El Defensor del Pueblo andaluz, Jesús Maeztu, ha reivindicado hoy que "las personas mayores merecen el lugar digno que les corresponde como miembros de pleno derecho de la sociedad". El Defensor ha señalado que la jornada, que ha organizado con el título Personas Mayores por derecho propio, gira sobra la pregunta de si el ordenamiento jurídico protege de manera adecuada a los mayores.

El Defensor ha recordado que se han cumplido 25 años de la ley 6/1999 de atención y protección a las personas mayores en Andalucía, la cual fija el marco normativo singular sobre el que poder asegurar a las personas mayores una respuesta uniforme y coordinada en el amparo de sus derechos y en la cobertura de sus necesidades.

Maeztu ha señalado que le apenan los casos de malos tratos, situaciones de abusos en residencias o en sus propios hogares, o las dilaciones para recibir prestaciones, pero ha afirmado que desde "el convencimiento se puede lograr una sociedad más respetuosa y humana, sobre todo con las personas vulnerables". "Las personas mayores están en edad de merecer derechos propios", ha subrayado.

Maeztu ha compartido con la consejera de Inclusión Social, Juventud, Familias e Igualdad, Loles López, la necesidad de activar medidas para hacer cumplir el derecho subjetivo de la ciudadanía a recibir las prestaciones en tiempo y forma, y la necesidad de conseguir inversión para hacerlo posible. "Las personas mayores no pueden perder, por la edad, los derechos que merecen", ha concluido.

Por su parte, Loles López ha llamado la atención sobre la necesidad de "atender a personas que nos lo han dado todo y ahora, moralmente, debemos devolverles lo que hemos recibido".

La consejera ha abundado en dos líneas de actuación, el primero desde la prevención, con la mejora de los centros de participación activa o las Aulas de mayores, entre otras, y en un segundo aspecto, las medidas para las personas necesitadas de favorecer su autonomía, entre ellas la dependencia, para la cual ha señalado que "hay que seguir invirtiendo, reducir tiempos de espera y aumentar las plazas". "Nos queda mucho por hacer, pero tambien se ha hecho mucho", ha señalado Loles López, que ha puesto de ejemplo las más de 4.500 plazas creadas o la simplificación del procedimiento para la dependencia con una única visita y una única resolución por la que se agilizará el sistema.

A continuación, Adela Cortina, catedrática de Ética y Filosofía Política en la Universidad de Valencia, ha pronunciado la ponencia marco y ha avisado sobre la heterogeneidad de este colectivo "porque no somos todos iguales, hay que fijarse en cada persona, y ver qué necesita cada una de ellas".

En primer lugar, Cortina ha hablado de la dignidad y que "cuanto más mayores, más necesitados de atención personal vamos a estar" y ha rechazo la gerontofobia, o el término más actual, el edadismo, que es la discriminación por la razón de edad, conceptos que "no sólo son inmorales, sino irracionales". 

En segundo lugar, Cortina ha señalado que este colectivo es necesario para la economía, y ha puesto como ejemplo el turismo, el gasto farmacéutico o la conciliación familiar "porque no hay colectivos, hay personas"."Suena fatal que las personas mayores son rentables, pero es verdad", ha señalado.

La catedrática ha señalado que "una sociedad es ética cuando acompaña a todas sus personas hasta el final, cuando llega el momento de dejarse hacer". "Vamos a dialogar y a convivir, porque es la única manera de conmorir, de no morir en soledad".

En la primera mesa redonda, con el título 'Mayormente dignos: objetivando valores sociales', participan Paula del Río, trabajadora social de la Confederación Estatal de Mayores Activos Confemac, Norberto Sotomayor, fiscal delegado en la especialidad de Protección de las Personas con Discapacidad y Mayores en Sevilla; María Martínez, coordinadora de la Inspección General de Servicios Sociales de la Consejería de Inclusión Social, Juventud, Familias e Igualdad, y Juan José Cádiz, jefe de Servicio de Gestión de Centros de Mayores.

En la segunda mesa redonda, 'En edad de merecer: ejerciendo derechos propios', participan Manuel Fuentes, responsable en Andalucía de la Asociación de Directoras y Gerentes de Servicios Sociales; Martín Durán, presidente de la Federación de Organizaciones Andaluzas de Mayores (FOAM), y Soledad Jiménez, responsable del Servicio de Atención Socionanitaria de la Dirección General de Atención Sociosanitaria, Salud Mental y Adicciones de la Consejería de Salud y Consumo.

Es ist in dieser Situation für alle Betroffenen wichtig, dass sie nicht allein gelassen werden und der Staat ein starkes Signal sendet.“

El Defensor del Pueblo, Ángel Gabilondo, ha mantenido este miércoles una reunión de carácter institucional con el ministro del Interior, Fernando Grande-Marlaska.

