A total of 1658 complaints were received in the 3rd quarter of 2015, which is 512 less than in the same period last year. The Defender was approached by 1078 persons in matters falling within my competence under the law, which is 184 less than in the 3rd quarter of the last year. Thus, the proportion of complaints falling within the Defender’s mandate increased to 65% (the figure for the last year was 58%). Most complaints were related to social security (291 complaints); many complaints (94) were concerned with the prison system, police and army, and also with construction proceedings and spatial planning (88)

In 73 of the complaints received, the complainants claimed unequal treatment by public administration and private individuals. The number of complaints directed against discrimination in the sense of the Anti-discrimination Act reached 56 . In 7 cases, we also provided information and analyses related to discrimination to international parties and national bodies.

In the third quarter, we performed 7 systematic visits to facilities where persons restricted in their freedom are or may be present. In the area of monitoring detention of foreign nationals and performance of administrative expulsion, we monitored 3059 decisions.

l Defensor pide a la FEMP que inste a los ayuntamientos a colaborar con la Institución

* Si persisten en su actitud, el Defensor del Pueblo pondrá los hechos en conocimiento del Ministerio Fiscal

La Defensora del Pueblo, Soledad Becerril, ha enviado una carta al presidente de la Federación Española de Municipios y Provincias (FEMP), Abel Caballero, para que inste a los ayuntamientos que no colaboran con la Institución a contestar a sus requerimientos.

El Defensor del Pueblo considera “administración no colaboradora” a aquella que no responde tras haberle enviado requerimientos en tres ocasiones, y actualiza diariamente el listado de esta administraciones en su página web www.defensordelpueblo.es

En la actualidad, 19 ayuntamientos llevan más de 100 días sin contestar al tercer requerimiento de la Institución: Alicante; Arenys de Mar (Barcelona); Barruelo de Santullán (Palencia); Borobia (Soria); Caminomorisco (Cáceres); Cartagena (Murcia); Colmenar de Oreja (Madrid); Cuenca; Gerindote (Toledo); Lantadilla (Palencia); La Pola de Gordón (León); La Unión (Murcia); Molvízar (Granada); Entidad local menor Nava de los Oteros (León); Santa María del Páramo (León); San Ildefonso-La Granja (Segovia); Villamayor de Calatrava (Ciudad Real); Villapalacios (Albacete) y Yeste (Albacete).

El Defensor del Pueblo recuerda que todas las administraciones tienen la obligación de responder y colaborar con la Institución y remitirle la información solicitada.

En caso de no colaborar, la Institución puede poner los hechos en conocimiento del Ministerio Fiscal, según establece el artículo 24 del Capítulo VI de la Ley Orgánica 3/81, que regula la Institución.

Welcome to the Winter 2015 issue of the Ombudsman's Casebook.

This Casebook contains summaries of recent cases the Ombudsman has dealt with. The Ombudsman hopes that by sharing the outcomes of cases, we will all learn from the mistakes and good practice of others.

Kinder mit Behinderungen anfälliger für Missbrauch aufgrund von lückenhaftem Schutz

Jungen und Mädchen mit Behinderungen werden häufiger vernachlässigt und auch häufiger Opfer von körperlicher und sexueller Gewalt als Kinder ohne Behinderungen. Außerdem greifen die existierenden Schutzmaßnahmen weniger für Kinder mit Behinderungen, da sie oft genau zwischen dem allgemeinen Schutz des Kindes und dem Schutz von Menschen mit Behinderungen fallen, offenbart der aktuelle Bericht der Agentur der Europäischen Union für Grundrechte (FRA). Aus diesem Grund müssen Kinder mit Behinderungen im Rahmen nationaler Kinderschutzsysteme sowie politischer Strategien und Maßnahmen als eigene Zielgruppe Beachtung finden. Nur so können sie vollständig in die Gesellschaft integriert werden und ein gewaltfreies Leben führen.
