El Instituto Nacional de Administración Pública (INAP) ha comunicado al Defensor del Pueblo que admite su sugerencia y permitirá a una mujer que dio a luz por cesárea el día antes del examen de la oposición a la que tenía previsto presentarse realizar la prueba próximamente.

Meses antes del examen la mujer había comunicado a la Comisión Permanente de Selección que se encontraba embarazada y que su fecha probable de parto coincidía con la de la prueba por lo que solicitaba instrucciones para poder realizar el ejercicio en caso de no poder asistir en la fecha fijada.

La Comisión le comunicó que debía ponerse en contacto por escrito comunicando su situación y adjuntando un certificado médico oficial acreditativo de la misma con una antelación de seis días a la fecha de celebración de la prueba. Todo ello con el objetivo de organizar los medios personales y materiales necesarios para garantizar la realización del examen en la fecha fijada en llamamiento único.

La interesada no siguió las instrucciones y hasta el día de antes no comunicó que se encontraba hospitalizada y que solicitaba que se le aplazara la realización del examen. Ese mismo día fue sometida a una cesárea. Finalmente, la Comisión desestimó su solicitud argumentando que había incumplido las instrucciones recibidas.

En opinión del Defensor del Pueblo, aunque la aspirante hubiese seguido las instrucciones de la Comisión, no podría haberse garantizado el llamamiento único y su prueba tendría que haber sido aplazada ya que no parecía factible realizar un examen en las instalaciones hospitalarias a una madre que acaba de sufrir una operación quirúrgica y mucho menos que la interesada acudiera personalmente a realizar el ejercicio en el lugar y hora establecido.

Así, el Defensor del Pueblo formuló una sugerencia al INAP para que reconsiderara la resolución de la Comisión Permanente de Selección y aplazara la realización del examen a esta mujer como por otra parte se contemplaba en la convocatoria para estos supuestos. El INAP ha aceptado esta sugerencia comunicando a la Institución que próximamente convocará a la interesada a una nueva prueba.

Dopo la definitiva chiusura della sezione 41 bis, il carcere ascolano è stato chiamato ad assorbire diversi detenuti destinati al circuito di alta sicurezza, con un inevitabile aumento delle problematiche già registrate nei mesi scorsi durante la visita effettuata dallo stesso Garante con la partecipazione di alcuni parlamentari marchigiani. “E’ indispensabile – sottolinea Nobili- garantire la vivibilità di luoghi, un adegauto aumento dell’organico di polizia penitenziaria nel rispetto di quanto previsto dalla pianta organica, ed un’attenzione costante sul versante sanitario”.
Al Garante è stata anche rappresentata l’esigenza di un intervento adeguato per quanto riguarda le attività trattamentali, oggetto nelle scorse settimane di un suo appello rivolto ai Presidenti di Giunta e Consiglio regionale in relazione allo sblocco dei finanziamenti previsti per i sei istituti operativi sul territorio marchigiano dalla legge di settore approvata nel 2008. Aspetto questo segnalato nel maggio scorso anche dal Provveditorato regionale dell’amministrazione penitenziaria.
Nobili ribadisce che “il ritardo nella messa a disposizione delle risorse continua a destare preoccupazione tra gli operatori, anche perchè il protrarsi della situazione d’incertezza potrebbe determinare l’interruzione dei progetti già avviati e l’impossibilità di attivarne altri nel prossimo futuro”.
Partendo da tali considerazioni il Garante ha esteso l’invito ad intervenire anche a tutti i capigruppo consiliari ed al Presidente della Commissione sanità, Fabrizio Volpini, chiedendo, se necessario, la convocazione urgente della medesima commissione per esaminare il problema “che ha caratteristiche di valenza altamente sociale, essendo le attività trattamentali alla base dei percorsi da attivare per un più consono reinserimento dei detenuti nella società”.

