Kinderbetreuungsgeld: Familienministerium bleibt trotz Beanstandungen der VA bei bisheriger Vorgangsweise

Einige Eltern müssen jahrelang auf die erste Kinderbetreuungsgeldüberweisung warten. Das hat die Volksanwaltschaft nach langen erfolglosen Bemühungen um eine Verbesserung Anfang Februar publik gemacht. Sie hat gegenüber der jetzt zuständigen Ministerin Christine Aschbacher in einer Missstandsfeststellung angeregt, bürgerfreundlich und serviceorientiert vorzugehen. Nun hat Aschbacher geantwortet. Vorweg: Die Antwort ist aus Sicht der Volksanwaltschaft nur wenig zufriedenstellend ausgefallen. Einige Anregungen werden zwar aufgegriffen, die meisten Vorschläge werden aber ignoriert. Die Volksanwaltschaft wird dem Nationalrat von den Missständen und der unzureichenden Reaktion des Ministeriums berichten.

Existenzbedrohende Verzögerungen

In der Missstandsfeststellung der Volksanwaltschaft wurden mehr als 30 grenzüberschreitende Fälle aufgezählt, wo es teilweise zu existenzbedrohlichen Verzögerungen gekommen war: Etwa Bettina G.: Ihre Tochter wurde am 8. Jänner 2015 geboren – fünf Jahre später wartet sie immer noch auf das Kinderbetreuungsgeld. Wie ihr erging es vielen Eltern. Überwiegend handelt es sich um in Österreich lebende Familien, bei denen ein Elternteil nicht in Österreich, sondern in einem anderen EU-Land lebt und/oder arbeitet. Oder um Familien, die in anderen EU-Ländern leben, während aber ein Elternteil in Österreich arbeitet, was ebenfalls Anspruch auf österreichische Familienleistungen bedeutet. Immerhin werden ja hierzulande Steuern bezahlt.

Die Antwort des Familienministeriums ist zwar ausführlich, fällt aber inhaltlich mager aus. Generell wird die Missstandsfeststellung der Volksanwaltschaft zurückgewiesen; man werde den Empfehlungen nicht folgen. Während die Volksanwaltschaft ihre Ansicht ausführlich juristisch begründet und mit Literatur und Judikatur belegt hat, hat sich das Ministerium in seiner Stellungnahme mit diesen juristischen Argumenten überhaupt nicht auseinandergesetzt. „Es ist mehr als bedauerlich, dass Ministerin Aschbacher auch künftig EU-Recht und entsprechende Gerichtsurteile ignorieren will“, sagt Volksanwalt Bernhard Achitz: „Das führt bei den betroffenen Eltern und ihren kleinen Kindern zu existenzbedrohenden Situationen. Vor allem Alleinerzieherinnen, bei denen das Geld ohnehin knapp ist, wissen nicht, wie sie ohne das Kinderbetreuungsgeld überleben sollen.“

Lange Verfahrensdauer inakzeptabel

In der Stellungnahme des Ministeriums heißt es, dass die meisten der 34 Fälle, anhand derer die Volksanwaltschaft die Missstände festgestellt hatte, ohnehin bereits erledigt wären. Das ist aber falsch: Die meisten der Betroffenen haben nie einen ablehnenden Bescheid erhalten, den sie vor Gericht bekämpfen könnten, obwohl die beantragte Leistung nicht oder nicht vollständig gewährt wurde. Einige Fälle wurden zwar, teilweise nach jahrelangen Verfahren, gelöst – aber diese lange Verfahrensdauer ist ebenfalls ein Missstand.

Betroffene müssen ausländische Behörden abklappern

Die Volksanwaltschaft hat die Behörden aufgefordert, dass sie von den Betroffenen nicht mehr verlangen, auch im Ausland Anträge auf verschiedene Familienleistungen zu stellen, Entscheidungen darüber abzuwarten und eventuell zu bekämpfen, bevor in Österreich weiter geprüft wird. Das Ministerium wendet nun ein, dass diese formellen Anträge gar nicht von Österreich, sondern von den anderen EU-Ländern verlangt werden. Aus den Beschwerdefällen, die bei der Volksanwaltschaft eingegangen sind, geht aber Anderes hervor: So bestätigte zum Beispiel die niederländische Behörde in einem der Fälle bereits mehrfach, dass kein Anspruch auf die niederländische Leistung besteht. Diese Bestätigungen werden aber von der österreichischen Behörde nicht akzeptiert. Ähnlich verhielt es sich in mehreren anderen Fällen. Das Ministerium beharrt nach wie vor darauf, dass die Betroffenen “formelle“ ausländische Bescheide vorlegen, was oft schwierig bis gar nicht zu bewerkstelligen ist.

