In the exercise of its mandate as the National Human Rights Institution (NHRI), in April the Ombudsman submitted the alternative report with a view to the Universal Periodic Review (UPR) to which the Portuguese state will be subject at the end of 2024.

Recognised as an accredited NHRI with A status, in full compliance with the Paris Principles, the Ombudsman acts as a link between the Portuguese system and the United Nations’ international system for the promotion and protection of human rights. In this capacity, it regularly cooperates with the Office of the High Commissioner for Human Rights in assessing the fulfilment of the Portuguese state’s obligations, presenting alternative reports and other contributions.

Established in 2006, the UPR is one of the most important instruments of the United Nations Human Rights Council and is conducted every four years in the form of an interactive dialogue between the State under review and the other UN member states.

It is a ‘peer review’ exercise; in other words, unlike other types of dialogues in which states are assessed by committees of independent experts, the UPR has the peculiarity that states issue recommendations to each other. In addition to the report submitted by the state under review, the recommendations are based on other contributions from other countries.

The examination of the Portuguese state by the Human Rights Council is scheduled for 6 November 2024. It will be the fourth time that Portugal has been submitted to this evaluation mechanism, with the last Universal Periodic Review of Portugal having taken place in May 2019.

El Defensor del Pueblo, Ángel Gabilondo, ha recibido este jueves a representantes de dos asociaciones de víctimas de abusos sexuales en el ámbito de la Iglesia católica. 

El encuentro ha tenido lugar en la sede de la institución y en él han participado Jesús Zudaire, Juan Arbizu y Fernando Aguado, de la Asociación Víctimas de Abusos de Navarra, y Ana Cristina Cuevas y Juan Cuatrecasas, de la Asociación Infancia Robada.

El Defensor del Pueblo hizo público el pasado 27 de octubre el “Informe sobre abusos sexuales en el ámbito de la Iglesia católica y el papel de los poderes públicos”, Una respuesta necesaria. Así dio cumplimiento a la encomienda del Congreso de los Diputados, tras la aprobación, el 10 de marzo de 2022, de la Proposición no de Ley en la que se explicitaba la misma.

Los representantes de las dos asociaciones expusieron en la reunión cuáles son sus prioridades, y mostraron su interés en que el Informe sea debatido ya en el Congreso de los Diputados para que las recomendaciones sugeridas en el mismo puedan llevarse a cabo cuanto antes.

Ángel Gabilondo espera poder defender en breve el informe en el Pleno del Congreso de los Diputados. Según ha señalado recientemente el Defensor, “ahora corresponde a la Mesa del Congreso de los Diputados fijar la fecha para ir a la presentación y debate con los parlamentarios. Y esto nos gustaría hacerlo lo antes posible”.

Por parte de la institución han asistido a la reunión la directora del Gabinete del Defensor, Isabel Aymerich, y los técnicos Antonio Mora y Antonio Fernández Barba.

Judgment of the General Court in Case T-411/22 | Dexia v SRB (2022 ex-ante contributions)

The calculation of the 2022 ex ante contributions to the Single Resolution Fund (SRF) is unlawful The Single Resolution Board (SRB) exceeded an annual upper limit imposed by the applicable rules

The French credit institution Dexia has challenged before the General Court of the European Union the lawfulness of the SRB’s decision 1 setting the 2022 ex-ante contributions 2 to the SRF, in so far as that decision concerns Dexia.

According to Dexia, when calculating individual ex ante contributions for a given year, the SRB must not exceed an upper limit imposed by the applicable legislation 3 . In particular, the ex-ante contributions of all the institutions authorised in the territories of all the Member States participating in the Single Resolution Mechanism (SRM) are not to exceed 12.5% of the financial means that should be available in the SRF at the end of 2023 (“the final target level”) 4 . The SRB disregarded that limit. (...)

The Ombudsman, Judge Emeritus Joseph Zammit McKeon, held a cordial meeting with Dr Matteo Mecacci, Director of the OSCE Office for Democratic Institutions and Human Rights (ODIHR). Dr Mecacci visited Malta to participate in a conference on Addressing Anti-Semitism in the OSCE Region.

