El accidente por un choque entre dos trenes ha causado una treintena de heridos

El Síndic quiere conocer cuál ha sido la causa del accidente y qué actuaciones se han llevado a cabo para garantizar los derechos de los usuarios

Estudiará todas las quejas que le puedan hacer llegar las personas afectadas

El Síndic de Greuges de Cataluña ha abierto una investigación en relación al accidente que se produjo entre un tren de mercancías y un tren de pasajeros de la línea R16 en Vila-seca. De acuerdo con las informaciones publicadas, una locomotora de la empresa Cargometro no se detuvo en un semáforo y acabó impactando sobre el tren regional de la línea R16. Según estas informaciones, la locomotora del tren de mercancías sufrió un fallo en los frenos y no pudo respetar el semáforo rojo. Como consecuencia del impacto, una treintena de personas resultaron heridas, cinco de ellas graves.

Mediante las peticiones de información que se han realizado, Síndic quiere conocer cuál se considera que ha sido la causa del accidente y qué actuaciones se han llevado a cabo –o están previstas– para garantizar los derechos de las personas que viajaban en el convoy accidentado en la asistencia, la seguridad, la indemnización de los daños y la calidad del servicio. También quiere saber cómo se gestionará el día a día en esta línea y, en concreto, si el accidente ha afectado a la infraestructura. También quiere saber cuál es la empresa responsable de realizar el mantenimiento (revisiones, inspecciones, etc.) del material rodante de FGC que se ha visto implicado en este accidente, y si este material rodante estaba al día en el cumplimiento de las obligaciones legales relativas a la gestión de la seguridad y los requisitos sobre los sistemas de control, circulación y seguridad ferroviaria. En este contexto, se ha solicitado información al Departamento de la Vicepresidencia y de Políticas Digitales y Territorio, a FGC, a la Agencia Catalana del Consumo, al Ayuntamiento de Vila-seca y al Ministerio de Transportes, Movilidad y Agenda Urbana.

El Síndic recuerda que el Código de consumo de Cataluña considera que los transportes son un servicio básico, esto es, un servicio de carácter esencial y necesario para la vida cotidiana o que tiene un uso generalizado entre las personas consumidoras. Además, el mismo Código identifica a unos colectivos de especial protección en las relaciones de consumo, como los niños y los adolescentes, las personas mayores, las personas enfermas, las personas con discapacidades y cualquier otro colectivo en situación de inferioridad o indefensión especiales.

En 2016 el Síndic presentó en el Parlament de Catalunya el Informe sobre los derechos de las personas en los servicios ferroviarios en Cataluña, que incluía hasta 75 medidas para garantizar los derechos de los pasajeros a un servicio de calidad. El propio Estatuto de autonomía de Cataluña (EAC) determina que los poderes públicos deben promover políticas de transporte y de comunicación basadas en criterios de sostenibilidad, que fomenten la utilización del transporte público y la mejora de la movilidad, y que garanticen el accesibilidad para las personas con movilidad reducida. Además, el Estatut también dispone que los poderes públicos deben garantizar la protección de la salud, la seguridad y la defensa de los derechos e intereses legítimos de los consumidores y usuarios.

El Síndic también abrió actuaciones de oficio a raíz de los accidentes ocurridos en la red de Cercanías de Cataluña en Vacarisses (2018), Castellgalí (2019) y Sant Boi de Llobregat (2022), y manifiesta que ha recibido numerosas quejas a lo largo de los años.

La institución estudiará detenidamente todas las quejas que le hagan llegar las personas afectadas y trabajará para garantizar los derechos de estas personas, tanto en el marco de la actuación de oficio que se ha abierto como de las quejas que reciba en relación con este caso.

Nur acht Monate danach wurde Frau P. auf Stufe 1 heruntergestuft, obwohl sich ihr Zustand verschlechtert hatte: Sie braucht Hilfe bei Körperpflege und am Klo, beim Aus- und Anziehen und bei vielen anderen alltäglichen Verrichtungen. Im Mai wandte sich Volksanwalt Bernhard Achitz an die zuständige Pensionsversicherung PVA und verlangte eine neuerliche Begutachtung durch einen Facharzt. „Die PVA ist unserer Anregung erfreulicherweise gefolgt – mit dem Ergebnis, dass Frau P. jetzt sogar Pflegegeld der Stufe 4 bekommt“, berichtete Achitz in der ORF-Sendung „Bürgeranwalt“.

