El Síndic investiga de oficio las garantías del procedimiento sancionador y el sistema de revisión a raíz de una multa inverosímil por un radar en Barcelona

Una persona resultó sancionada por un error en un radar ubicado en la Ronda de Dalt de Barcelona

El Síndic ha solicitado información al Ayuntamiento de Barcelona para conocer el alcance del fallo y el protocolo de revisión para los afectados
 

El Síndic ha tenido conocimiento por los medios de comunicación de una multa de tráfico por circular supuestamente a 298 km/h por la Ronda de Dalt de Barcelona, en el que límite de velocidad permitido es de 60, a una persona que iba a trabajar, el 28 de abril de 2020, en pleno confinamiento. La multa consistió en el pago de 600 euros y también conllevó la retirada de 6 puntos del carné de conducir.

La persona afectada presentó dos recursos administrativos puesto que aseguraba que era imposible que circulara a esa velocidad ya que, entre otros motivos, según la ficha técnica, su vehículo no puede superar los 221 km/hora. Ninguno de los dos recursos fueron aceptados alegando que el radar estaba homologado y que existía constancia fotográfica del vehículo identificado (simplemente una foto donde se ve la matrícula del coche), una respuesta genérica y que no entraba a valorar el caso concreto que se estaba planteando.

Finalmente, los medios de comunicación también han publicado que el Ayuntamiento se ha avenido a revisar el caso y ha abierto una investigación interna de la que se desprende que el radar tuvo un problema puntual con el GPS, justo cuando pasaba el coche afectado. Asimismo ha hecho saber que se revisarán los procedimientos para que no se puedan repetir casos similares.

A pesar de todo ello, el Síndic ha abierto una actuación de oficio con la voluntad de constatar los hechos, conocer el origen de los errores que se han producido, el número de personas que se han podido ver afectadas y el alcance del fallo. También pide al Ayuntamiento de Barcelona conocer cuáles serán los protocolos que se instaurarán para reparar el error.

Protector of Citizens controls competent authorities after child’s death in Lebane

Upon learning from the media that the family from Lebane whose child was found dead in the family home has been on the competent authorities’ records and that two older children were previously removed to foster families, the Protector of Citizens launched own-initiative investigation to control work legality and regularity of Lebane Social Welfare Center and the Ministry of the Interior of the Republic of Serbia.

The Protector of Citizens has requested Lebane Social Welfare Center to provide data on all activities undertaken in this case, particularly including possible domestic violence reports, within 15 days.

Given the media information that the police had already searched for the father due to the criminal acts he had committed earlier, the Protector of Citizens has requested the Ministry of the Interior to notify the Institution, within the same deadline, whether the MOI had acted on possible violence reports in the deceased child’s family

City council censured for complaints response

The Local Government and Social Care Ombudsman has heavily criticised Bristol City Council for failing to provide evidence it had completed recommendations in two separate complaints.

Investigations into the complaints, which involved missed bin collections and noise nuisances, were completed in early 2020. In both cases the council accepted the Ombudsman’s decision and its recommendations to put things right for the men who had complained, and to improve its services for other people in the city.

Owing to the COVID-19 crisis, the Ombudsman suspended chasing the council for evidence it had complied with the recommendations during the first lockdown in Spring 2020.

Once it resumed its casework, in both cases the Ombudsman contacted the council, including the Chief Executive, numerous times for a response. But it was not until the Ombudsman registered fresh complaints in November 2020 that the council provided the evidence needed to comply.

The council has explained to the Ombudsman it recognises it had an issue with “case handling resource problems”. It carried out an independent internal investigation resulting in recommendations for improvements being made to the Chief Executive. The council says actions have been implemented in most of its cases from October 2020.

Michael King, Local Government and Social Care Ombudsman, said:

“Good complaints handling should be at the heart of any local authority’s corporate governance arrangements and oversight, but it is clear from these two cases there were significant issues in the city.

“I am pleased the council has acknowledged and identified there have been problems with its complaint handling. However, it should not have taken our intervention - including months of chasing, and our decision to register new complaints - to trigger this.

“This report demonstrates the efforts to which we go, to ensure councils follow-through on their commitments to put things right, and how we will hold them to account if they don’t. I hope councils across the country will take lessons from it and ensure their own complaints arrangements meet the standards both we, and the people they serve, expect.”

The Local Government and Social Care Ombudsman’s role is to remedy injustice and share learning from investigations to help improve public, and adult social care, services. In this case the council has agreed to apologise to both men for not carrying out the actions previously agreed. It will also pay them £100 to recognise the frustration and uncertainty caused.

The Ombudsman has the power to make recommendations to improve processes for the wider public. In this case the council has agreed to review its revised arrangements for monitoring complaints and ensuring compliance with any future recommendations made. It will also ensure waste collection monitoring arrangements are robust so it can provide evidence of monitoring in future cases.

In addition, the council still needs to satisfy the Ombudsman on an outstanding original recommendation made in the waste collection case which was to update and provide a copy of its written missed collections policy.
