Una persona acudió al Ararteko ante la falta de respuesta del Ayuntamiento de Lemoiz a una denuncia presentada por las obras de ampliación y usos urbanísticos de una nave agrícola. En concreto, señalaba que el edificio se ubica en una zona clasificada como suelo no urbanizable con categoría agroganadera y forestal, de alto valor estratégico.

Tras analizar la queja, el Ararteko recordó al Ayuntamiento de Lemoiz la obligación de tramitar e impulsar de oficio, dentro de las garantías y plazos previstos para cada caso, los procedimientos para el ejercicio de las potestades de inspección urbanística encomendadas respecto a la denuncia, comunicando a las personas interesadas las actuaciones que deriven de la inspección realizada.

En su respuesta el Ayuntamiento de Lemoiz reconoce que debe ejercer su potestad de control de la legalidad urbanística.

De ese modo, informa que va a trasladar el expediente a la oficina técnica, con el fin de que se realice una visita de inspección y se elabore un informe donde se dé una respuesta clara y motivada a todas las cuestiones planteadas. Asimismo, si así se derivara del informe técnico, se compromete a instruir los expedientes de restauración de la legalidad urbanística y sancionador. Por último, señala que se mantendrá puntualmente informada a la persona reclamante de todas las actuaciones que lleven a cabo.

Sobre la base de esa respuesta municipal que acepta la recomendación remitida, el Ararteko ha acordado suspender la tramitación de esta queja.

RESOLUCIÓN

El Defensor del Pueblo, Ángel Gabilondo, se ha reunido este lunes, en la sede de la institución, con el secretario general de la Organización de Estados Iberoamericanos para la Educación, la Ciencia y la Cultura (OEI), Mariano Jabonero, y con los integrantes de una comisión de expertos de alto nivel que les asesora en su Programa de Derechos Humanos, Democracia e Igualdad.

El propósito de la OEI es contribuir a consolidar en Iberoamérica sociedades más cohesionadas, justas y tolerantes. Según el Defensor del Pueblo, Ángel Gabilondo, es la educación el elemento cohesionador e imprescindible para alcanzar los objetivos marcados por esta organización.

En la reunión han estado presentes además Irune Aguirrezábal, directora del Programa Iberoamericano de Derechos Humanos, Democracia e Igualdad, así como los expertos Daniel Zovatto, académico y experto en política latinoamericana; Yasna Provoste, senadora de Chile; Yago Pico de Coaña, exdiplomático de España; Olinda Salguero, presidenta de la Fundación Esquipulas para la Paz, Democracia, Desarrollo e Integración de Guatemala, y Gerardo L. Munck, profesor de Ciencias Políticas y Relaciones Internacionales de la Universidad del Sur de California.

Por parte de la institución, también han participado la directora del Gabinete del Defensor, Isabel Aymerich, y el secretario general de la institución, José Manuel Sánchez Saudinós.   

Previamente a este encuentro, Ángel Gabilondo ha asistido a varios paneles en el que han participado los expertos en una jornada que se ha desarrollado en Casa América.

El Defensor del Pueblo de Navarra se reunió con Ehuleak el viernes, 5 de mayo

La prostitución está ligada en gran medida a la trata de personas y a la explotación sexual. Buena parte de mujeres en prostitución son captadas mediante engaño y se encuentran en una situación de vulnerabilidad extrema al no contar con apoyos socio familiares y carecer de documentación válida para residir y trabajar, lo que las lleva la prostitución para saldar sus deudas. Por ello, les resulta muy complicado el proceso de salida de la explotación sexual, según manifestaron Sara Vicente y Edurtxa Artoleta, presidenta y vicepresidenta respectivamente de Ehuleak al titular del Defensor del Pueblo de Navarra, Patxi Vera, y a la jefa de Gabinete de la Institución, Susana Galilea, en un encuentro celebrado en el centro comunitario Plazara.

Desde Ehuleak, la plataforma navarra de mujeres por la abolición de la prostitución creada en 2019, llevan a cabo programas de inserción sociolaboral y acompañamiento a mujeres en situación de prostitución. Realizando esta labor, han detectado, entre otros temas, el gran desconocimiento que existe sobre la prostitución de mujeres chinas y la existencia de abusos a la hora del empadronamiento, una circunstancia comunicada al Defensor también por otras entidades sociales. Una de sus principales reivindicaciones es un mayor apoyo institucional y políticas sociales que permitan a las mujeres abandonar la prostitución porque, según afirman, salir de la prostitución es posible.

We have been saddened by the news that Ivan Bizjak, the first Human Rights Ombudsman in the independent Republic of Slovenia, an esteemed colleague and a great man, passed away at the age of 68.

He was elected to the position of the Ombudsman in 1994 and he carried his six-year mandate through until September 2000. While laying the foundations of the institution of the Ombudsman of the Republic of Slovenia, of which he was the founder, he and only a handful of colleagues at the time followed three aspects of operation that still distinguish the institution of the Ombudsman from the state apparatus that it supervises. For the collection of papers on the 20th anniversary of the Ombudsman's operation in 2014, he described the institution's mission in the following words: “First, we are here to solve people's problems. The problem is not an interruption in our work, problems are our work. Second, we must do the best we can for anyone who reaches out to us. Third, we must be better than those we criticize.”

With his approach, the late Ivan Bizjak implemented a comprehensive human approach to the work of the institution – not only strictly legal, or merely analytical, but least of all mathematical, even though he had a bachelor's degree in mathematics. Above all, he strived to gain people's trust, strengthen the recognition and reputation of the institution, which, as he himself thought, “means walking a lonely path. Establishing an institution and at the same time demonstrating its effectiveness – this is a serious challenge. At the formal start of the operation of the Ombudsman, we already had more than three hundred initiatives on the table. And hardly any people.”

But although the initial steps may have been full of challenges, Ivan Bizjak, also with the help of his successors, managed to establish a trustworthy institution. With his involvement in the international field – both within the framework of the then European Association of Ombudsmen (1995–2000) and the International Ombudsman Institute (1996–2000), in which he was a member of the leadership – he also strengthened the institution’s international reputation. “Cooperation among ombudsmen is strongly established, as the Ombudsman is a rather isolated institution in their own country. In this collaboration, colleagues take seriously those who can prove that they are firm and consistent in their work, observe the fundamental principles of the ombudsman concept and, of course, are in no way just a fig leaf of the authorities. Contacts at the international level initially enabled me to transfer the good practices of established institutions, which was also very useful later in the period of closer cooperation and leadership roles in international associations. This aspect, too, therefore benefited the people we served,” he remembered on the 20th anniversary of the institution, which he led between 1994 and 2000.

Ivan Bizjak worked tirelessly for the respect of human rights and fundamental freedoms of everyman. His legacy is priceless, with his engagement and the tireless work of the Ombudsman's colleagues, he ensured the correction of thousands of injustices. As an expert on human rights issues, he was a respected lecturer and author of numerous expert articles on this issue, even after the end of his mandate as Ombudsman.

The colleagues of the Human Rights Ombudsman of the Republic of Slovenia will remember him as an exceptional person. Our deepest respect.

A conference on "Police arbitrariness and racist motivation" was held by the Ombudsman on Tuesday, May 2, in the hall of the Thessaloniki Bar Association.

At the event, in addition to the Ombudsman Andreas Pottakis, spoke Elisavet Symeonidou-Kastanidou, Professor of the Law School of the Aristotle University of Thessaloniki, Kostas Tsitselikis, Dean of the School of Economics and Regional Studies of the University of Macedonia and Stavros Keselidis, Deputy General Director of the Police Force of Thessaloniki.
