Nachdem Abgeordnete des Petitionsausschusses des Landtages Mecklenburg-Vorpommern im September des vergangenen Jahres nach Kiel reisten, waren nunmehr Mitglieder des Petitionsausschusses des Schleswig-Holsteinischen Landtages nach Schwerin gekommen, um den im letzten Jahr begonnenen Erfahrungsaustausch fortzuführen. Hierzu nahmen der Vorsitzende des Petitionsausschusses, Hauke Göttsch, und seine Delegation u. a. an der gestrigen Sitzung des Petitionsausschusses teil.

Zu Beginn der 49. Ausschusssitzung wurde eine Petition zusammen mit einer Vertreterin des Sozialministeriums beraten, in der der Petent eine Änderung des Landespflegegesetzes forderte. Mit diesem Begehren trat er an den Petitionsausschuss heran, weil für seinen Vater nach Schließung einer Tagespflege im Landkreis Nordwestmecklenburg nur eine Versorgungsmöglichkeit in Lübeck gefunden werden konnte. Durch den Wechsel nach Schleswig-Holstein konnte seinem Vater aber nicht mehr der in § 7 Landespflegegesetz geregelte Landeszuschuss gezahlt werden, wodurch nach Ansicht des Petenten sein Vater finanziell schlechter gestellt sei.

Die Vertreterin des Sozialministeriums zeigte Verständnis für die Sorgen des Petenten, die er sowohl bei der Absicherung der Versorgung als auch bei der Finanzierung habe. Dennoch könne der Forderung des Petenten aufgrund der gesetzlichen Vorgaben nicht entsprochen werden. Das sei dem Petenten sowohl von Seiten des Sozialministeriums als auch des zuständigen Pflegestützpunktes bereits mehrfach in der Vergangenheit erläutert worden. Dabei seien ihm auch die gesetzlichen Rahmenbedingungen dargestellt worden, die auf Vorgaben des Bundes im SGB XI zurückzuführen seien, wonach die Länder dazu aufgefordert seien, die notwendigen pflegerischen Versorgungsstrukturen aufzubauen und weiterzuentwickeln. So sei es auch das Ziel des Zuschusses nach § 7 Landespflegegesetz, die Angebotslandschaft im Land zu stärken. Der Zuschuss stelle somit eine Objektförderung und keine Individualförderung dar. Damit einhergehend sei es aber möglich, dass der Zuschuss an teilstationäre Pflegeeinrichtungen in Mecklenburg-Vorpommern ausgezahlt werde, wenn dort Personen aus anderen Bundesländern Angebote in Anspruch nehmen würden. Abschließend empfahl sie, dass sich der Petent noch einmal an den Pflegestützpunkt oder alternativ an die Pflegekasse wenden solle, um zu erörtern, wie die wirtschaftliche Leistungsfähigkeit verbessert werden könne oder ob mittlerweile andere Angebote im Land infrage kommen könnten.

Die Abgeordneten des Petitionsausschusses stellten in Anbetracht dieser Ausführungen fest, dass zur abschließenden Klärung des Sachverhaltes noch weitere Informationen, insbesondere zu den gesetzlichen Ausgestaltungsmöglichkeiten des Landespflegegesetzes, eingeholt werden müssen. Sobald diese vorliegen, wird sich der Petitionsausschuss erneut mit dem Anliegen des Petenten befassen.

Danach erörterten die Abgeordneten bei zehn anderen Petitionen das weitere Vorgehen. Im Ergebnis soll bei drei Petitionen dem Landtag empfohlen werden, das Petitionsverfahren abzuschließen. Außerdem hat der Petitionsausschuss den Tätigkeitsbericht des Bürgerbeauftragten auf der Drucksache 8/3490 abschließend beraten und seine Beschlussempfehlung hierzu einstimmig beschlossen. Diese soll dem Landtag in seiner kommenden Sitzung vorgelegt werden.

Im Anschluss an die Ausschusssitzung tauschten sich die Ausschussmitglieder beider Petitionsausschüsse über die Verfahrensweisen bei der Bearbeitung von Petitionen aus. Dieser Dialog wurde in weiteren Gesprächen mit der Präsidentin des Landtages von Mecklenburg-Vorpommern fortgesetzt.

The KRS's application to the Constitutional Court regarding the the ECHR rulings. The Commissioner requests that the proceedings be discontinued

The Commissioner for Human Rights has presented his position regarding the application submitted by the National Council of the Judiciary (KRS) to the Constitutional Tribunal, which challenges the constitutionality of provisions of the European Convention on Human Rights (ECHR) and the rules of the European Court of Human Rights (ECtHR). The Commissioner argues that the KRS's application essentially seeks to undermine ECtHR judgments against Poland, in particular:

  • Point 1 of the petitum seeks a ruling on the unconstitutionality of ECtHR judgments in the Reczkowicz, Dolińska-Ficek, Advance-Pharma, Juszczyszyn and Wallach cases, declaring irregularities in the appointment of certain Supreme Court judges after March 6, 2018; 
  • Point 2 of the petition seeks a ruling on the unconstitutionality of the ECtHR's judgment in the Xero-Flor case, stating that the election of a Constitutional Court judge was irregular;
  • Point 3 of the petitum seeks a ruling on the unconstitutionality of the ECtHR's judgment in the Walesa case, because it was rendered by a panel without a Polish judge.