During the meeting, Mr Mecacci outlined the ODIHR’s mandate, which encompasses the full respect for human rights and fundamental freedoms, adherence to the rule of law, promotion of democratic principles, strengthening of democratic institutions, and fostering tolerance throughout society. He intended to explore avenues for collaboration between the two institutions on related issues.

The Office of the Ombudsman highlighted two specific issues that require support in advocacy:

1. National Human Rights Institution: The Ombudsman’s Office proposed expanding its mandate to offer a wider range of human rights protections. Inspired by similar European institutions, the proposal includes the establishment of a National Human Rights Institution (NHRI) in Malta. The Ombudsman’s Office could broaden its scope to encompass a more extensive human rights mandate, aligning with its capabilities under the Ombudsman Act 1995. This initiative is crucial as Malta is one of the few EU and Council of Europe countries without an NHRI, which underlines the importance of reinforcing the country’s dedication to human rights.
2. Protocol 12 of the ECHR: Although Malta ratified Protocol No. 12 of the ECHR, focusing on equality and non-discrimination, it has yet to be fully integrated into national law. This gap hinders individuals’ ability to seek remedies for discrimination domestically, often necessitating recourse to the Strasbourg Court. The Ombudsman’s Office is advocating for incorporating Protocol 12 into Malta’s legal framework to ensure the enforceability of these rights at a national level.

The Parliamentary Ombudsman was joined by the Commissioner for Education, Chief Justice Emeritus Vincent De Gaetano, Dr Monica Borg Galea, Head of Investigations, and Mr Jurgen Cassar, Head of Communications and Research. Accompanying the Director of ODIHR was Mr Peter Mossop, Advisor.

El Diputado del Común, Rafael Yanes, se reunió mediante videollamada con el director técnico y portavoz de la ‘Fundación ANAR’, Benjamín Ballesteros, y con la directora de las Líneas de Ayuda de ANAR, Diana Díaz, quienes le presentaron el informe donde se recogen las principales problemáticas detectadas a través de las llamadas y consultas realizadas por niños y adolescentes que acuden al teléfono y al chat de ayuda gratuitos. En la reunión estuvo presente la asesora de la Diputación del Común, María Afonso.

Ballesteros expuso que en 2023 se recibieron 256.263 llamadas por parte de menores en toda España, 3.571 en Canarias. De esas llamadas, se abrieron expedientes con las que revestían una especial gravedad. En concreto, en toda España se abrieron en 18.893 casos, y en Canarias 877. “Las llamadas las clasificamos gracias a la valoración técnica que realizan nuestros psicólogos de cada problemática que nos llega”, añade.

En este sentido, Díaz recalcó que las líneas de ayuda “son confidenciales y están atendidas por un grupo de psicólogos expertos con formación específica”. Las diferentes líneas de ayuda se dividen en el Teléfono ANAR de Ayuda a Niños y adolescentes; el Teléfono ANAR de la Familia y Centros Escolares, en el que se atiende a cualquier adulto que tenga conocimiento de una problemática relacionada con un menor; el Teléfono ANAR para casos de Niños Desaparecidos, el Chat ANAR y el Email ANAR. Además, la ‘Fundación ANAR’ atiende también a menores de edad víctimas de violencia de género a través de un convenio de colaboración con la Delegación del Gobierno Contra la Violencia de Género.

En cuanto a la tipología de las consultas, la Fundación detecta que desde la pandemia han aumentado el número de peticiones de ayuda relacionados con la salud mental. “Los problemas relacionados con las violencias no han descendido, pero los de salud mental se siguen multiplicando exponencialmente, y hay un colapso dentro del sistema a la hora de darles salida”, añadió Ballesteros. Los datos recogidos por la Fundación a lo largo de los años evidencian este ascenso. En el año 2014, se recogieron 255 casos de intento de suicidio, mientras que en 2023 se detectaron 5.198 casos.