Unfair admission arrangement changes force siblings into separate schools

Nottinghamshire County Council has agreed to pay two families £500 a year because their children missed out on places at their preferred schools after it unfairly changed admissions arrangements, the Local Government and Social Care Ombudsman has said.

Because the council removed priority for families with children already at schools, the two families were left having to take their younger children to different primary schools.

And as their preferred school is full, there is little prospect of the younger siblings of either family being offered a place in the near future.

Local Government and Social Care Ombudsman, Michael King, said:

“The changes Nottinghamshire County Council made to its admissions arrangements have had a significant impact on daily life for these two families, which could last until the older siblings have moved on to senior school.

“In cases like this we would normally ask the council to offer a fresh appeal to the families. But because the school has now converted to an academy, neither the council nor we have any authority over its admissions arrangements.

“I am therefore pleased the council has accepted my recommendations, and hope these will go some way to help these families with their arrangements over the coming years.”

Councillors in Nottinghamshire decided to remove priority in the oversubscription criteria for children outside the schools’ catchment areas who had siblings, over those outside the catchment area who did not.

This decision affected the two families, who applied for reception places at the same school for entry in September 2016. The two families appealed the decision not to offer their children a place, but these appeals were unsuccessful.

The Office of the Schools Adjudicator ruled in January 2017 that the new admissions arrangements for September 2017 were unfair.  The council decided to offer second appeals to families affected by the changes in 2016 who might thereby have lost places.

The two families were offered a second appeal, but because the school was full it could not offer them places for their children.

The families are now having to transport their children to different schools in the morning, and make arrangements for after-school clubs or for friends and relatives to help with collecting in the afternoon.

The Local Government and Social Care Ombudsman’s role is to remedy injustice and share learning from investigations to help improve public, and adult social care, services.

In this case the council has agreed to apologise to the families and pay them each £500 per school year until either the time their eldest children leave the preferred school or the preferred school has spaces for their younger children. It will also pay both families £250 for the distress in being denied the remedy they should normally have been entitled to, and a further £250 each for the time and trouble in bringing their cases to the Ombudsman.

Complaints made to the Public Services Ombudsman for Wales about Welsh NHS bodies hit a record high last year, new figures show.

The Ombudsman’s Annual Report and Accounts for 2017/18 reveal that complaints against NHS bodies (which include Health Boards and Trusts, GPs and dentists) increased by 7% on the previous year – rising from 863 to 927.

Complaints about Health Boards rose 11%, with large increases in complaintsreceived about Abertawe Bro Morgannwg (up 29%) and Aneurin Bevan University Health Boards (up 34%).   Whilst the number of complaints about Betsi Cadwaladr University Health Board fell moderately by 3%, it still generated 186 complaints, the highest number of any Health Board in Wales.  There were small reductions in the number of complaints about other NHS bodies such as GPs and Dentists .

In total, the Ombudsman received 2,253 complaints, 2% fewer than in the previous year.  This decrease is largely attributed to a 10% reduction in complaints about local authority services.  Complaints that local councillors had breached their code of conduct, however, increased by 14%.

Assembly Members recently agreed to approve the general principles of new legislation that would give the Ombudsman own initiative powers and enable him to investigate the private healthcare element of complaints involving a mix of public and private healthcare.

Public Services Ombudsman for Wales, Nick Bennett, said:

“Spiralling health complaints are a real concern and they now make up more than 40% of my office’s total caseload.

“Many healthcare complaints are complex, sensitive and significant, often involving harm or the death of a family member.  They often take longer to investigate than other complaints due to the seriousness of the matters raised and the need for clinical advice.

“When my office finds an injustice, we expect bodies to take on the learning from my  investigations – only if they do this are we likely to stem the flow of complaints.

“More generally, I’m pleased to see a small reduction in the total number of complaints across devolved public services in Wales, with a 10% drop in complaints about local government. I hope standards of service are maintained and the improvement continues next year.”
