Die parlamentarisch gewählten Bürgerbeauftragten der Bundesländer haben heute in Schwerin im Rahmen ihrer Jahrestagung eine Schweriner Erklärung verabschiedet. Mit Sorge sehen sie, dass Verwaltungsverfahren in vielen Bereichen immer länger dauern und öffentliche Dienstleistungen immer mehr Zeit benötigen. Sie fordern daher einen besseren Zugang zu Behörden und ihren Dienstleistungen. Es fehlten oft noch Onlinezugänge für Amtshandlungen. Zudem fehle Personal in den Ämtern. Die Bürgerbeauftragten fordern einen umfassenden Lösungsansatz der Politik und eine gesamtstaatliche Kraftanstrengung für durchgreifende Lösungen.

Matthias Crone, derzeit Vorsitzender der Arbeitsgemeinschaft der parlamentarisch gewählten Bürgerbeauftragten, sagte heute in Schwerin:

„Auch mich erreichen dazu viele Petitionen. Ich sehe und anerkenne, dass viele Behörden seit der Corona-Pandemie im Krisenmodus arbeiten. Aber gerade in Krisenzeiten ist es wichtig, dass der Staat handlungsfähig bleibt. Vertrauen in unseren Staat erwächst nicht nur durch Entscheidungen der Landes- oder Bundesparlamente. Die Bürgerinnen und Bürger müssen vor Ort ganz praktisch erfahren, dass ihr Antrag schnell bearbeitet und zum Beispiel eine Leistung zügig gewährt wird. Ein guter Zugang zu Behördendienstleistungen ist eine ganz wichtige Voraussetzung für die Akzeptanz unseres demokratischen Rechtsstaats“.

El Ararteko recibió un escrito de queja de una estudiante de la UPV/EHU que tiene un grado de discapacidad física del 82%, por lo que requiere de un técnico de apoyo educativo para seguir con sus estudios universitarios en condiciones de igualdad con el resto del alumnado.

La interesada exponía que había dispuesto de un técnico de apoyo educativo en los cuatro años que había cursado un Grado en Trabajo Social, pero que, tras haber vuelto a solicitar dicho recurso para estudiar un máster en Gestión e Innovación en Servicios Sociales, dicha petición había sido desestimada, de acuerdo con lo dispuesto en el Reglamento de Igualdad de Oportunidades en la atención al alumnado con necesidades especiales de la UPV/EHU.

En la resolución desestimatoria se indicaba que el postgrado para el que se ha solicitado el recurso es un título propio y que, de acuerdo con lo dispuesto en el reglamento citado, por no tratarse de un título oficial, no le correspondía la asignación de un técnico de apoyo educativo. 

El Ararteko solicitó la colaboración de la UPV/EHU que remitió un informe en el que manifestaba, entre otras cuestiones, que “El derecho a solicitar a la UPV/EHU la dotación de recursos a los estudiantes con discapacidad y/o necesidades educativas especiales está, como el ejercicio de cualquier derecho, sometido a límites”.

Añadía la universidad que “El reconocimiento del derecho a los y las estudiantes con discapacidad y/o necesidades educativas especiales matriculados en titulaciones propias de la UPV/EHU a disponer de medios, apoyos y recursos no solo comprometería seriamente la sostenibilidad del actual sistema de atención y apoyo a las personas con discapacidad y/o necesidades educativas especiales, sino que además haría inviables la continuidad del propio sistema de Enseñanzas Propias”.

Sin embargo, el Ararteko considera que la no asignación del recurso solicitado por la estudiante impide que pueda acceder a la única especialización impartida por la UPV/EHU vinculada a la titulación de grado en Trabajo Social que ha cursado. La denegación del recurso de apoyo que requiere, según los términos establecidos en el vigente Reglamento de oportunidades en la atención del alumnado con necesidades especiales, supone una forma de discriminación por motivos de discapacidad.

Por ello, el Ararteko recomienda a la UPV/EHU que amplíe a todas las enseñanzas universitarias el ámbito de aplicación del Reglamento de Igualdad de Oportunidades en la Atención al Alumnado con Necesidades Educativas Especiales de la UPV/EHU, ya que así se garantizaría el acceso al alumnado con discapacidad a dichas enseñanzas en igualdad de condiciones.

El Defensor del Pueblo de Navarra ha aprobado la convocatoria de una beca de formación, de duración anual y con requisito de conocimiento de euskera, para personas con grado en Derecho.