Einzelfall gelöst, Problem bleibt

Das grundsätzliche Problem, dass Menschen mit Demenz manchmal falsch eingestuft werden, bleibt aber bestehen, entsprechende Reformen sind notwendig. „Die Regeln, mit denen die Höhe des Pflegegelds festgelegt wird, zielen auf körperliche Beeinträchtigungen und Erkrankungen ab. Psychische Beeinträchtigungen wie Demenz werden nicht ausreichend berücksichtigt, obwohl die Betroffenen viel Pflege brauchen“, kritisiert Achitz: „Die Volksanwaltschaft fordert, dass die Einstufungsverordnung überarbeitet wird. Bei den Gutachten müssen die Angehörigen besser eingebunden werden, und die Pensionsversicherung muss besser auf die Spezialisierung der Gutachterinnen und Gutachter schauen.“

Erhöhter Unterstützungsbedarf, obwohl körperliche Fähigkeiten noch vorhanden sind

„Oft entsprechen Pflegegeldeinstufungen von geistig oder psychisch schwer beeinträchtigten Menschen bei weitem nicht der zeitlichen und psychischen Belastung, die mit ihrer Betreuung verbunden ist“, so Achitz. Die Richt- und Mindestwerte der Einstufungsverordnung (EinstV) zum Pflegegeldgesetz stellen primär auf den Hilfe- und Betreuungsbedarf bei körperlichen Beeinträchtigungen ab. Die Pflegeabhängigkeit geistig oder psychisch beeinträchtigter Menschen wird in der EinstV nicht ausreichend abgebildet. Daran änderte auch der seit 2009 bestehende Erschwerniszuschlag für geistig oder psychisch schwer beeinträchtigte Personen wenig.

On 13 June 2022, the Human Rights Ombudsman Peter Svetina presented to the Speaker of the National Assembly of the Republic of Slovenia Urška Klakočar Zupančič the 27th annual report of the Human Rights Ombudsman and the 14th report of the National Preventive Mechanism for 2021. In the new report, the Ombudsman addressed 86 new recommendations to various bodies. "We made fewer new recommendations this year than last year, but there is still a lot of work to be done by the competent authorities and institutions. Many of the previous recommendations by the Ombudsman have not yet been implemented, which is unacceptable. The people's rights defined in the relevant acts presuppose the obligation of the state to exercise them. The Constitution and laws impose a mandate on the Ombudsman to supervise their implementation. It does this in accordance with the highest international standards, which has been confirmed by evaluators as part of the accreditation procedure for a national institution for human rights with A status in accordance with the Paris Principles. The awarding of this status in 2021 is a signal to the Slovenian state that respecting the Ombudsman as a national institution for human rights and its strengthening is the right path. This is why I expect this signal to be perceived and demonstrated in practice. If the authorities follow the Ombudsman's recommendations, it means that they are doing good for the people. After all, they were elected by them and they are expected to create a society in which rights are respected," Ombudsman Svetina noted.

The work of the institution of the Ombudsman in 2021 was strongly marked by the coronavirus pandemic. "We processed 6,863 cases, which is a third more than in the pre-Covid period, and this is a record number of cases in the time since I've been running the institution. This shows that the institution of the Ombudsman is recognised in society, as an increasing number of people are turning to it. Last year we identified 276 violations of human rights, fundamental freedoms and other irregularities. Although I'm very happy that their number dropped by 40% compared to 2020, any violation found is inadmissible and too many," said Ombudsman Svetina.