The Commissioner emphasizes that the Constitutional Tribunal is not empowered to review the constitutionality of international tribunal rulings, as its competence is limited to assessing the conformity of domestic law with the Polish Constitution. Therefore, any ruling by the Tribunal based on the KRS's application would be inadmissible, as there is no legal basis for assessing the compliance of ECtHR judgments with the Polish Constitution.

Additionally, the Commissioner points out that the ECtHR rules, which the KRS attempts to challenge, do not fall within the scope of the Constitutional Tribunal's jurisdiction, as they are not legal acts subject to constitutional review. The KRS also fails to provide sufficient arguments to support its claims, and the application cannot result in the annulment of the obligation for Polish authorities to implement ECtHR judgments.

A young pedestrian who was knocked over by a cyclist was sent home from Accident and Emergency (A&E) with an undiagnosed fracture to her head after doctors failed to properly assess her, England’s Health Ombudsman has found.

The Parliamentary and Health Service Ombudsman (PHSO) is calling on hospitals to learn from and take action on mistakes. It follows a case where a serious head injury was missed and the Ombudsman is urging the NHS to take action to make sure patients are properly diagnosed and that they receive appropriate treatment as soon as possible. 

The woman, who is now 20 and wishes to remain anonymous, was hit by a cyclist while crossing a road in Exeter city centre on 7 December 2022. 

A member of the public took the then 18-year-old to the Royal Devon and Exeter Hospital, which is run by Royal Devon University Healthcare NHS Foundation Trust. 

She spent three hours in hospital with injuries including a three-centimetre cut on her forehead, facial swelling, loose and chipped teeth, pain in her neck, head, left hand and left hip, as well as feeling nauseous and lightheaded. 

Doctors glued the cut on her head and she was discharged with only verbal head injury advice. 

The following day, the complainant still felt nauseous, her face was more swollen, and she still had head, neck, and shoulder pain. 

The woman’s parents took her to the minor injury unit at the Royal South Hampshire Hospital and she was immediately referred to A&E at University of Southampton NHS Foundation Trust, where an X-ray and CT scan revealed a fracture to the front of her skull, a broken rib and extensive facial bruising.

The complaint was brought to PHSO by the woman’s parents on her behalf about the care she received from Royal Devon University Healthcare NHS Foundation Trust. 

She said her experience with the hospital had given her anxiety which in turn disrupted her university education. 

Our investigation found failings with how the Trust assessed the complainant’s head injury, and she should have been given written advice as well as verbal advice for what to do if her symptoms escalated when she was discharged.

Royal Devon University Healthcare NHS Foundation Trust has agreed to comply with the Ombudsman’s recommendations, including apologising to the complainant, acknowledging the failings and producing an action plan to explain how it will prevent the same mistakes happening again. 

The complainant’s mother said: 

“We were shocked and angry when we found out doctors had missed the fracture and broken rib. It felt like because she was a young person going into hospital, there was no-one to really advocate for her, no-one there to fight her cause. 

“They missed major red flags and I literally can’t comprehend it. I worked for the NHS for nine years, I’m a great advocate of the NHS, and yet I feel my daughter was so let down. 

“It is scary that she was discharged not knowing what to do and knowing something didn’t feel right. 

“She’s still suffering from the effects of her treatment now. It has affected her grades. She’s very anxious and stressed about things now.

“We are so grateful that the Ombudsman took this on and has held them to account. This absolutely should not happen again, and we can help prevent others going through the same situation.

“The service I received from the Ombudsman has been very good. The caseworker really understood the whole situation and kept us informed, he’s been excellent.” 

Parliamentary and Health Service Ombudsman Rebecca Hilsenrath said: 

“As well as the physical pain and discomfort from sustaining a head injury, this young woman has experienced subsequent ongoing disruption, including to her education, at a key time in her life. It is particularly important that head injuries are properly assessed and treated appropriately in good time. This patient manifested a range of symptoms of injury, was not taken seriously and was let down badly.

“When mistakes in healthcare occur, they must be acknowledged and appropriately addressed to ensure a better service in the future. Those who complain to us are motivated by a desire to prevent others from experiencing the same service failings.  Our investigations aim to encourage learning and service improvements and we hope the NHS will listen and learn from what has happened.”