Las bases que rigen la convocatoria se publicarán en el Boletín Oficial de Navarra.

La beca tendrá una duración de doce meses. La ejecución de la beca requerirá la presencia de las personas beneficiarias en la sede del Defensor del Pueblo de Navarra durante 30 horas semanales.

Las personas interesadas deberán presentar, en el plazo de 15 días naturales contados a partir del siguiente al de la publicación en el BON, la instancia y la documentación requerida en el registro del Defensor del Pueblo de Navarra, situado en la calle Emilio Arrieta 12 bajo, 31002, Pamplona-Iruña, o por correo electrónico, en la dirección info@defensornavarra.es.

Leicestershire County Council has agreed to refund a mother’s school transport costs after the Local Government and Social Care Ombudsman found flaws in the way it handled her application.

The mother had appealed an unsuccessful application for school transport costs for her teenage son, who has disabilities and attends the post-16 section of a special school.

The council upheld her appeal, but the mother complained the council refused to backdate the money she paid for her son’s transport while the council considered her appeal, despite her having spent more than £7,000.

The Ombudsman investigated the mother’s complaint and found faults with the process the council used for both the application for transport, and for considering the appeal of the decision.

The investigation found the council took too long to reach its initial decision on the family’s school transport application, and that the information provided to parents about timescales was misleading.

The information provided by the council on its website about the appeals process was also criticised by the investigation, which found a link to the appeals process did not work, and so parents had to find the forms on the website themselves. It also found problems with the length of time the council took to consider the appeal, which meant the hearing took place after the school year started.

Additionally, the family incurred a significant financial cost as the council took three months to arrange provision after their appeal in the October.

Paul Najsarek, Local Government and Social Care Ombudsman, said:

“When carrying out assessments and appeals for any services, councils need to ensure transparency, timeliness and accountability. But in this case Leicestershire’s school transport process was beset by delay and a lack of clear information.

“This investigation also found that this process was inherently inferior for children and young people with Special Educational Needs. Because their places are decided later in the year they have been disproportionately affected and less likely to have their appeals heard in time for transport to be put in place for the start of term.

“I am pleased Leicestershire County Council has taken on board my findings, and hope the changes it has agreed to make to its application and appeal process will ensure other children and young people with disabilities will not be adversely affected in future.”

The Local Government and Social Care Ombudsman remedies injustice and shares learning from investigations to help improve public, and adult social care, services. In this case the council will apologise to the family and reimburse the costs they incurred minus the personal transport budget payments received. It will also pay them £500 to recognise the avoidable distress caused by the council’s poor handling of their application and appeal.

The Ombudsman has the power to make recommendations to improve processes for the wider public. In this case the council will ensure information provided to applicants is accurate. It will also consider providing information relating to SEND transport in the relevant policy and will also consider looking at its systems to ensure any issues identified can be dealt with promptly.

It will also meet the costs of transport following a successful appeal, if it is unable to arrange suitable transport within a reasonable time, and where a parent is meeting the cost themselves.

The parliamentarily elected ombudsmen and police commissioners of the federal states will meet for their annual meeting on 20 and 21 April 2023 in Schwerin. The country's Ombudsman, Matthias Crone, is currently chairman of the Working Group of Parliamentarily Elected Ombudsmen. The conference will be opened by him together with Birgit Hesse, President of the State Parliament. In the afternoon, there will be a consultation on current police issues with Interior Minister Christian Pegel.

The list of topics on the agenda ranges from social law issues, such as citizen's allowance or housing benefit, to police operating conditions. The host Ombudsman, Matthias Crone, sees a particular focus on the consultations on good access to public authority services. He said in the run-up to the event:

"On the one hand, online access to official acts is still underdeveloped. On the other hand, I have been concerned for some time that since the Corona pandemic, general opening hours have been greatly reduced or completely abolished and office hours are only allocated by appointment, often with long waiting times. However, a public office building also includes access for the public that is as unhindered as possible. We will discuss how good access to public services for citizens must look like and how to ensure them," said Matthias Crone.

In addition to Mecklenburg-Western Pomerania, there are also parliamentarily elected ombudsmen or police commissioners in the states of Baden-Württemberg, Berlin, Brandenburg, Bremen, Rhineland-Palatinate, Schleswig-Holstein and Thuringia. They all take part in the Schwerin conference. In Hesse, there are only the legal requirements for this, but no commissioned person yet.
