What had seemed unthinkable in Europe in the 21st century has just happened. Our continent is today once more being drawn into an armed conflict. The Russian military attack on Ukraine has already resulted in the loss of human life and dire human suffering. It exposes millions of people in Ukraine and beyond to the risk of senseless violence, displacement and other serious violations of human rights and international humanitarian law. People are already fleeing in high numbers in search of safety, away from the hostilities. Many others, such as elderly people, people with disabilities, the sick, and families with young children, may be unable to leave and are therefore particularly vulnerable.


I urge the authorities of the Russian Federation to prevent the further unfolding of this human rights disaster by immediately putting a stop to all military actions in Ukraine and adhering strictly to international humanitarian and human rights law. I further call on all Council of Europe member states to stand in unity and solidarity with Ukraine and to receive people fleeing Ukraine with open arms to help protect their dignity, safety and human rights. My thoughts are with the people of Ukraine and all those affected by these terrible events and as Commissioner for Human Rights, I will do my utmost to address the human rights violations resulting from this situation.

Petitionsausschuss berät zu den Auswirkungen der Corona-Maßnahmen auf Kinder und Jugendliche

Der Petitionsausschuss kam gestern zu seiner 4. Sitzung zusammen, die als Präsenz- und Videokonferenz durchgeführt wurde.


Im ersten Tagesordnungspunkt wurde die Petition des Sozialpädiatrischen Zentrums Mecklenburg-Schwerin (SPZ) gemeinsam mit einem Vertreter des Petenten und Vertretern des Bildungsministeriums beraten. Der Petent hatte in seiner Eingabe die gesundheitlichen Probleme der Kinder und Jugendlichen infolge der Corona-Maßnahmen dargestellt. Zu diesen Folgen gehören unter anderem Übergewicht aufgrund mangelnder Bewegung, die fehlende oder unzureichende Betreuung von Kindern und Jugendlichen mit Förderbedarf und die vor allem während der Lockdowns auftretenden Überlastungssituation in den Familien. Der Vertreter des Petenten führte hierzu aus, dass einige der Forderungen zwischenzeitlich bereits umgesetzt worden seien. Im Zuge der Beratung einigten sich das Bildungsministerium und der Petent darauf, die noch offenen Fragen in einem gemeinsamen Gespräch zu klären. Außerdem bot das Bildungsministerium dem Petenten an, künftig an der im Ministerium eingerichteten Expertenkommission „Schule, Kita, Hort“ teilzunehmen. Von Interesse war auch die Frage, inwiefern im kommenden Schuljahr 2022/23 die Schuleingangsuntersuchungen gesichert seien.


Der Petitionsausschuss beschloss einstimmig die Petition der Landesregierung zur Berücksichtigung zu überweisen, da das Anliegen des Petenten begründet und Abhilfe notwendig sei.  Weiterhin wurde einstimmig beschlossen, die Petition den Fraktionen des Landtages zur Kenntnisnahme zu geben, um sie auf das Anliegen des Petenten besonders aufmerksam zu machen.


In einer weiteren Petition setzt sich der Petent für eine Änderung des § 87 Absatz 2 Nr. 1 Aufenthaltsgesetz ein. Danach sind die zuständigen öffentlichen Stellen verpflichtet, Personen ohne gültigen Aufenthaltstitel umgehend an die Ausländerbehörde zu melden, wenn sie eine Kostenübernahme für medizinische Leistungen beantragen. Aus Angst vor einer Abschiebung würden sich viele Betroffene nicht behandeln lassen, darunter Menschen mit lebensbedrohlichen Krankheiten, Schwangere und Kinder. Der Petent fordert die Aufnahme eines Ausnahmetatbestandes und regt hierzu eine Bundesratsinitiative an. Der Petitionsausschuss beschloss, den Landtag zu empfehlen, die Petition zum einen der Landesregierung als Material für künftige Verordnungen oder andere Initiativen oder Verordnungen zu überweisen. Zum anderen solle die Petition den Fraktionen des Landtags zu Kenntnisnahme gegeben und zusätzlich an den deutschen Bundestag abgegeben werden.

Personale, telemedicina, ospedalizzazione dei detenuti

Il Garante Giulianelli partecipa, per la prima volta, al tavolo dell’Osservatorio regionale sulla sanità penitenziaria. Al centro dell’attenzione anche l’aumento delle patologie psichiatriche, il ruolo e l’attività della Rems


Il Garante per la prima volta al tavolo dell’Osservatorio regionale sulla sanità penitenziaria. “Una partecipazione che abbiamo chiesto ed ottenuto – evidenzia Giancarlo Giulianelli – e che già dalla prima riunione ha dato l’avvio ad un positivo confronto in ordine ai problemi che attualmente gravano sulle strutture carcerarie delle Marche e che avevamo già avuto modo di affrontare con il Provveditore dell’amministrazione penitenziaria di Emilia Romagna e Marche, Gloria Manzelli”.


Tra le numerose questioni affrontate, quella di garantire le necessarie prestazioni mediche nelle diverse strutture, anche in relazione alle patologie riscontrate tra i detenuti.