Durante el encuentro, celebrado en la sede del Ministerio del Interior, han tratado cuestiones de interés para ambas instituciones. Han abordado asuntos relacionados con los requerimientos ciudadanos que, desde el Defensor del Pueblo, se remiten al Ministerio a fin de recabar información solicitada. Además, han tratado sobre diversos aspectos relacionados con las Fuerzas y Cuerpos de Seguridad del Estado.

Angel Gabilondo y Fernando Grande-Marlaska se han comprometido a mantener e impulsar la relación institucional existente, respetando sus ámbitos competenciales, para dar respuesta a los expedientes que se reciben en la institución.

Today, 5 June 2024, Ombudsman Peter Svetina submitted the 29th regular Annual Report of the Ombudsman and the 16th report of the National Preventive Mechanism for 2023 to the National Assembly of the Republic of Slovenia. Today, he handed the reports to the President of the Republic of Slovenia, Dr. Nataša Pirc Musar, and on Friday, 7 June, he will hand it over to the Prime Minister, Dr. Robert Golob.

After the fifth year of his mandate, Svetina is concerned because the necessary changes in society or key systemic reforms – in the field of health, education, long-term care, deinstitutionalisation, and other social areas – are happening too slowly. “We seem to lack ambition and vision. I miss an honest dialogue between different stakeholders, which is not an end in itself, but aims to find the best possible solutions, with people at the centre. Solidarity and compassion for one's fellow man are increasingly put to the test. Individualism, even selfishness, is on the rise, while those on the margins of society are becoming more and more powerless and without the support they need and deserve," said the Ombudsman at the handover.

In 2023, the institution of the Ombudsman handled a total of 6,225 cases, which is 250 cases more than the year before, and found 262 violations of human rights and fundamental freedoms and other irregularities. Public bodies still most often violate the principle of good governance (in 2023, this was the case in 65 cases), unjustifiably delay procedures, and violate the principle of equality before the law and the rights of persons with disabilities. This is followed by a violation of the right to social security, a violation of the right to health care, and a violation of the principle that Slovenia is a legal and social state. These 262 violations or irregularities are still most often detected by the Ombudsman in the work area of the Ministry of Labour, Family, Social Affairs and Equal Opportunities (in 55 cases), in 23 cases the violations and irregularities were caused by administrative units in their work, the Ministry of Health has irregularities and caused violations in 18 cases, while violations were detected in 15 cases in the municipalities. In 2023, 14 violations related to the Ministry of the Interior, centres for social work (in 10 cases) and the Government of the Republic of Slovenia (in 9 cases).
The Ombudsman also emphasised that the number and share of well-founded complaints among those resolved are not a true indicator of the state of human rights protection in Slovenia, as not all those whose rights are violated contact the institution. "However, it can also happen that a single well-founded complaint, in which we found a systemic irregularity, means a violation of the rights of hundreds or even thousands of people. This is also why, on our own initiative, we address many open questions in society and make unannounced and announced visits to institutions. In the role of the National Preventive Mechanism, within the framework of which we take preventive care of the rights of persons in places of deprivation of liberty, we made 87 visits in 2023 alone. We are also active in the field of children's rights – 85 children were assigned a lawyer in 2023, and we have also done a lot of work as a national institution for human rights, as well as in the international field in the field of analytical, research and educational activities in the field of raising awareness of the importance of human rights,” Ombudsman Svetina emphasised.
 Based on all its activities in 2023, the Ombudsman presented a total of 85 new recommendations to decision-makers. "The number of recommendations is about the same as in the previous two years, and the number of unimplemented past recommendations has slightly decreased, but I point out again that the key recommendations in the reforms still remain unimplemented. I call on all those in charge to implement the recommendations of the Ombudsman's institution, as they are based on specific violations and findings. With changes, either to the legal framework or to the practice of the authorities, many new violations could be prevented. A mere general reference to the importance of human rights is insufficient. We need concrete actions, which also includes the adoption of regulations that address acute open issues," said the Ombudsman.

He added that the failure to comply with the Ombudsman's recommendations and the increase in violations of the principle of good governance shows the step-motherly attitude of the respective authorities towards the institution of the Ombudsman, whose tasks are defined by the constitution and the law, and which is bound by high international standards in its work. "Democratic societies need independent supervisory institutions for a well-functioning system of checks and balances. It is imperative that their suggestions and recommendations are taken into account, as well as their financial independence and appropriate position. At the Ombudsman, we want to do our best to contribute to changes for the better and to be a strong voice for all those who are not heard, but without the cooperation and active engagement of all stakeholders, there will be no significant progress," added Ombudsman Peter Svetina.