As he said in a press statement after the meeting with the Speaker of the National Assembly, in 2021 state bodies, local community bodies and holders of public authority most often violated the principle of good governance, followed by violations of equality before the law, disability rights and equal protection of rights.  The areas covered by the Ministry of Labour, the Family, Social Affairs and Equal Opportunities stand out in terms of violations, with as many as 63 recorded in 2021. These are followed by the areas covered by of the Ministry of the Environment and Spatial Planning (25), which last year failed to implement any of the Ombudsman's recommendations from the 2020 Annual Report. The Ombudsman also detected many violations in the areas covered by the Ministry of the Interior and the Ministry of Health (18 each).

Svetina also notes that the cracks that have been showing in the field of human rights for years have deepened in the last two pandemic years, and that no one has tackled them, although the institution of the Ombudsman has been warning about them. "Certain areas have been neglected for the last two years, that is a fact, and many of the most vulnerable among us have paid a high price, so we must do everything we can to stop this trend. The attitude of the state towards human rights and the most vulnerable groups of the population is the best mirror of society. I would like to see us finally be guided by our actions and have the decision-makers implement our recommendations as soon as possible for the benefit of all individuals," the Ombudsman said as he presented the annual reports.

Among other things, he praised the progress made in the implementation of judgements of the European Court of Human Rights, as "only" five remain unimplemented. The situation is sad regarding the implementation of decisions of the Constitutional Court of the Republic of Slovenia (US), with the number of unimplemented decisions constantly growing in recent years. At the end of 2021, there were 23 declaratory decisions of the US that were yet to be implemented," the Ombudsman said on the occasion, noting only a part of the findings covered in the 2021 annual report. In 2021, an advocate of children's rights was assigned to almost 100 children, which indicates that this institute is urgently needed in society. Despite the pandemic-related restrictions, the Ombudsman continued to carry out the tasks and powers of the National Preventive Mechanism (DPM) in 2021. It visited 60 places of detention and issued as many as501 recommendations in the process, which is almost 200 recommendations more than the year before. He also presented this report to the Speaker of the National Assembly of the Republic of Slovenia Urška Klakočar Zupančič.

The Ombudsman places great importance on the protection of the environment, which is why the 2021 annual reports were published for the first time in full only in an electronic PDF version, available on the website www.varuh-rs.si and www.ombudsman.si. "With such an approach, we want to give a clear signal that individual institutions and society as a whole need to be as sustainability-oriented as possible - not only in words, but also in actions," noted the Human Rights Ombudsman Peter Svetina.

Juni kamen Herr Kemal Ahmed, Beauftragter der römisch-katholischen Kirche, Anlaufstelle Pro Sinti & Roma und die Bürgerbeauftragte des Landes Baden-Württemberg, Frau Beate Böhlen, sowie ihr Referent Jan Kremer in den Räumlichkeiten der Bürgerbeauftragten in Stuttgart zu einem Austausch zusammen.

Am 2. Juni kamen Herr Kemal Ahmed, Beauftragter der römisch-katholischen Kirche, Anlaufstelle Pro Sinti & Roma und die Bürgerbeauftragte des Landes Baden-Württemberg, Frau Beate Böhlen, sowie ihr Referent Jan Kremer in den Räumlichkeiten der Bürgerbeauftragten in Stuttgart zu einem Austausch zusammen. Bei dem Gespräch ging es um die Situation der Menschen in Baden-Württemberg, die der Minderheit der Sinti und Roma angehören. Dabei ging Kemal Ahmed auch explizit auf die Lage geflüchteter ukrainischer Sinti und Roma ein.

Gemeinsam erörterten sie unter anderem die Auftaktstudie zum Nationalen Diskriminierungs- und Rassismusmonitor "Rassistische Realitäten - wie setzt sich Deutschland mit Rassismus auseinander?" in der auch Diskriminierungen durch Verwaltungsbehörden thematisiert werden. Kemal Ahmed berichtete von einschneidenden Erlebnissen, die ihm in seiner Tätigkeit zugetragen werden. Diese Situation konnte Frau Böhlen teilweise bestätigen und verwies auf die Tätigkeitsberichte der Bürgerbeauftragten der letzten Jahre. Das Team der Bürgerbeauftragten und der Beauftragte der römisch-katholischen Kirche, Anlaufstelle Pro Sinti & Roma, Kemal Ahmed, vereinbarten künftig im engen Austausch zu bleiben.
