La XXXVi I edición de las Jornadas de Coordinación de Defensorías del Pueblo, a las que han acudido el ararteko, la adjunta, el secretario general y la responsable de la Oficina de Infancia y Adolescencia, se han celebrado los días 23 y 24 de noviembre en Barcelona, organizadas por la Síndica de Greuges de Cataluña.


Bajo el título “Proteger a la infancia protegiendo sus derechos: un reto desde las defensorías”, las jornadas han abordado la respuesta que los sistemas públicos implicados están ofreciendo a los niños, niñas y adolescentes que se encuentran en situaciones de riesgo de desprotección. Este encuentro complementa el trabajo de análisis y diagnóstico realizado a lo largo de 2023 por todas las defensorías, a la vez que lo concluye con una declaración institucional suscrita por las personas titulares de éstas.


Por primera vez en el histórico de las jornadas de coordinación, las conclusiones obtenidas han contado con la voz y las opiniones de personas menores de edad, recogidas en el taller organizado por el Ararteko con este propósito en los meses previos al encuentro de Barcelona. 

Su contribución al análisis y propuestas forma parte, junto a la realizada por los equipos de profesionales de las defensorías, del sustrato que ha alimentado las conclusiones y declaración “Prevenir para proteger” de las defensorías del pueblo.

Los días 23 y 24 de noviembre se desarrollaron las XXXVI Jornadas de Coordinación de las Defensorías del Pueblo en la ciudad de Barcelona. En dichas Jornadas se trató el tema de los sistemas de protección de menores con especial atención al desamparo y las consecuencias de crecer fuera del núcleo familiar, asistiendo a las mismas tanto el Procurador del Común como la Adjunta al Procurador del Común.

(CoE) Hungary: The proposal for a “defence of national sovereignty” package should be abandoned

“The proposal to establish an ‘Office for the Defence of Sovereignty’ in Hungary, that would be vested with broad powers to investigate any organisation or person suspected of serving foreign interests or threatening national sovereignty, poses a significant risk to human rights and should be abandoned”, said today the Council of Europe Commissioner for Human Rights, Dunja Mijatović.

“Under a President appointed by the President of the Republic on a proposal from the Prime Minister, it would have unlimited authority to request sensitive data and private information from anyone, without oversight and without any legal remedy. The draft package of laws submitted to Parliament, jointly with a parallel proposal by the Government to insert a reference to the new Office into the Fundamental Law, is so vague that the invasive scrutiny of the proposed Office could be weaponised against anybody who may be considered an adversary due, for instance, to ‘activities aimed at influencing democratic debate’.

I have consistently warned against the steps taken in Hungary to impose arbitrary restrictions to the indispensable work of human rights NGOs and defenders in the country. I have also expressed concern about the overreach of executive powers and the efforts to undermine the independence of the judiciary. If this proposal is adopted, it will provide the executive with even more opportunity to silence and stigmatise independent voices and opponents.

Draft laws with such far-reaching consequences on the functioning of human rights, democracy and the rule of law in Hungary should undergo comprehensive scrutiny and meaningful consultation before they are submitted to Parliament. I call on the Hungarian Parliament to shelve these proposals and use its legislative and oversight powers to uphold human rights and fundamental freedoms in line with the European Convention and the core values of the Council of Europe.”

Accès aux droits des "Gens du voyage" : La Défenseure des droits et son équipe en déplacement à Rouen et Louviers

La Défenseure des droits, Claire Hédon, s’est rendue vendredi 24 novembre 2023 à Rouen puis à Louviers. L’occasion de sensibiliser les acteurs locaux aux atteintes aux droits vécues par les voyageurs dans presque tous les domaines de leur vie quotidienne et de présenter les outils conçus pour les voyageurs et ceux qui les accompagnent pour faire respecter leurs droits.

À Rouen (76), une rencontre dans les locaux de l’association « Echelle Inconnue » a permis aux voyageurs de partager les difficultés qu’ils rencontrent: problématiques de relogement, notamment pour des voyageurs qui résidaient sur l’aire d’accueil de Lubrizol, et qui ne disposent pas d’informations claires sur les suites de leur demandes de relogement, discriminations dans l’accès aux comptes bancaires, difficultés d’accéder à l’instruction en famille… La Défenseure des droits accompagnée de son adjointe, George Pau-Langevin, de juristes,  du chef de pôle régional  et de délégués du Défenseur des droits qui interviennent sur le territoire ont pu répondre à certaines de leurs questions et leur indiquer comment faire valoir leurs droits.
Ils ont pu leur présenter le dépliant et les fiches thématiques conçues pour faciliter le recours à l’institution. Les voyageurs y retrouvent pour chaque situation ce que peut faire le Défenseur des droits et les étapes à suivre : à qui s’adresser, les documents à rassembler...

À Louviers (27), la Défenseure des droits et son adjointe ont sensibilisé les élus locaux aux problématiques rencontrées par les voyageurs et rappelé certaines des recommandations formulées dans le rapport « Gens du voyage » : lever les entraves aux droits, notamment sur la question du nombre de places disponibles dans les aires d’accueil et la nécessité pour les voyageurs d’accéder pour ceux qui le souhaitaient au logement social.

Enfin, une visite à l’aire d’accueil de Louviers et une rencontre avec les associations et les acteurs sociaux de Louviers (CCAS, Centres sociaux…) a été l’occasion de rappeler à tous les modes d’intervention du Défenseur des droits et d’œuvrer collectivement à faciliter l’accès aux droits des voyageurs.
