Freiwillige Feuerwehrleute sind bei ihren Einsätzen automatisch unfallversichert. Darauf weisen Politikerinnen und Politiker sowie die Unfallversicherung AUVA immer wieder hin. Eine junge Feuerwehrfrau, die seit ihrem letzten Einsatz eine 100-prozentige Behinderung hat, musste aber zur Volksanwaltschaft und vor Gericht gehen, bis die Unfallversicherung AUVA zur Anerkennung als Arbeitsunfall bereit war. „Ich erwarte, dass die AUVA künftig in ähnlichen Fällen nicht auf stur schaltet, sondern schnell und unbürokratisch im Sinne der Helfer*innen entscheidet. Sollte die AUVA weiterhin uneinsichtig sein, wäre eine Gesetzesänderung notwendig“, sagt Volksanwalt Bernhard Achitz: „Sonst wird bald niemand mehr bereit sein, Leben und Gesundheit zu riskieren, und beim nächsten Hochwasser können wir alle selber unsere Keller auspumpen.“ Eine Nicht-Anerkennung als Arbeitsunfall hat Folgen: Die Betroffenen fallen um bessere Reha um, und um die komplette Versehrtenrente.

Nach Unfall im Einsatz bleibt 100-prozentige Behinderung

Am 22. August 2024 heulte die Sirene im oberösterreichischen Kronabittedt. Marlies K., damals 19, wurde davon aus dem Schlaf gerissen, zog sich schnell an und wollte zum Einsatz als Mitglied der Freiwilligen Feuerwehr eilen. Aber sie stürzte über die Stiege. Sie konnte reanimiert werden und wurde mit dem Hubschrauber ins Spital geflogen. Als Folge blieb ihr eine erhebliche Sehstörung, die zu einer 100-prozentigen Behinderung führte.

AUVA soll anerkennen, dass ein Alarmeinsatz immer eine Stresssituation ist

Im Fall von Marlies K. wollte die AUVA aber nicht zahlen. Medizinische Gutachten ergaben nämlich - sehr verkürzt gesagt -, dass sie womöglich an einer seltenen Krankheit litt, die zum plötzlichen Herztod führen kann, und dass sie wegen eines Herzstillstands gestürzt wäre, der jederzeit eintreten hätte können, auch unabhängig von einem Einsatz. „Wer auch nur ein bisschen Lebenserfahrung hat, weiß, dass man in einem Alarmeinsatz immer unter außergewöhnlicher Belastung steht. Das ist etwas völlig anderes, als wenn jemand gemütlich gefrühstückt hat und zum Arbeitsplatz spaziert“, so Achitz: „Die Rechtslage lässt es zu, dass auch die AUVA solche Fälle als Arbeitsunfall anerkennt. Aber Marlies K. hat erst vor Gericht gehen müssen, und erst nach einer neuerlichen medizinischen Begutachtung hat die AUVA anerkannt, dass der medizinische Notfall ohne den Stress des Einsatzes nicht passiert wäre.“

Versehrtenrente nur bei Anerkennung als Arbeitsunfall

An sich sind alle Mitglieder freiwilliger Hilfsorganisationen während ihrer Ausbildung, Übungen und Einsätze bei der AUVA (ohne Beitragszahlung) unfallversichert. Das ist gesetzlich im Allgemeinen Sozialversicherungsgesetz (ASVG) geregelt. Es gelten die gleichen Bestimmungen wie für Arbeitsunfälle. Arbeitsunfälle sind Unfälle, die sich im örtlichen, zeitlichen und ursächlichen Zusammenhang mit der die Versicherung begründenden Beschäftigung ereignen. Wegunfälle sind ebenfalls versichert. Bei Arbeitsunfällen gibt es bessere Rehabilitationsangebote als bei Freizeitunfällen, und die Betroffenen erhalten eine Versehrtenrente.

The Parliamentary Ombudsman, Judge Joseph Zammit McKeon, met Ms Emilie Wiinblad Mathez, Head of the UNHCR National Office and Liaison to the European Union Agency for Asylum in Malta, to discuss cooperation in the context of the forthcoming entry into force of the EU Pact on Migration and Asylum on 12 June 2026.

During the meeting, the Ombudsman outlined the mandate of the Office and explained that, although the institution is not formally designated as a national human rights institution, in carrying out its functions the Office actively promotes fairness, justice, and accountability, which are crucial for the meaningful promotion and effective protection of human rights.

Ms Wiinblad Mathez presented the work and initiatives of UNHCR Malta and explored areas of collaboration. She highlighted UNHCR’s role in advocating for a protection sensitive asylum system that ensures fair and efficient procedures and respects the dignity and rights of forcibly displaced and stateless persons. She referred to the need for a more effective and predictable response to the challenges of mixed movements of refugees and migrants requiring looking beyond border management to a broader, whole-of-route approach, where protection is ensured from the outset of flight.

