedor escolar a alumnado que se encuentra por debajo del umbral de la pobreza”.

El Defensor del Pueblo inició una actuación ante la Consejería de Educación, Ciencia y Universidades de la Comunidad de Madrid, tras recibir una queja de la Federación de la Comunidad de Madrid de Asociaciones de Padres y Madres del Alumnado (FAPA) Francisco Giner de los Ríos, que manifestaba su desacuerdo con el criterio de renta familiar fijado en las convocatorias para el acceso a las becas que concede la Comunidad de Madrid para cursar estudios en centros privados de Educación Infantil, Bachillerato y Formación Profesional.

La FAPA Francisco Giner de los Ríos manifestó en su queja que la regulación establecida por la Comunidad de Madrid no atendía a la finalidad de las becas de garantizar, en la medida de lo posible y dentro de las limitaciones presupuestarias, la igualdad de oportunidades en el ejercicio del derecho a la educación con el objeto de evitar discriminaciones por razones económicas.

La Consejería, por su parte, apuntó, en un informe remitido al Defensor, que la orden 1533/2022 de 2 de junio, por la que se aprueba la convocatoria de becas para el estudio de Bachillerato, vincula la concesión de las becas a la defensa de la excelencia académica y a la voluntad de apoyar la libertad de elección de centro de las familias, algo que, a juicio de la institución Defensor del Pueblo, no ocurre ya que las ayudas se conceden sin tomar en consideración el expediente académico.  

El Defensor subraya en la recomendación que acaba de emitir que “aunque no le  corresponde a esta institución determinar los umbrales de renta que dan acceso a las ayudas”, sí ha analizado el informe recibido de la Consejería de Educación “para determinar si los criterios para la fijación de esos umbrales, que constituyen el elemento troncal del sistema de becas, son compatibles con la finalidad que las justifica de atender a los ciudadanos con condiciones socioeconómicas desfavorables”. Y recomienda que éstos sean revisados.
