Das Thema „inklusive Gesundheit und Pflege“ stand im Mittelpunkt des 65. Treffens der Behindertenbeauftragten des Bundes und der Länder am 11. und 12. Mai 2023 in Bad Nauheim.

In einer Bad Nauheimer Erklärung fordern die Beauftragten, dass der Zugang zur allgemeinen Gesundheitsversorgung inklusiv und barrierefrei gestaltet sein muss. Auch medizinische Rehabilitation müsse mit dem Ziel gewährleistet werden, Menschen mit Behinderungen ein Höchstmaß an Unabhängigkeit sowie umfassende körperliche, geistige, soziale und berufliche Fähigkeiten zu ermöglichen.  

La adjunta segunda del Defensor del Pueblo, Patricia Bárcena, ha intervenido en la 85 Sesión del Comité para la Eliminación de la Discriminación contra la Mujer de Naciones Unidas, que se ha celebrado en el Palacio de las Naciones de Ginebra el 15 y 16 de mayo.

Bárcena ha participado, representando a la institución Defensor del Pueblo, en la Sesión de Examen del Informe a España donde ha presentado la contribución de la institución, en su condición de Institución Nacional de Derechos Humanos, al noveno proceso de revisión de la aplicación de la Convención sobre la Eliminación de Todas las Formas de Discriminación contra la Mujer.

Durante la intervención ha señalado que, aunque se han producido avances importantes para adecuar el ordenamiento español a la Convención y a las recomendaciones del Comité, quedan cuestiones pendientes para la “real y efectiva eliminación de toda forma de discriminación contra la mujer”.

De entre las quejas investigadas por la institución,  se ha destacado tres asuntos: violencia de género, procesos administrativos y judiciales y mujeres extranjeras, sobre los que ha señalado que “pese a que se han producido modificaciones legislativas, su aplicación práctica no ha tenido los efectos deseados”.

La adjunta segunda ha apuntado que se ha ampliado el concepto de violencia de género, pero continúa existiendo disparidad en los requisitos de acreditación de la condición de víctima en función de la Administración. Ha pedido, también, en materia de violencia de género, que se dote de recursos y personal especializado en atención jurídica, psicológica y social a los servicios públicos de atención a víctimas de violencia contra la mujer. Ha reclamado, asimismo, un protocolo para los servicios psicosociales y mejoras en los puntos de encuentro familiar autonómicos y locales.

En lo relativo a procesos administrativos y judiciales se ha insistido en la necesidad de mejorar el proceso de denuncia para que las víctimas no se sientan cuestionadas. Y ha recordado, al tiempo, la recomendación formulada por la institución para que se unifiquen en un único procedimiento los aspectos civiles y penales de la violencia de género que afecten a una misma unidad familiar, haciendo hincapié en que la situación de los niños y niñas víctimas directas o indirectas de la violencia de género y la violencia vicaria reciban la máxima atención.

Por otra parte, y en relación a las mujeres extranjeras, la adjunta segunda ha subrayado que 54.623 mujeres solicitaron protección internacional en España en 2022 y ha abogado por acometer una reforma estructural del sistema de gestión, tramitación y acogida para identificar vulnerabilidades. Además, ha resaltado que siguen existiendo carencias en la identificación y protección de las víctimas de trata y que a la institución Defensor del Pueblo le preocupa las condiciones de explotación y alojamiento de algunas mujeres temporeras que se desplazan cada campaña a las poblaciones rurales.

The Ombudsman’s Office has been receiving a significant number of complaints regarding various aspects of the measures adopted, since September 2022, in the context of mitigating the effects of inflation.

The analysis and resolution of these complaints allowed the acquisition of vast information regarding the practical application of the measures, as well as the revelation of some problems of conception and articulation of the regimes that approved them.

In this context, the Ombudsman’s Office prepared a brief thematic report, which it sent to the Government on 8 May. Here it is pointed out, namely, the lack of clarity of the transitional regime for updating pensions; inaccuracies in defining the recipients of the measures; the lack of provision for unseizability of financial support.

The study was carried out with the dual purpose of presenting a survey of the insufficiencies and difficulties that citizens and the services themselves are faced with in this matter, and of helping to avoid the repetition of some constraints detected in the design of possible future measures.

Pursuant to Article 22(4) of the Ombudsman Act, the Ombudsman and the Commissioner for Education have forwarded the Final Opinion on a complaint to the House of Representatives. The complaint, lodged by two sixth-form teachers, addresses the unjust situation resulting from the pegging of calls for teachers in private and church schools with those issued by the Ministry for Education.

Summary of the Case

Two sixth-form teachers, currently employed at a church school, lodged a complaint with the Ombudsman. Despite having been in full-time teaching at a church school for several years, they are facing an issue due to an anomaly in the employment/recruitment system in Government schools for post-secondary and higher-level teachers. Their salary, funded by the Government through the Education Division at the Ministry responsible for Education (in line with Malta’s Agreement with the Holy See), remains pegged at the level of a supply graduate teacher, even though they effectively perform duties as regular teachers.

Following a thorough examination of the facts and the changes over time of the requirements for a teacher’s warrant, the Commissioner for Education has concluded that the aforementioned practice is unjust, verging on the oppressive with the passage of time.

The Commissioner recommended that calls for applications for the post of teacher in post-secondary education (i.e., post-compulsory education stage) should be separate and distinct from calls for the post of teacher in secondary education and should reflect the current law of not requiring a permanent teaching warrant. The Commissioner also recommended that the remuneration transferred by the Education Division within the Ministry to the school employing the complainants should, with immediate effect, reflect the salary commensurate with that of a regular teacher, not a supply teacher.

Outcome

The Ministry for Education was informed of the Final Opinion of the Commissioner for Education on 2nd February 2023. Despite a reminder being sent a month later, the Office of the Ombudsman has received no response.

The Ombudsman and the Commissioner brought the case to the Prime Minister’s attention on 28 March 2023. Since no action has been taken, the Ombudsman and the Commissioner forwarded the report to the House of Representatives for its attention.