UNHCR has been present in Malta since 2005, supporting the country in its role as a frontline EU Member State. The office works closely with public authorities, civil society, and refugee led organisations to improve reception conditions, strengthen the asylum system, and promote durable solutions and integration.

In his closing remarks, the Ombudsman reaffirmed that the Office is accessible to all persons seeking protection who feel aggrieved by acts or omissions of the public administration. He welcomed continued collaboration with UNHCR and organisations working in the field of migration and asylum.

El Defensor del Pueblo, Ángel Gabilondo, ha asistido este miércoles al acto inaugural de la conmemoración del V Centenario del Consejo de Estado que se ha celebrado en el Teatro Real de Madrid.

En el acto han intervenido la presidenta del Consejo de Estado, Carmen Calvo y el presidente del Teatro Real, Gregorio Marañón y Bertrán de Lis.

A continuación, la orquesta titular del Teatro Real ha interpretado obras de compositores españoles como Manuel de Falla, Joaquín Turina o Roberto Chapí, entre otros autores.

Con motivo de este quinto centenario están previstos otros actos conmemorativos en diferentes ciudades y exposiciones en la Biblioteca Nacional y en el Museo del Prado. Además, por primera vez, el Consejo de Estado celebrará una jornada de puertas

Al acto asistieron, entre otras, el presidente del Tribunal Constitucional, la presidenta del Consejo General del Poder Judicial, varios ministros, embajadores, el secretario general de UGT, el delegado del Gobierno en la Comunidad de Madrid, además de miembros del Consejo de Estado y personal de esa institución.

Il Coordinamento Nazionale dei Difensori Civici Italiani terrà la propria riunione periodica il 9 e 10 luglio prossimi presso la sede istituzionale dell’Assemblea Regionale Siciliana, su autorizzazione del Presidente dell’ARS On.le Gaetano Galvagno. 

La scelta della Sicilia rappresenta un passaggio significativo e simbolico: tra le Regioni italiane, infatti, l’Isola non ha ancora istituito la figura del Difensore Civico regionale, determinando una oggettiva mancanza di tutela per i cittadini nei rapporti con la Pubblica Amministrazione.

Negli ultimi mesi sono pervenute al Coordinamento nazionale numerose richieste da parte di cittadini siciliani che, in assenza di un presidio regionale di difesa civica, hanno chiesto supporto per la definizione di istanze e segnalazioni nei confronti della PA. Un segnale chiaro di bisogno di tutela, ascolto e mediazione istituzionale.

La riunione di luglio rappresenterà dunque un primo passo concreto verso l’apertura di un’interlocuzione istituzionale sul tema, con l’obiettivo di promuovere l’istituzione della difesa civica anche in Sicilia, in linea con i principi di buon andamento, imparzialità e trasparenza dell’azione amministrativa.

“La presenza del Coordinamento nazionale in Sicilia – dichiara Marino Fardelli, Presidente del Coordinamento Nazionale dei Difensori Civici Italiani – non è un atto formale, ma un segnale di attenzione verso i cittadini siciliani. La difesa civica non è un costo, ma una garanzia democratica. L’assenza di questa figura in una Regione così importante rappresenta una lacuna istituzionale che va colmata. Il nostro obiettivo è avviare un dialogo costruttivo, nel rispetto delle prerogative regionali, per rafforzare la tutela dei diritti e la qualità della Pubblica Amministrazione. La difesa civica è uno strumento di equilibrio tra cittadini e istituzioni, ed è tempo che sia assicurata in modo uniforme su tutto il territorio nazionale.”

Il Coordinamento continuerà a operare con spirito di collaborazione istituzionale, nella convinzione che una rete solida di difesa civica rappresenti un presidio fondamentale di legalità, prossimità e fiducia tra cittadini e istituzioni.

El Defensor del Pueblo de Navarra - Nafarroako Arartekoa, Patxi Vera, se ha reunido, en la sede de la institución, con el nuevo Ararteko Mikel Mancisidor. Se trata del primer encuentro institucional entre ambos defensores, tras la toma de posesión del cargo de Ararteko el pasado cinco de febrero, en el Parlamento Vasco.

 Durante la reunión, Vera y Mancisidor han abordado cuestiones relacionadas con la justicia restaurativa, la Agenda 2030, los Objetivos de Desarrollo Sostenible y la promoción del euskera, materias en las que ambas instituciones han colaborado con anterioridad. Asimismo, ambos titulares han mostrado su disposición a seguir colaborando en nuevas áreas en el futuro.
