(EO) Query from the Catalan Ombudsman to the European Commission concerning the obligations on Spain to protect habitats and biodiversity, notably in relation to the Ebro Delta

The Catalan Ombudsman submitted a query to the European Ombudsman concerning Spain’s obligations to protect habitats and biodiversity, notably in relation to the Ebro Delta, which suffered damages during Storm Gloria (January 2020). The query was made in the context of an own-initiative investigation by the Catalan Ombudsman concerning the lack of timely action by the Spanish authorities to properly plan measures for the protection of the Ebro River and Delta.

Query

On 24 February 2021, the European Ombudsman asked the Commission to elaborate on the following questions:

(i) The Ebro Delta is designated as a Special Area of Conservation under the Habitats Directive (92/43/EEC) and a Special Protection Area under the Birds Directive (2009/147/EC). Do the provisions of these directives require Member States to adopt and implement effective measures for such designated areas aimed at protecting natural habitats and the animal and plant species therein?

(ii) Do the EU’s recent environmental and climate change commitments — as set out, for example, in the EU Biodiversity Strategy for 2030 ; the Communication ‘Stepping up Europe’s 2030 climate ambition, Investing in a climate-neutral future for the benefit of our people’;  or the European Green Deal  — make the adoption and implementation of such measures more urgent?

(iii) Does Article 7 of the Floods Directive (2007/60/EC) oblige Member States to develop and implement flood risk management plans for areas that have been subject to previous repeated floods? For such areas, are Member States obliged to implement measures aimed at mitigating the risk posed by flooding for human health, the environment, cultural heritage and economic activity, and, if appropriate, reducing the likelihood of future flooding?

Commission's reply

On 31 March 2021, the Commission replied that the Habitats Directive and the Birds Directive require Member States to set conservation objectives and to establish specific conservation measures for the designated areas. It stated that it is currently conducting an infringement procedure against Spain for breaching the Habitats Directive, including regarding the Ebro Delta.

It also stated that Member States have an obligation to establish flood risk management plans that include measures for achieving the main objectives (notably reducing the potential adverse consequences of flooding for human health, the environment, cultural heritage and economic activity). It noted that Spain’s Flood Risk Management Plan[1] designates the entire area of the Ebro Delta as being subject to flooding, and that the plan includes measures such as “coastal restoration projects that aim to increase the system capacity to absorb flood impacts and restoration of sand dunes in the delta area to reduce erosion problems”.

La vulnerabilidad por COVID-19 contará para optar a una vivienda de emergencia, como pidió el Defensor

La Comunidad de Madrid incluirá la vulnerabilidad derivada de la crisis provocada por la COVID-19 entre los criterios para adjudicar una vivienda de emergencia social, tal y como le había recomendado el Defensor del Pueblo.

Tras el estallido de la pandemia, la Institución consideró que era necesario adoptar alternativas y medidas para aliviar el impacto económico y social que ha generado el coronavirus en las familias más vulnerables.

Tras abrir una actuación de oficio, el Defensor recomendó “incluir entre los acontecimientos extraordinarios del artículo 18 del Decreto 52/2016, de 31 de mayo las situaciones de vulnerabilidad residencial derivadas de la COVID-19 que imposibilitan a los ciudadanos afectados encontrar una alternativa habitacional para sí y para las personas con las que conviven, de manera que estos puedan resultar adjudicatarios de vivienda por emergencia social, siempre que en todos ellos concurran situaciones de grave dificultad económica, social o familiar”.

En su escrito de respuesta a la Institución, la Consejería de Vivienda y Administración Local del gobierno madrileño reconoce que “serán numerosas las familias que se verán especialmente afectadas por esta crisis y que necesitarán de un apoyo en su proceso de recuperación en aras de evitar situaciones de exclusión social”.

Por ello, acepta la recomendación y asegura que “se valorarán como supuesto de emergencia social las circunstancias acreditadas y derivadas desde el inicio de la situación de estado de alarma como consecuencia de la COVID-19”.

En concreto, añade que “como situación de especial necesidad, se atenderá mediante una clasificación propia a personas en situación de estabilidad residencial y económica previa a la COVID-19 que como consecuencia de la pandemia sanitaria hayan visto agravada su situación acreditada de vivienda, o haya concurrido pérdida de la misma, mediante su priorización, considerando tal circunstancia ponderable en aplicación del apartado 8 del Anexo I del Decreto 52/2016, de 31 de mayo”.

AntiDiscriminations.fr - 5 000 appels, 1 500 tchats et 3 500 saisines : retour sur 4 mois d’activité

Lancé le 12 février dernier, le service de signalement et d’accompagnement des victimes de discriminations du Défenseur des droits, dresse un point d’étape après 4 mois d’activité croissante.

Doté d’un numéro de téléphone à 4 chiffres (39 28), d’un tchat, et d’un accès sourds ou malentendants, AntiDiscriminations.fr est destiné aux personnes victimes ou témoins de discriminations, quel qu’en soit le motif et le domaine.

L’identification des discriminations peut être difficile à établir par les victimes. Aussi, face à des expériences de discriminations répétées, la majorité des victimes n’engagent pas de recours.

Au bout de la ligne du 39.28, ou par tchat, les juristes du Défenseur des droits, spécialement formés à la discrimination, effectuent un premier niveau de prise en charge auprès des victimes : écoute, réponse aux questions, première qualification juridique de leur situation, explication des démarches possibles et orientation. Face à ces situations, après 4 mois d’existence, c’est un bilan très positif pour AntiDiscriminations.fr qui confirme son utilité pour permettre aux victimes de faire valoir leurs droits.

Ainsi, depuis son ouverture, AntiDiscriminations.fr enregistre :

  • 5 000 appels au 39.28, d’une durée moyenne de 15 minutes
  • 1 500 tchats, d’une durée de conversation moyenne de 30 minutes
  • Plus de 3 500 dossiers en cours d’instruction au Défenseur des droits

Les trois principaux domaines de discriminations observés depuis le 12 février sont l’emploi privé (43%), la fonction publique (13%) et le service public (10%).

Concernant les critères de discriminations, le Défenseur des droits observe que l’origine reste le principal critère (20%) comme il l’a souvent rappelé, suivi du handicap (10%) et de l’état de santé (5%).

Enfin, le Défenseur des droits constate que 73% des appels au 39.28 aboutissent à une saisine de l’institution - soit 3 500 saisines, représentant en 4 mois 70% d’une année d’activité en matière de lutte contre les discriminations[1]. Ainsi, AntiDiscriminations.fr se présente comme une porte d’entrée mieux identifiable pour les victimes ou témoins afin d’agir en matière de lutte contre les discriminations.
