La Diputada del Común de Canarias, Lola Padrón, ha mantenido los días 20 y 21 de enero diversas reuniones en Sevilla con el Defensor del Pueblo Andaluz en funciones, Jesús Maeztu, y con el presidente del Parlamento de Andalucía, Jesús Aguirre. Estas jornadas de trabajo se centraron en abordar retos compartidos, como la gestión de la inmigración y la implantación de la mediación en las defensorías.

Durante los encuentros, Jesús Maeztu ofreció la colaboración de la Defensoría andaluza para enfrentar el drama de la inmigración, especialmente en la acogida de menores no acompañados. “Andalucía tiene experiencia y recursos para apoyar a Canarias en este desafío. Es crucial que el Gobierno de España y la Unión Europea se impliquen en un pacto urgente que garantice los derechos de estos niños y niñas”, subrayó Maeztu.

Por su parte, Lola Padrón agradeció el compromiso de la comunidad andaluza en la defensa de los derechos humanos y destacó la necesidad de separar el fenómeno migratorio del debate político. “La inmigración no es una crisis, es una realidad que requiere acuerdos inmediatos y una coordinación efectiva entre comunidades autónomas, ayuntamientos y Europa. No podemos esperar más para actuar”, afirmó.

Ambos representantes coincidieron en la urgencia de proporcionar a los menores migrantes no acompañados acceso a una acogida digna, educación y atención sanitaria. La Diputada del Común recordó que, debido a las barreras idiomáticas y las condiciones en algunos centros de acogida, estos derechos fundamentales no siempre están garantizados.

Otro tema clave de las reuniones fue la mediación como herramienta para resolver conflictos de manera ágil y eficaz. La Diputación del Común expresó su interés en implementar este modelo, inspirado en la experiencia pionera de la Defensoría andaluza, para reducir la carga en los tribunales y fomentar soluciones consensuadas.

La visita incluyó también un encuentro con el presidente del Parlamento de Andalucía, Jesús Aguirre, donde se exploraron nuevas vías de cooperación entre ambas comunidades autónomas en temas de interés común.

La Diputación del Común reafirma su compromiso de seguir trabajando por los derechos de las personas más vulnerables, como los menores migrantes, y en la mejora de las herramientas institucionales que permitan responder de manera eficaz y solidaria a los desafíos actuales.

The Chancellor of Justice was visited by a six-member delegation from the Mongolian National Human Rights Commission (NHRC), with a wish to learn about the work of the Chancellor as the national human rights institution and gain an overview of its activities in the field of data protection. During the visit, meetings are also scheduled with representatives from the Data Protection Inspectorate and the Ministry of Justice and Digital Affairs. In the two preceding days, the Mongolian colleagues visited the Danish Human Rights Centre. The study visits are part of the European Union's Technical Assistance and Information Exchange (TAIEX) program.

The main task of the Mongolian National Human Rights Commission, established by law in 2001, is to monitor the fulfilment of Mongolia's domestic and international human rights obligations, investigate human rights violations, resolve complaints, provide recommendations for improving laws, policies, and practices, and increase public awareness of their rights. Since May 2022, the commission also operates as a data protection authority.

Petition zur Finanzierung von Kinderwunschbehandlungen

Den Petitionsausschuss haben zahlreiche Petitionen zur Fortführung der Finanzierung von Kinderwunschbehandlungen durch das Land NRW erreicht. Kinderwunschbehandlungen wurden seit 2019 vom Bund und dem Land gemeinsam zu gleichen Teilen gefördert. Zusätzlich gewährt das Land NRW eine Pauschale für nicht eheliche Lebensgemeinschaften.

 

Der Petitionsausschuss hat sich zum Anliegen der Petenten von der Landesregierung, Ministerium für Kinder, Jugend, Familie, Gleichstellung, Flucht und Integration (MKJFGFI), berichten lassen.

Das MKJFGFI hat mitgeteilt, dass die massiven Mittelkürzungen des Bundes der gemeinsamen Förderung der Kinderwunschbehandlung weitgehend die Grundlage entzögen. Es sei dem Land nicht möglich, fehlende Bundesmittel zu kompensieren. Vor diesem Hintergrund werde das Land NRW – vorbehaltlich der Zustimmung des Landtags – die Förderung der Kinderwunschbehandlung nicht fortsetzen und infolgedessen das Portal für die Antragstellung nicht mehr öffnen. 

