La Defensoría de la Infancia y la Adolescencia de Andalucía, y Defensor del Pueblo Andaluz, tramita la presente queja relativa a la prestación de apoyo educativo para el alumnado con necesidades específicas de apoyo educativo (NEAE) en un centro de una localidad de la provincia de Cádiz.

En su día nos dirigimos ante la Delegación Territorial de Desarrollo Educativo y Formación Profesional en Cádiz trasladando dicha problemática, recibiendo la información.

“En relación al expediente de queja referenciado, formulado ante esa Institución en el que plantea que su hija de necesidades educativas especiales, escolarizada en el C.E.I.P., no cuenta con las horas necesarias de atención por Personal Técnico de integración Social ni con el mobiliario adaptado para el control postural, y una vez emitido el correspondiente informe del Servicio de Ordenación Educativa, le informo lo siguiente

1. Con fecha 29 de Noviembre de 2023 se comunicó al Servicio de Planificación y Escolarización la ampliación de 15 horas del recurso de PTIS para el mencionado centro educativo, suponiendo el aumento del recurso a 25 horas semanales, Dicho Servicio procedió en ese momento a la grabación de la citada ampliación en la plataforma correspondiente.

2. Respecto a la dotación de mobiliario adaptado, entre los días 27 y 30 de noviembre de 2023, se depositó en el centro educativo. todo "el material específico adaptado prescrito para la alumna en su dictamen de escolarización”

Tras estudiar el informe enviado, hemos de comprobar la reacción adoptada por las autoridades educativas desde la Delegación Territorial de Desarrollo Educativo y Formación Profesional en Cádiz, sobre la decisión de promover medidas de refuerzo en el recurso de personal de PTIS a fin de dar respuesta a las necesidades de apoyo y de profesionales especializados que la alumna necesite, así como en su caso, para el alumnado NEAE.

Del mismo modo nos congratulamos de la puesta a disposición del material adaptativo que se reclamaba por la familia de la alumna.

Por ello creemos entender que el asunto se encuentra en vías de solución, debiendo otorgar un plazo razonable de tiempo para completar la evaluación de las medida adaptadas y la situación del centro. En todo caso, sí insistimos en la conveniencia de facilitar toda la información y asesoramiento a la familia para propiciar las actuaciones de seguimiento y mejora del apoyo destinado a todo el alumnado con perfiles NEAE.

Y así, procedemos a concluir nuestras actuaciones

La valedora del pueblo, Dolores Fernández Galiño, visitó ayer el Museo de las Peregrinaciones y de Santiago, acompañada por su directora, Esperanza Gigirey, quien le explicó el objetivo del centro y la guio por sus tres plantas.

Creado en 1951 por iniciativa de Manuel Chamoso Lamas, su exposición comienza mostrando distintas peregrinaciones que se desarrollan alrededor del mundo, antes de centrarse en la jacobea, vertebrada por el Camino de Santiago. Finalmente, destaca el nacimiento y la evolución de Santiago de Compostela como consecuencia de este fenómeno religioso.

De entre las piezas con las que cuenta el centro expositivo, la valedora resaltó el libro El Camino de Santiago en España, del japonés Ikeda Munehiro. La obra contiene ilustraciones detalladas de distintos monumentos y paisajes que su autor encontró a lo largo del Camino de Santiago.

En su dedicatoria en el libro de honor del museo, Fernández Galiño alabó su funcionamiento y su exposición. Además, tuvo ocasión de conversar con su personal.

Addressing these issues requires police protection for journalists, thorough effective investigations of crimes committed against them, and legislative reforms to protect media professionals from undue pressure. It is also essential to promote awareness and a political discourse that supports journalists. These measures are crucial both for the protection of journalists and to uphold the public's right to have access to information.

An independent, pluralist and ethical press is a public good which serves the public interest. It requires a safe and secure environment. I will play my part in ensuring that journalists can work freely and safely, so that the press can continue to perform its essential role in a democratic society.”

Achitz, Rosenkranz und Schwarz stellen ihre Arbeitsschwerpunkte vor

The European Network of National Human Rights Institutions (ENNHRI) has announced the publication of the ENNHRI 2024 Report on the State of the Rule of Law in the European Union. Submitted to the European Commission on 23 April, the report significantly contributes to the EU’s rule of law monitoring cycle.

ENNHRI, uniting over 40 national human rights institutions across Europe, aims to promote and protect human rights throughout the region. It serves as a collaborative platform for these institutions, fostering solidarity and collective action to defend human rights and address related challenges at the European level.

The report addresses the situation in Malta, specifically relating to the establishment, independence, and effectiveness of a National Human Rights Institution (NHRI). It highlights that various national, regional, and international stakeholders have urged Malta to establish an NHRI, a recommendation prominently featured during the Universal Periodic Review of Malta.

The report encourages Malta to advance the adoption of legislative amendments swiftly and establish an NHRI in line with the UN Paris Principles.

It also highlights recent progress made by the Office of the Parliamentary Ombudsman, which joined ENNHRI in February 2024. By joining ENNHRI, the Ombudsman’s Office has committed to taking proactive steps towards achieving accreditation as an NHRI compliant with the Paris Principles.

The Ombudsman’s Office has actively pursued the establishment of a fully-fledged NHRI in Malta. It has proposed to the Maltese Government the integration of NHRI functions within its existing framework and suggested an extension of its current mandate to include a broader spectrum of human rights responsibilities. The Ombudsman Act supports this expansion, empowering the Office to address issues related to unjust, oppressive, or improper discriminatory actions by the public administration.

The Office operates with a high degree of independence. It is supported by adequate resources and enjoys financial autonomy, ensuring it can effectively uphold and advocate for expanded human rights responsibilities.

ENNHRI continues to monitor developments in Malta and stands ready to support the member institution and provide expertise on establishing and accreditation NHRIs to relevant stakeholders.

This publication and the ongoing efforts of the Ombudsman’s Office reflect a committed step towards enhancing the rule of law and strengthening human rights protection in Malta.
