“Council of Europe member states should insist on clear human rights safeguards in any further migration co-operation with Tunisia”, said the Council of Europe Commissioner for Human Rights, Dunja Mijatović today, in relation to the conclusion of a Memorandum of Understanding between the European Union and Tunisia which foresees, among other things, closer co-operation on migration.

“Comprehensive human rights safeguards must be an integral part of any migration co-operation activity between Council of Europe member states and third countries, including Tunisia. Such safeguards should ensure that support does not result, directly or indirectly, in human rights violations at the hands of those third countries. The recently reported serious human rights violations against refugees and migrants in Tunisia only make the inclusion of such safeguards more pressing.

The text of the Memorandum of Understanding between the EU and Tunisia relating to migration only includes very general language on human rights, and no concrete indication of whether safeguards would be put in place or what those would be. I therefore call on Council of Europe member states which are also EU member states to press for immediate clarification of the human rights safeguards that will be put in place and to insist that the migration-related aspects of the agreement are not further implemented until adequate safeguards have been established. Such safeguards should include, at a minimum, the publication of a comprehensive human rights risk assessment, full transparency in the provision of funding, the setting up of independent monitoring mechanisms to assess the human rights impact of specific activities under the agreement, and the ability to suspend any activities found to be negatively impacting on the human rights of refugees, asylum seekers and migrants.

Failure to establish clear and concrete safeguards in migration co-operation activities will only add to the worrying trend of human rights being sacrificed to European states’ attempts to externalise their responsibilities.”

El Gobierno de la Generalitat aprobó ayer un nuevo modelo de atención ciudadana que incluye dos medidas sobradamente reivindicadas por la institución del Síndic. Por un lado, se ha eliminado la obligatoriedad de la cita previa para acceder a los servicios y trámites; la cita previa es ahora voluntaria, por si alguien quiere solicitarla. Por otro lado, la Generalitat también ha anunciado la gratuidad del teléfono de información ciudadana 012.

El pasado octubre la síndica pidió a todas las administraciones que la cita previa dejara de ser un requisito para acceder a sus oficinas de atención ciudadana y registro: si la cita previa era obligatoria y además se debía obtener por vía electrónica, en la práctica se estaba impidiendo o dificultando el acceso a la atención presencial a buena parte de la población, especialmente a las personas mayores y colectivos vulnerables. Desde entonces la institución está haciendo seguimiento de la aceptación de su recomendación a partir de las respuestas a su actuación de oficio y del contenido de los portales digitales de las administraciones.

Sin duda, la síndica se muestra satisfecha con la decisión tomada por el Gobierno de la Generalitat: es una medida que lucha contra la brecha digital y que tiene en cuenta sobre todo a la gente mayor, si bien es aplicable a toda la población. En esta línea, el Ayuntamiento de Barcelona, ​​en marzo de 2023, comunicó a la institución que cualquier ciudadano que se dirigiera a una oficina de atención ciudadana para obtener información, registrar documentación o realizar una gestión urgente, sería atendido sin necesidad de cita previa. Por tanto, dos administraciones relevantes –por el volumen de ciudadanos que atienden– han aceptado la recomendación de la síndica.

A pesar de ello, cabe decir que en el proceso de seguimiento se ha constatado que todavía hay ayuntamientos que siguen trabajando con la cita priva como requisito, y la síndica insiste en la necesidad de que lo eliminen.

En cuanto al 012, la institución reclamaba su gratuidad desde 2015, al entender que se trata de un servicio vinculado al derecho de acceso a la información pública, reconocido legalmente, por lo que no podía estar sujeto a ninguna contraprestación. Hasta la fecha, el 012 es un número de teléfono sin coste añadido, pero los operadores lo facturan por separado a sus clientes. A criterio del Síndic, este teléfono es un canal habilitado para hacer trámites con la Administración, como también lo son la web o la atención presencial, que son gratuitos. En este caso, la institución trasladó el expediente al Defensor del Pueblo con la idea de obligar normativamente a los operadores de telefonía a incluir, en su oferta de tarifa plana, los teléfonos de información pública con tarifa especial.

FRA Director Michael O’Flaherty will participate in the informal meeting of Justice ministers on 21 July 2023 in Logroño, Spain. He will intervene in the discussion on improving access to justice, with a special focus on people with disabilities.

FRA will draw on international and EU legislation to underline that there can be no effective access to justice for persons with disabilities if services, information and communication used by the justice authorities are not accessible. The Director will also speak about mechanisms for improving victim support, based on FRA’s evidence and data.
