The Parliamentary Ombudsman, Judge Emeritus Joseph Zammit McKeon, was invited by the Department of Public Policy within the Faculty of Economics, Management, and Accountancy at the University of Malta to deliver a lecture on the vital role and functions of the Ombudsman institution in Malta.

The engaging lecture attracted a diverse audience, including students from the MA Public Policy Leadership program and the BA (Hons) Politics and Governance program. It provided a unique opportunity for students to interact with the Ombudsman directly and gain valuable insights into the institution’s historical context, legislative evolution, roles, functions, and the wide array of services it offers.

The two-hour session with the Ombudsman was both stimulating and fruitful, allowing students to delve deeper into the intricacies of the Ombudsman’s work. Dr George Vital Zammit, Senior Lecturer at the Department of Public Policy, coordinated this lecture, making it a valuable experience for all in attendance.

El Diputado del Común, Rafael Yanes, se reunió con representantes de la ‘Plataforma vecinal El Lasso’, un barrio de Las Palmas de Gran Canaria, quienes denuncian que nadie les ha informado sobre el Centro de acogida de personas migrantes que se está construyendo en el solar donde estaba ubicado el Colegio León, un espacio que ellos consideran que era un referente social en el barrio.

La presidenta de la Plataforma, Kely García, denuncia que “están haciendo una obra, pero no hay carteles informativos, no sabemos qué se está construyendo”. La última información que recibieron, a través de la prensa, fue que se iba a construir con centro de acogida a personas migrantes para la atención de madres y menores.

García aclara que los vecinos de El Lasso no se oponen a la creación de este centro, pero creen que la información es fundamental para fomentar una convivencia adecuada. “Somos 747 familias queremos formar parte de ese proyecto, si tenemos que interactuar y ayudar, lo haremos, pero para eso hay que informarnos sobre lo que se va a hacer”.

El Diputado del Común, Rafael Yanes, señaló que lo que piden los vecinos es muy razonable. “El objetivo de estos centros es integrar, y para que haya integración tiene que haber transparencia”, añadió. Además, Yanes afirmó que desde la Diputación del Común “solicitaremos a la Delegación del Gobierno que se informe adecuadamente a los vecinos sobre este proyecto”.

Una persona acudió al Ararteko después de que el Ente Vasco de la Energía (EVE) le denegara una ayuda para la instalación de un punto de recarga para coche eléctrico dentro del Programa de incentivos a la movilidad eficiente y sostenible (MOVES III).

En septiembre de 2022 esta ciudadana presentó una solicitud de ayuda para la instalación de un punto de recarga de un vehículo individual en el garaje de un edificio residencial en Bilbao. Un mes más tarde el EVE se la denegó por considerar que no cumplía con los requisitos. En concreto, el motivo era que la instalación de recarga de vehículos eléctricos instalada “No se trata de un sistema de recarga de vehículo eléctrico.”

En noviembre de 2023 la reclamante presentó un recurso de reposición alegando que la instalación sí que cumplía con todos los requisitos recogidos en las bases de la convocatoria y tenía la consideración de punto de recarga de vehículo eléctrico. Unos meses más tarde el EVE acordó desestimar el recurso al interpretar que las bases del programa de ayudas estaban destinadas a los sistemas de alimentación específicos para vehículos eléctricos y excluían a los sistemas de recarga simples, como era el de la persona solicitante. 

El Ararteko solicitó la colaboración del EVE que, en su respuesta, informó de la aprobación de las bases del programa MOVESIII en julio de 2021 y la modificación del anexo I de las bases en julio de 2023. La justificación de la exclusión era que, aunque el enchufe puede utilizarse para la recarga de vehículos eléctricos, no estaba destinado en exclusiva a tal fin.

Sin embargo, la reclamante insistía en que su instalación está destinada en exclusiva para la recarga de su coche eléctrico y dispone de un sistema de control y gestión de las recargas.

Analizando las bases el Ararteko concluye que son subvencionables todas las infraestructuras de recarga de vehículos eléctricos y cree que un cambio en el contenido literal de las bases no puede tener la consideración de “clarificatorio”.

Por ello, el Ararteko recomendó al EVE que revocara la denegación de la ayuda solicitada por la promotora de la queja y, en su caso, dictara una nueva resolución estimatoria teniendo en cuenta que la solicitud cumplía con los modos de carga de batería regulados. El EVE ha comunicado al Ararteko que no acepta la recomendación.

The Public Defender of Georgia has learnt about the violation of the rights of pensioners as a result of the postponement of loans for several months by JSC Liberty Bank due to the spread of coronavirus on the recommendation of the Government.

In particular, due to the grace period,[1] the loan term was extended for older persons, which led to an increase in the accrued interest. After the end of the grace period, the amount stipulated by the new schedule drawn up by the bank was significantly increased compared to the amount of the grace period, therefore the loan became more expensive for the older persons and the duration of the loan agreement increased.

According to the explanation of the National Bank of Georgia,[2] the customer enjoying the so-called grace period activated due to the pandemic caused by the new coronavirus has the right to request the conditions existing before the postponement, including a return to the old payment schedule, for which he must pay the amounts corresponding to the postponed months. In order to use the mentioned right, the customer should apply to the relevant commercial bank, microfinance organization or credit entity. It should be noted that some of the older persons may not have access to information, which is why they are unable to apply to Liberty Bank. The request to return to the old schedule and refinance obligations requires appropriate knowledge, and often, pensioners are not well aware of these issues. Those pensioners who, with the help of a relevant person/organization, individually applied to the bank and requested a new loan payment schedule, significantly reduced the term and amount of the loan.[3]

In addition to the above, overdraft loans offered to pensioners by JSC Liberty Bank are also a significant challenge.[4] The upper limit of the annual interest rate of loans has been determined from 2023, however, before 2023, the said interest rate was inappropriately high for pensioners. Accordingly, the loans taken before the new regulation are recalculated according to new conditions and a new low interest rate based only on the appeal of pensioners and there is again a problem of unequal information in this case too.

The Public Defender of Georgia addressed the National Bank of Georgia with a proposal and requested the development of a relevant resolution/instruction for the purpose of restructuring the pensioners' obligations and for the protection of the affected customers who benefited from the grace period, by which JSC Liberty Bank will refinance/restructure the monetary obligations of the beneficiary pensioners and it will be possible for the pensioners to use the terms existing before the postponement and to return to the old payment schedule. In addition, the Public Defender requested - to take all measures in order to automatically recalculate pensioners' overdraft agreements according to the new low interest rate effective from 2023, in order to avoid violations of the property rights of older persons as much as possible.
