La Médiatrice européenne, Emily O'Reilly, a envoyé un rapport spécial au Parlement européen sur son enquête visant à améliorer la responsabilité du travail législatif du Conseil. Ce n’est que la deuxième fois au cours de son mandat qu’elle envoie un tel rapport au Parlement.

La Médiatrice a adressé un certain nombre de recommandations au Conseil de l’UE en février, à la suite d'une enquête qui a duré un an. Elle recommande, entre autres, que le Conseil enregistre systématiquement les positions des États membres lors de ses réunions préparatoires et lors des réunions du COREPER et qu'il élabore des critères clairs et appropriés pour la classification des documents du Conseil, la pratique actuelle limitant sérieusement leur accessibilité en temps opportun.

Le Conseil n'a pas répondu à ces recommandations dans le délai légal de trois mois, fixé au 9 mai. Compte tenu de l’importance qu’a le Conseil en matière de légitimité démocratique de l'UE, la Médiatrice a décidé de

European Ombudsman Emily O'Reilly has for only the second time during her mandate sent a Special Report to the European Parliament, on her inquiry to improve the accountability of the Council’s legislative work.

The Ombudsman issued a number of Recommendations to the Council of the EU in February, following a year long inquiry, including that it systematically record Member State positions both in its preparatory meetings and in COREPER (ambassador) meetings; and that it draw up clear and appropriate criteria for the classification of Council documents as the current practice severely limits their timely accessibility.

The Council however failed to respond to the Recommendations by the legal three-month deadline on 9 May, and so given its importance for the democratic legitimacy of the EU, the Ombudsman decided to call now on Parliament’s support.
