La Défenseure des droits, Claire Hédon, a remis ce jour sa contribution à la consultation citoyenne sur les discriminations lancée en avril dernier par Elisabeth Moreno, ministre déléguée chargée de l’égalité entre les femmes et les hommes, de la diversité et de l’égalité des chances, et Marc Fesneau ministre délégué, chargé des relations avec le Parlement et de la participation citoyenne.

Le Défenseur des droits est en charge de la mission de lutte contre les discriminations et de promotion de l’égalité. A ce titre, l’institution alerte depuis des années sur l’insuffisante mobilisation des pouvoirs publics et a publié de nombreuses propositions de réformes et recommandations afin de mieux prévenir et sanctionner les discriminations. Les près de 5000 appels et 1500 tchats initiés sur la plateforme antidiscriminations.fr depuis son lancement en février dernier par le Défenseur des droits démontrent à nouveau les attentes et besoins de la population.

Dans ce contexte, la Défenseure des droits salue l’initiative de consultation citoyenne qui vise à construire collectivement les outils pour mieux assurer l’effectivité du principe de non-discrimination. A travers sa contribution, elle entend contribuer au débat public pour favoriser l’élaboration d’une politique de lutte contre les discriminations ambitieuse.

La Défenseure des droits insiste sur la double nécessité d’une action transversale aux 25 critères légaux de discriminations et de mesures spécifiques pour les formes les plus répandues de discriminations, et les plus délétères pour notre système social, en rappelant notamment la nécessité de traiter les discriminations fondées sur l’origine. Elle rappelle notamment son souhait de voir créer un observatoire des discriminations permettant de quantifier les discriminations et de les analyser, la mesure constituant un levier indispensable pour construire et guider une véritable politique publique de lutte contre les discriminations.

• Assurer une sanction dissuasive des discriminations par les juges
• Assurer une réelle portée au dispositif d’action de groupe
• Assurer un engagement des organisations dans la prévention des discriminations

• Assurer la transparence, la traçabilité et l’objectivation des procédures et décisions
• Éduquer contre les discriminations
