El síndic de Greuges de la Comunitat Valenciana, José Cholbi, ha dictado una resolución en la que recomienda al Ayuntamiento de Oropesa del Mar que realice los trabajos de limpieza del cauce del río Chinchilla a su paso por las zonas urbanas del municipio. 

Esta recomendación es la consecuencia de la queja presentada por una vecina que recogía el malestar general de los residentes de la zona y denunciaba la suciedad del cauce del río, así como el mal olor y la afluencia de mosquitos por la falta de limpieza, a su paso por uno de los puentes cercanos a la entrada de Marina d’Or. Al parecer, los afectados habían planteado esta situación al ayuntamiento, que les contestó que dicha tarea correspondía a la Confederación Hidrográfica del Júcar.

En este sentido, nos encontramos con un problema que se repite cada vez que hay que limpiar el cauce de un río. El coste derivado de dichos trabajos de limpieza no quiere ser asumido ni por el ayuntamiento ni tampoco por la respectiva confederación hidrográfica. 

En su resolución, el Síndic aplica los razonamientos del Tribunal Supremo (en su Sentencia nº 2302, de fecha 10 de junio de 2014) que mantiene que la limpieza del cauce de lo ríos a su paso por zonas urbanas no es competencia del organismo de cuenca.

No obstante, Cholbi apunta también a la conveniencia de firmar un convenio entre la Confederación Hidrográfica del Júcar y el Ayuntamiento de Oropesa de Mar para acometer en un futuro los trabajos de limpieza.

Die Deutsche Polizeigewerkschaft mit dem Landesvorsitzenden Werner Kasel und seinen Kollegen Thomas Meyer und Benno Langenberger führten mit dem Beauftragten für die Landespolizei Dieter Burgard und dem für Polizei zuständigen Referenten Dr. Mayer einen intensiven Meinungsaustausch. Dabei sicherte die DPolG zu, dass sie die Arbeit des Beauftragten für die Landespolizei ebenso aufmerksam wie konstruktiv begleiten wird. Vereinbart wurde dazu, dass die gegenseitigen Kontakte weiter intensiviert und dazu künftig regelmäßige Gespräche und Erörterungen stattfinden werden.

Rund 6.000 Menschen in NÖ wandten sich in den Jahren 2012/2013 mit einer Beschwerde an die Volksanwaltschaft. Ihre Probleme bezogen sich vor allem auf Bauverfahren, die Bedarfsorientierte Mindestsicherung sowie Landes- und Gemeindeabgaben. „Die Volksanwaltschaft steht all diesen Menschen zur Seite, sie informiert über die Rechtslage, erteilt Auskünfte und stellt Informationen zur Verfügung. Ist ein Fehler der Behörden zu vermuten, leiten wir umgehend ein formelles Prüfverfahren ein“, sagt Dr. Gertrude Brinek, Vorsitzende der Volksanwaltschaft.

Die Volksanwaltschaft hat in den Jahren 2012/2013 1.149 Prüffälle über die NÖ Landes- und Gemeindeverwaltung abgeschlossen – um fast ein Fünftel mehr als in den Jahren zuvor. Im Bereich des präventiven Menschenrechtsschutzes haben die Kommissionen der Volksanwaltschaft in Niederösterreich bisher rund 162 meist unangekündigte Kontrollen in Einrichtungen, in denen es zu Freiheitsentzug kommt oder kommen kann, durchgeführt.

The Ombudsman's Office has received a number of queries from members of the public in recent days in relation to outstanding liabilities for payment of Non-Principal Private Residence* (NPPR) charge.

The Ombudsman can examine complaints in relation to the administrative actions of Local Authorities.  Members of the public are normally required to first bring their complaint to the Local Authority.  If they are not satisfied with the response, they can then complain to the Ombudsman.   All public bodies subject to Ombudsman oversight are legally obliged to give reasonable assistance and guidance to members of the public in relation to such liabilities or penalties.

To date the Ombudsman has dealt with a number of NPPR cases. Complaints were made for a variety of reasons. All complaints are assessed on their individual merits.  A number of complaints have not been upheld.  Following contact with this Office, and in a small number of cases, Local Authorities have agreed to review the penalties imposed.  It should be stressed that this applies to a small number of cases where there appeared to be exceptional circumstances.

If members of the public have queries in relation to the penalties they may have to pay they should contact the local authority to which payment may be due.

*The NPPR related to any residential property in which the owner did not reside as their normal place of residence. The NPPR charge was effective for the years 2009 to 2013 only, and is separate from both the Household Charge (€100 for 2012 only) and Local Property Tax (valuation based, from 2013 onwards). The Household Charge and the Local Property Tax are the responsibility of the Revenue Commissions, whereas NPPR is payable to the local authority in whose area the property concerned is located.
