Arrêt de la Cour dans les affaires jointes C-339/20 | VD et C-397/20 | SR

La conservation généralisée et indifférenciée des données de trafic pendant un an à compter du jour de l’enregistrement par les opérateurs de services de communications électroniques n’est pas autorisée, à titre préventif, aux fins de la lutte contre les infractions d’abus de marché, dont font partie les opérations d’initiés

Une juridiction nationale ne peut en outre limiter dans le temps les effets d’une déclaration d’invalidité d’une législation nationale prévoyant une telle conservation

Des procédures pénales ont été engagées en France contre VD et SR des chefs de délits d’initiés, de recel de délits d’initiés, de complicité, de corruption et de blanchiment. Ces procédures avaient pour origine des données à caractère personnel issues d’appels téléphoniques effectués par VD et SR, générées dans le cadre de la fourniture de services de communications électroniques, qui avaient été communiqués au juge d’instruction par l’Autorité des marchés financiers (AMF) à la suite d’une enquête diligentée par cette dernière.

Felipe Afonso acudió a estas jornadas de concienciación y visibilización de la enfermedad, organizadas por la Asociación de Fuerteventura de Familias de personas con Alzheimer (AFFA) con motivo del Día Mundial del Alzheimer

El adjunto primero de la Diputación del Común, Felipe Afonso, asistió a las I Jornadas Alzheimer Fuerteventura: “Gestión Sociosanitaria Integral del Deterioro Cognitivo”, organizadas por la Asociación de Fuerteventura de Familias de personas con Alzheimer (AFFA) con motivo del Día Mundial del Alzheimer. El objetivo de este acto fue concienciar, visibilizar y proponer nuevos modelos de atención a las personas que conviven con la enfermedad.

La presentación corrió a cargo del presidente del Cabildo Insular de Fuerteventura, Sergio Lloret, del consejero de Políticas Sociales, Adargoma Hernández, de la directora del área de Salud, Sandra Celis, y del presidente de AFFA, José Bueno.

Tras esta presentación, intervino el doctor en Medicina y Cirugía por la Universidad del País Vasco, Rafael Bengoa, mediante una ponencia online que fue moderada por el gerente de Servicios Sanitarios de Fuerteventura, José Luis Rodríguez, y por el presidente de AFFA.

The Ombudsman participates in the ENOC Annual Conference

From 19 to 21 September, Ombudsman Mr Juris Jansons and Head of Communication and International Cooperation Division Ms Ruta Silina are in Reykjavik, Iceland, attending the European Network of Ombudspersons for Children (ENOC) Annual Conference and Annual General Assembly.

This year, the main topic for ENOC’s activities has been climate justice from a children’s rights perspective. The Annual Conference will thoroughly address the main findings of ENOC’s research on Climate Justice, along with valuable insights from the young people participating in the European Network of Young Advisors (ENYA). Among other, experts have gathered information on existing and/or missing justice mechanisms (i.e., prevention, complaints, reparation, compensation mechanisms) that enable or prevent children and adults to enjoy a wide array of rights related to the environment. They also provided useful input and suggestions regarding children’s engagement in climate activism, climate actions to mitigate environmental impact and child participation in environmental policy and decision-making. They stressed the pivotal role of human rights education, as well as the right to a healthy environment, as a way of empowering children to stand up for their rights.

Los derechos de la infancia ante el cambio climático, a debate en la Conferencia ENOC que se celebra en Reykjavik

El Consejo del Menor e-foro de la Defensoría de la Infancia y Adolescencia de Andalucía está participando esta semana en la Conferencia de ENOC (European Networks Ombudsperson for Children) sobre cambio climático que se celebra en Reykjavik, Islandia, del 19 al 21 de septiembre.

Natalia, nuestra consejera de la provincia de Cádiz, ha participado en los talleres junto a niños, niñas y jóvenes de otros países para concienciar sobre los derechos de los niños y la justicia climática, y ha intervenido ante el auditorio para recordar a los adultos el deber de cumplir con la Convención de los Derechos del Niño de la ONU.

(FRA) Jim Clarken elected new FRA Management Board Chair

Clarken is a Commissioner at the Irish Human Rights and Equality Commission, CEO of Oxfam Ireland and a member of the Executive Board of Oxfam International. He is also an adjunct Professor at the School of Business and Law at National University of Ireland, Cork.

He is a leading commentator on global issues relating to human rights, inequality, sustainable development and the role of business in protecting and promoting human rights, with a deep commitment to women’s rights and equality. He regularly contributes to political and public debate in a wide range of international fora and his expertise and experience have been sought by government, business and academia for many years.

On accepting this role Clarken said: “I am deeply honoured to have been elected to this position. I will endeavour to lead and support the FRA Management Board with energy and commitment as we navigate these challenging times, balancing the need to tackle emerging issues with a deep commitment to continuing the excellent work of FRA, putting Rights Holders at the heart of all that we do”.

At the same time, Lyra Jakulevičienė was elected a member of the Executive Board. Jakulevičienė is an international and European Union law professor at Mykolas Romeris University in Lithuania. Previously, she held various positions at the United Nations.

The Agency thanks the outgoing Chairperson Elise Barbé for her expert guidance over the years. 

The Management Board is FRA’s independent oversight body. It is responsible for adopting the agency’s multiannual Programming Document, and its annual Fundamental Rights Report. It monitors the Agency’s operations and adopts its budget. It also appoints FRA’s Director, as well as the members of its Scientific Committee.

The Management Board consists of one independent member per Member State, nominated for five years. Members have high-level responsibilities in national human rights institutions or other public or private sector organisations.

Two representatives of the European Commission and one independent person appointed by the Council of Europe also sit on the Board.

Members from Albania, North Macedonia and Serbia participate as observers in the work of the FRA Board.
