The Faculty of Pedagogy of Gál Ferenc University organised its 11th national minorities conference entitled “National Minority Education: Options and Solutions in an International Context” in Szarvas, Hungary on 17 April 2024. 
 

The conference was opened by the patron of the conference, Bishop of Szeged-Csanád Diocese Dr. László Kiss-Rigó, then an opening speech was given by Commissioner for Fundamental Rights Dr. Ákos Kozma. 

At the conference, an inaugural address was delivered, among others, by Rector of Gál Ferenc University Prof. Dr. László Dux, Consul General of Romania in the City of Gyula Mr. Daniel Banu, Romanian Nationality Advocate Mr. Traian Cresta, Slovakian Nationality Advocate Mr. Antal Paulik and Mayor of the City of Szarvas Mr. Mihály Babák. 

Police carried out a search of a residence to search for a person arrested in absentia on suspicion of a serious offence. The police made the assessment that the man they were seeking could be armed and dangerous and therefore used an offensive approach. The man was not in the residence, but several minor children were present. The investigation shows that the police officers tasked with searching the residence were aware that children might be present.

It is a legal requirement that the best interests of the child are taken into account in accordance with the Convention on the Rights of the Child in all actions concerning a child. The Parliamentary Ombudsman states that the police must carefully consider what can be done to satisfy the best interests of the child to the greatest extent possible during and after a search.

According to the Parliamentary Ombudsman, information that there may be children in a residence where a search is to be carried out is information of a kind that the police may need to share with the person in charge of the investigation. Further, the Parliamentary Ombudsman stresses that if there are any doubts as to how the best interests of the child should be respected in the planning and execution of a residence search, the person in charge of the investigation should be informed and directives sought.

The findings of the investigation in this case do not give the Parliamentary Ombudsman reason to direct criticism at the prosecutor or the police. According to the Parliamentary Ombudsman, the case illustrates that the prosecutor and the police may be confronted with difficult choices where there is a possibility that coercive measures will affect children. The Parliamentary Ombudsman therefore wishes to emphasise the importance of the Prosecution Authority and the Police Authority continuously engaging in quality and knowledge enhancement work with the aim of supporting staff and ensuring that the best interests of the child are a primary consideration in all actions which concern children.

Im Rahmen ihrer jährlichen Pressekonferenz stellte Babara Schleicher-Rothmund ihren Jahresbericht 2023 vor.

„An meinen Aussagen aus dem letzten Jahr hat sich nichts wesentlich geändert. Die langen Bearbeitungsdauern von Anträgen und der sich immer mehr verschärfende Personal- und Fachkräftemangel spitzen sich weiter zu. Digitalisierung kann hier helfen, aber nicht das Erfordernis von mehr Fachkräften komplett beseitigen.“ so die Bürgerbeauftragte des Landes Rheinland-Pfalz Barbara Schleicher-Rothmund bei der Vorstellung ihres Berichts im Rahmen einer Pressekonferenz in Mainz.

Im Jahr 2023 wurden bei den 2.226 Eingaben, wieder vielfältige Probleme und Herausforderungen an die Bürgerbeauftragte herangetragen. Dies bedeutet eine Zunahme von rund 6 % gegenüber dem Vorjahr.

Die öffentlichen Petitionen, die über die Homepage der Bürgerbeauftragten eingereicht werden können, sind im Berichtszeitraum erfreulicherweise erneut stark angewachsen. Bei den öffentlichen Petitionen konnte von der neuen Regelung der Geschäftsordnung Gebrauch gemacht werden und die Petition „Änderung der Beihilfeverordnung; Abschaffung der Kostendämpfungspauschale“ mit 12.730 Mitzeichnern in öffentlicher Sitzung behandelt werden.

Bürgerbeauftragte Schleicher-Rothmund dankte den Verwaltungen, ihren Leitungen sowie den Mitarbeiterinnen und Mitarbeitern für die gute und konstruktive Zusammenarbeit auch in diesen schwierigen Zeiten.

Beschlussempfehlungen und Berichte des Petitionsausschusses zu verschiedenen Eingaben

Ombudsman.be, le Réseau belge des ombudsmans, vient d’adopter son mémorandum à destination des responsables politiques de notre pays.

À partir des constats faits dans l’exercice de leurs missions et des expériences échangées au sein du réseau « Ombudsman.be », les ombudsmans formulent des recommandations à l’attention des responsables politiques en vue de promouvoir l’accès des citoyens à leurs droits, aux services et aux médiateurs.

Cinq recommandations sont formulées :

1. Garantir et renforcer l’accès des citoyens à leurs droits, par exemple, par l’octroi automatique des droits sans demande préalable ou par la généralisation du principe « Only once ».
2. Garantir l’accessibilité des services et des entreprises, par exemple, par la généralisation de l’accompagnement des personnes qui rencontrent des difficultés à utiliser les procédures administratives numérisées, ou par le maintien de lieux d’accès physiques, y compris dans les zones rurales.
3. Garantir l’accès à internet comme un besoin essentiel, par exemple, par la fixation de règles spécifiques pour un accès minimal à un internet de qualité et abordable.
4. Garantir une fonction d’ombudsman à chaque niveau de pouvoir, y compris au niveau des communes et des CPAS.
5. Garantir le statut et l’indépendance des ombudsmans, par exemple, par l’inscription dans la Constitution, du droit au recours à un ombudsman indépendant de l’administration ou de l’entreprise vis-à-vis desquels il reçoit des plaintes.