“Una situazione a cui si sta ponendo mano – dice il Garante – ma che richiederà ulteriori interventi per la sua competa definizione. L’aumento dei problemi di ordine psichiatrico richiama un’attenzione particolare anche rispetto al ruolo e all’attività delle Rems, con la consapevolezza che nelle Marche esiste soltanto una struttura di questo tipo, ubicata in via provvisoria a Fossombrone”.


Argomento di estrema attualità, affrontato nel corso dell’incontro, quello della telemedicina per il quale, come spiega Giulianelli, “occorrerà a monte una verifica dei requisiti tecnici, prevedendo un avvio comprensibilmente graduale a secondo del livello di presenza degli stessi nei singoli istituti”.


Da ultimo, ma non per importanza, il problema legato all’ospedalizzazione dei detenuti, con l’individuazione di stanze a loro riservate, soprattutto nei nosocomi situati in prossimità delle strutture carcerarie.


“Una ricognizione generale – conclude il Garante – permetterà di avere elementi ancora più concreti da portare al centro dell’attenzione del prossimo incontro. Proseguirà, intanto, la consueta azione di monitoraggio negli istituti penitenziari messa in atto periodicamente dall’Autorità di garanzia, anche per quanto riguarda la situazione legata alla diffusione del Covid, che come abbiamo avuto nodo di dire nei giorni scorsi sembra avviarsi sulla strada della normalizzazione”.

Ombudsman’s COVID report highlights how councils and care providers coped

The COVID-19 pandemic placed unprecedented pressure on councils and care providers, and a new report from the Local Government and Social Care Ombudsman analyses just how those organisations coped.


The Ombudsman investigates complaints about local councils and care providers in England, getting involved when things have gone badly wrong. Today’s report, which analyses its cases over the first 18 months of the pandemic, shows that, by and large, councils and care providers weathered the unprecedented pressures they were under. But, when things did go wrong it had a serious impact on people’s lives.


Cases highlighted in the report include a woman who died from COVID-19 at a care home with poor infection control procedures which was then compounded by staff later trying to cover up the facts.


Another case involved a homeless family left to sofa surf then sleep in a tent at the height of the pandemic, after different departments of the same council failed to help them.


The Ombudsman’s report focuses on the lessons that can be learned from the complaints it has received about the pandemic and welcomes that, in many cases, councils and care providers are already using their experiences from the pandemic to consider how they can make improvements to services.


The report also offers questions councillors and scrutiny committees can ask to reflect on their own council’s practice during this time.


Michael King, Local Government and Social Care Ombudsman, said:


“We have investigated some tragic individual cases over the past months. Each represents poor personal experiences where councils and care providers did not get things right.

“Our investigations have shown that, while the system did not collapse under the extreme pressures placed on it, COVID-19 has magnified stresses and weaknesses present before the pandemic affecting some councils and providers.

“We have always advocated how crucial good complaint handling is in any setting, so I am particularly saddened that, in some authorities, dealing with public concerns and complaints itself became a casualty of the crisis. At a time when listening to public problems was more important than ever, we saw some overstretched and under-resourced complaints teams struggle to cope.

“If evidence was needed, this report proves that managing complaints should be considered a frontline service.”

Laura Iturrate Areste, nueva Secretaria General del Defensor del Pueblo Andaluz

Laura Iturrate Areste tomó ayer posesión del cargo como nueva secretaria general del Defensor del Pueblo Andaluz.

 

Nacida en Sevilla, es Licenciada en Derecho por la Universidad de Sevilla -Especialidad Derecho Público- y cuenta con el título de experta en Administración Pública por la referida Univesidad y el Diploma de Estudios Avanzados en Derechos Humanos y Desarrollo por la Universidad Pablo de Olavide. 

 

Es funcionaria de carrera de la Junta de Andalucía del Cuerpo Técnico Superior de Administradores Generales (Especialidad Gestión Financiera), desde el año 2003 y ha desempeñado diversas responsabilidades dentro de la Junta de Andalucía. Con anterioridad a su incorporación a la Función Pública ha ejercido de abogada por cuenta propia en diversos despachos profesionales.

 

Dentro de la Administración de la Junta de Andalucía,  ha  sido Jefa de la Oficina de Planificación y Gestión de la Secretaría General de Políticas Sociales y Conciliación; Jefa del Servicio de Asistencia Técnica y Seguimiento de la Oficina de Pensiones de Dirección General de Personas Mayores y Pensiones no Contributivas, Jefa del Gabinete de Planificación y Relaciones Institucionales de la Secretaría General de Servicios Sociales y Jefa del Servicio de Educación y Promoción de Consumidores .

 

Ha participado de forma activa en proyectos de digitalización, automatización e interoperabilidad de datos con otras Administraciones Públicas para la agilización de los procedimientos administrativos (PNC y RMISA),  en el diseño y puesta en marcha de proyectos financiados con Fondos Europeos (FSE y FEDER) y ha colaborado en diversos planes estrategicos de la Consejería con competencias en materia de servicios sociales.

 

Actualmente, venía desempeñando la labor de asesora técnica de la Defensoría andaluza desde noviembre de 2019 en el Área de Salud, Servicios Sociales y Dependencia de la Institución.
