The senior advisor of the Ombudsman Institution participated at the ENNHRI’s WG meeting on the Convention on the Rights of Persons with Disabilities, as a member of the group, in Brussels, Belgium on May 14, 2019.  More than 20 representatives of the states and several European organizations attended the event.

The representative of the Institution noted that in Azerbaijan the Ombudsman was recommended to implement independent mechanism functions enshrined in the Article 33.2 of the CRPD. The Ombudsman receives and investigates the applications and complaints of the persons with disabilities, conducts visits to the state facilities, where they live or are kept and can not leave on their own will, for the protection of their rights. He said that the Law of the Republic of Azerbaijan “On the Rights of Persons with Disabilities” was adopted by the initiative of the Ombudsman.

The representative also gave information about the Parallel Report on Implementation of the CRPD, sent to the relevant UN Committee in 2013. He noted that the State Program on Development of Inclusive Education for Persons with Disabilities in 2018-2024 was approved in accordance with the Article 24 of the CRPD, taking into account the Commissioner’s proposals as well.

IN HIS OPINION FOR THE SENATE, THE COMMISSIONER FOR HUMAN RIGHTS NEGATIVELY ASSESSES THE TOUGHENING OF THE PENAL CODE PASSED BY THE SEJM ON 16 MAY 2019

  • EXCESSIVELY REPRESSIVE, RESTRICTS JUDICIAL LATITUDE, INCREASES PROSECUTORS’ AUTHORITY – THIS IS THE CHR’S ASSESSMENT OF THE PACKAGE OF AMENDMENTS TO THE PENAL CODE PASSED BY THE SEJM ON 16 MAY
  • THE ACT INTRODUCES HARSHER PENALTIES FOR MANY CRIMES, YET THE DATA SHOW THAT THE CRIME RATE HAS BEEN DECLINING IN POLAND FOR 10 YEARS
  • MORE EFFECTIVE DETERRENCE IS PROVIDED BY MORE LENIENT BUT UNAVOIDABLE PENALTIES THAN BY STRICTER PENALTIES THAT PERPETRATORS COUNT ON AVOIDING
  • THE CHR’S CRITICAL STANCE TOWARD THE AMENDMENTS ALSO STEMS FROM THE RAPID, TWO-DAY LEGISLATIVE PROCESS THAT PRECEDED THEIR ADOPTION, THE ABSENCE OF JUSTIFICATION FOR MANY OF THE AMENDMENTS AND THE LACK OF PUBLIC DEBATE
  • THE CHR IS ALSO OPPOSED TO THE NEW DEFAMATION LAWS, WHICH COULD RESTRICT FREEDOM OF SPEECH

Across Europe, recent elections and referendums have made one thing very clear: voting matters. How we vote – and whether we vote at all – can change our societies for generations.

It was also a good reminder of the risks that are never far away from election campaigns. Many recent votes have been marred by reports of deliberate efforts to manipulate voters with fake news.

So how to respond? The first step is to inform ourselves. To seek out reliable information on the issues that matter to us. The second is to get involved, whether by voting or campaigning or encouraging others to vote. The European Parliament elections on 23-26 May provide a chance to do just that.
