Las trabajadoras del Síndic de Greuges nos hemos unido hoy para reclamar igualdad real, porque a pesar de los esfuerzos y los avances conseguidos todavía son muchos los obstáculos que nos quedan por salvar.

Queremos que todas las mujeres podamos acceder al mercado laboral en igualdad de condiciones y llegar tan lejos como nos propongamos, porque la independencia económica es clave para que ejerzamos un control real de nuestras vidas. Necesitamos medidas para que la maternidad no sea una barrera en nuestra carrera profesional. Reclamamos igualdad salarial porque es absurdo que por el mismo trabajo ganemos menos dinero. Ansiamos acabar con todo tipo de violencia que se ejerce contra nosotras, desde la más evidente como la violencia física y/o sexual a la más sutil y normalizada como el control económico y/o emocional. Queremos ejercer y disfrutar de nuestros derechos sin tener que reclamarlos una y otra vez.

En el Día Internacional de la Mujer, que se celebra el 8 de marzo, el Defensor del Pueblo (e.f.), Francisco Fernández Marugán, ha pedido a las administraciones que hagan un esfuerzo para garantizar la plena igualdad de mujeres y hombres en todos los ámbitos de la sociedad.

Discriminación laboral y brecha salarial

El Defensor considera que no es aceptable que en el siglo XXI siga existiendo discriminación laboral y brecha salarial entre mujeres y hombres. Fernández Marugán recuerda que las tasas de empleo femeninas continúan siendo más bajas que las masculinas lo que implica una mayor tasa de paro entre las mujeres. Esto choca con la cada vez mayor cualificación laboral de muchas mujeres a las que el mercado de trabajo no ofrece una respuesta adecuada.

La Institución ha constatado que las mujeres, en general, tienen más dificultades para acceder a un empleo acorde a su cualificación y una vez encontrado un trabajo tienen que seguir luchando para romper el techo de cristal. Al Defensor le preocupa especialmente la falta de acciones para acabar con la brecha salarial. El factor de género sigue siendo muy significativo en este asunto y las mujeres siguen teniendo salarios más bajos y trabajos más precarios.

En este contexto, el Defensor ha subrayado la necesidad de seguir implementando nuevas medidas de conciliación para que mujeres y hombres tengan igualdad de condiciones en el ámbito laboral y en el familiar. Fernández Marugán ha asegurado que “la corresponsabilidad y la flexibilidad deben ser una prioridad”.

Violencia machista

El Defensor ha mostrado su compromiso en la lucha contra todas las formas de violencia hacia la mujer y ha reclamando más implicación de las administraciones para acabar con la violencia machista. Además, ha remarcado que la Institución está haciendo un seguimiento del Pacto de Estado contra la Violencia de Género.

Para Fernández Marugán “es fundamental reforzar y ampliar los valores igualitarios y la educación afectivo-sexual obligatoria en todos los niveles educativos ya que es una herramienta muy poderosa en la lucha contra el machismo y las conductas violentas”.

 Lenguaje no sexista

Uno de los pilares fundamentales para la igualdad de género es la utilización de un lenguaje no sexista. Por este motivo, la Institución vigila los usos del lenguaje que puedan tener connotaciones negativas o peyorativas por razón de género. Así, mantiene abiertas actuaciones ante la Secretaría de Estado de Servicios Sociales e Igualdad para conocer el estado en que se encuentra la elaboración y difusión de un manual de uso de lenguaje no sexista.

The Commissioner for Human Rights and German Institute for Human Rights organized the joint workshop on protection of human rights of older persons which will take place on 7^th March, in the Office of the Commissioner for Human Rights in Warsaw.

The Office of the Commissioner for Human Rights in Poland plays the role of both the national human rights institution (NHRI) and the equality body. It works extensively on the issues of equal treatment, anti-discrimination, and combating all kind of violence also against older persons.

Therefore the Commissioner is also engaged in the process undertaken in the UN Open-ended Working Group on Ageing (OEWGA) aiming more effective protection of the rights of older persons. In December 2017 the Chair of the OEWGA turned to UN member states and A status NHRI with a request for submitting i.a. a substantive inputs in the form of normative content for the development of a possible international standard on the protection of the rights of older persons to equality and non-discrimination and the right to live free from violence, neglect and abuse. The inputs will be discussed during IX Session of OEWGA 23-26 July 2018.

The aim of the workshop is to build the co-operation between German and Polish NHRI with regard to strengthening international protection of human rights of older persons. The conclusions from the workshop will be taken into account in preparing the input for the OEWGA and in considering further steps to be undertaken in order to protect the rights of older persons in a more effective way.

Local Government and Social Care Ombudsman, Michael King revealed his office was now upholding 80 per cent of complaints it investigates about Education and Health Care Plans (EHCP) at this week’s SEN Law Conference.

Speaking at the event in London on Tuesday (6^th), Mr King told the audience of lawyers, parents, representatives of local and national government and the third sector, the Ombudsman had now investigated nearly 140 cases in detail – and upheld eight out of 10 of those.

Mr King said:

“We know many authorities are struggling to meet the April deadline for transferring Statements, and I want to stress they need to ensure provision remains in place if transfers to EHC Plans have not occurred by the deadline.

“In the cases that come to us, we are seeing worrying patterns of delay, inadequate evidence gathering and poor administration and this is having a significant impact on the children and families the new plans were designed to help.

“While we recognise the increasing pressure on Children’s Services departments, we will continue to make decisions based on the law, guidance and rights and not on diminishing budgets.”

All children with existing Statements of SEN should be transferred to the new plans by April 2018, however, the Ombudsman is seeing significant delays in the process – sometimes by up to 90 weeks. Other problems regularly seen by investigators include failing to involve parents and young people properly in the decision-making process, not gathering sufficient evidence to inform decisions, and a lack of proper forward planning when young people move between key educational stages.

This week’s announcement follows the publication of the Ombudsman’s focus report on the problems faced by parents of children with Special Educational Needs, based on its first 100 investigations. Published in October, the report highlighted the ‘disproportionate burden’ faced by parents fighting for their children to get the support they are entitled to.

The report gives local authorities best practice guidance to help councils get things right. It also offers councillors and scrutiny chairs a number of questions they can ask of their own authorities to ensure they offer children and young people with Special Educational Needs the best possible start.

L’événement a réuni, ces 8 et 9 mars 2018, des ombudsmans nationaux, régionaux et locaux de toute l'Europe, à l’invitation de la Médiatrice européenne. Les ombudsmans ont notamment discuté de la crise migratoire et des problèmes spécifiques liés aux minorités.

Problèmes transfrontaliers

Le Médiateur fédéral a partagé son expérience des problèmes transfrontaliers rencontrés par les citoyens.

Certains citoyens se plaignent de devoir payer deux fois la TVA lorsqu’ils achètent, par exemple, une voiture en Allemagne ou font réaliser des travaux par un fournisseur étranger. D’autres ayant travaillé aux Pays-Bas risquent de se retrouver, à 65 ans, sans pension ni allocations sociales pendant deux ans.

Guido Herman, Médiateur fédéral : « L’Union européenne joue un rôle primordial dans la résolution de ces problèmes. A terme, il est nécessaire de revoir la coordination et de renforcer l’harmonisation des règles au niveau européen. »