Der Petitionsausschuss nimmt zur Kenntnis, dass der Landtag derzeit unter der Drucksache 18/10526 eine parlamentarische Initiative berät und der federführende Fachausschuss für Familie, Kinder und Jugend eine Anhörung im Landtag NRW durchführt, um die Möglichkeit zu eröffnen, dass die Forderungen in die politische Willensbildung einfließen können.

Der Petitionsausschuss überweist diese Petition gemäß § 99 der Geschäftsordnung des Landtags als Material an den Ausschuss für Familie, Kinder und Jugend.

Der Petitionsausschuss beschließt zudem, die Beschlussempfehlung zu dieser Massenpetition gemäß § 97 Abs. 7 der Geschäftsordnung des Landtags auf der Internetseite des Landtags zu veröffentlichen.

Meeting of Public Defender’s Council of Ethnic Minorities

On January 23, 2025, the Public Defender of Georgia held a meeting with representatives of ethnic minorities in Georgia, during which the problems facing ethnic minorities and the activities carried out by the Public Defender's Office were discussed.

The meeting was welcomed by Public Defender Levan Ioseliani, Deputy Public Defender Irine Chikhladze and Coordinator of the Council of Ethnic Minorities Koba Chopliani.

A representative of the Public Defender's Office, Mariam Orzhonia, discussed the mandate of the Public Defender in the field of ethnic minority rights, and also presented information on the main issues included in the Public Defender’s annual parliamentary report relating to ethnic minorities and the activities carried out by the Office to advocate for the challenges beyond the report.

During the discussion held within the framework of the meeting, the participants spoke about the challenges relating to the protection of rights and integration of ethnic minorities, as well as the issues to be reviewed in the Public Defender’s 2024 parliamentary report.

Deputy-Ombudsman proposes legislative amendments to secure returning of children who have run away from child welfare institutions

Parliamentary Ombudsman Petri Jääskeläinen has issued an extensive decision on a complaint concerning returning a child to a child welfare institution when the child is absent from the institution without an authorisation. The Ombudsman has assessed the executive assistance provided by the police and the powers of the police in relation to the matter, the powers and tasks of the child welfare authorities, and the guidelines given to the Emergency Response Centre Agency.

Firstly, Ombudsman Jääskeläinen considers it obvious that it must be possible to implement a decision made in the child’s interests to take the child into care and place them into substitute care, when the decision determines the place of substitute care and may have been issued by the Supreme Court. However, the legislation currently in force is deficient. Legislation should contain express and specific provisions on the implementation and the powers related to it.

Secondly, the Ombudsman considers it very unsatisfactory that the right of the police to apprehend a so-called runaway child in order to return the child to the child welfare institution is tied to an apprehension warrant, which as such should not have legal effects in this connection.  For example, in a situation where the child’s whereabouts are known and no apprehension warrant is therefore required, the police do not have the right of apprehension. This means that the police are able to provide executive assistance only if social services is kept from carrying out its official duty. This can only be assessed when a representative of social services is present at the location where the child is found. This in turn is difficult to implement in a situation where the child tries to avoid being returned to the child welfare institution by evading the authorities.

The Ombudsman considers legislation severely deficient in this regard. Legislation should have express and specific provisions on the right to apprehend a child in order to return them to a child welfare institution. In the Ombudsman's opinion, the police should have the right of apprehension.

The Ombudsman proposes to the Ministry of Social Affairs and Health and the Ministry of the Interior that they should cooperate to take measures to supplement legislation in this respect. In this connection, they should also examine the needs to amend legislation more widely to secure the implementation of a decision on taking a child into care and placing them into substitute care as well as returning a runaway child to the institution. The Ombudsman has requested that the Ministry of Social Affairs and Health and the Ministry of the Interior inform him by 30 June 2025 what action they have taken as a result of the proposal. 

As for the police, the Ombudsman has informed the National Police Board of the views he has expressed in the decision and requested it to inform all police departments of the decision. He has requested that the National Police Board notify him by 30 June 2025 whether the decision has given reason for it to take any measures. 

The Ombudsman has also requested that the Ministry of Social Affairs and Health inform the child welfare authorities of all wellbeing services counties of the decision. He has also sent the decision to the Emergency Rescue Centre Agency for information.