LG and Others v Rina SpA and Ente Registro Italiano Navale

Those organisations could rely on immunity from jurisdiction only in so far as their activities constituted an expression of the public powers of the Panamanian State
In the judgment in Rina (C-641/18), delivered on 7 May 2020, the Court held, first, that an action for damages, brought against private-law corporations engaged in the classification and certification of ships on behalf of and upon delegation from a third State, falls within the concept of ‘civil and commercial matters’, within the meaning of Article 1(1) of Regulation No 44/2001 (‘the Brussels I Regulation’)1 and, therefore, within the scope of that regulation, provided that that classification and certification activity is not exercised under public powers, within the meaning of EU law. Secondly, the Court held that the principle of customary international law concerning immunity from jurisdiction does not preclude the national court seised from exercising the jurisdiction provided for by that regulation in a dispute relating to such an action, where that court finds that such corporations have not had recourse to public powers within the meaning of international law.

In 2006, the vessel Al Salam Boccaccio ’98, sailing under the flag of the Republic of Panama, sank in the Red Sea, with more than 1 000 people losing their lives. Relatives of the victims and survivors of the sinking brought an action before the Tribunale di Genova (District Court, Genoa, Italy) against Rina SpA and Ente Registro Italiano Navale (‘the Rina companies’), that is to say against the societies which carried out the classification and certification of the ship which sank and which have their seat in Genoa. The applicants claimed compensation for the pecuniary and non-pecuniary losses stemming from the Rina companies’ civil liability, arguing that the classification and certification operations were the cause of the sinking. The Rina companies contended that the court seised lacks jurisdiction, relying on the principle of immunity from jurisdiction, since the classification and certification operations which they conducted were carried out upon delegation from the Republic of Panama and, therefore, are a manifestation of the sovereign powers of the delegating State. The court seised, raising the question of the jurisdiction of the Italian courts, referred a question for a preliminary ruling to the Court of Justice.

Le vittime del naufragio di una nave battente bandiera panamense possono adire i giudici italiani con un’azione di responsabilità contro gli organismi italiani che hanno classificato e certificato tale nave
Tali organismi possono avvalersi dell’immunità giurisdizionale solo in quanto le loro attività siano state espressione dei pubblici poteri dello Stato panamense
Nella sentenza Rina (C-641/18), pronunciata il 7 maggio 2020, la Corte ha statuito, in primo luogo, che un ricorso per risarcimento danni, proposto contro persone giuridiche di diritto privato che esercitano un’attività di classificazione e di certificazione di navi per conto e su delega di uno Stato terzo, rientra nella nozione di «materia civile e commerciale» ai sensi dell’articolo 1, paragrafo 1, del regolamento n. 44/2001 1 (in prosieguo : il «regolamento Bruxelles I») e, di conseguenza, nell’ambito di applicazione di tale regolamento, qualora detta attività non sia esercitata in forza di prerogative dei pubblici poteri ai sensi del diritto dell’Unione. In secondo luogo, essa ha affermato che il principio di diritto internazionale consuetudinario sull’immunità giurisdizionale non osta all’esercizio, da parte del giudice nazionale adito, della competenza giurisdizionale prevista da detto regolamento in una controversia relativa a un siffatto ricorso, qualora detto giudice constati che tali organismi non si sono avvalsi delle prerogative dei pubblici poteri ai sensi del diritto internazionale.
Nel 2006, la nave Al Salam Boccaccio’98, battente bandiera della Repubblica di Panama, naufragava nel Mar Rosso, facendo più di 1 000 vittime. Alcuni familiari delle vittime e taluni passeggeri sopravvissuti al naufragio hanno adito il Tribunale di Genova (Italia), con un ricorso contro la Rina SpA e l’Ente Registro Italiano Navale (in prosieguo, congiuntamente: le «società Rina»), vale a dire, le società che hanno effettuato le operazioni di classificazione e di certificazione della nave naufragata, la sede sociale delle quali si trova a Genova. I ricorrenti chiedevano il risarcimento dei danni patrimoniali e non patrimoniali derivanti dall’eventuale responsabilità civile delle società Rina, facendo valere che dette operazioni erano all’origine del naufragio. Le società Rina hanno eccepito l’incompetenza del giudice adito invocando il principio dell’immunità giurisdizionale, dato che le operazioni di classificazione e di certificazione che esse hanno svolto sono state effettuate per delega della Repubblica di Panama e, di conseguenza, costituiscono una manifestazione delle prerogative sovrane dello Stato delegante. Il giudice adito, interrogandosi quanto alla competenza dei giudici italiani, ha sollevato una questione pregiudiziale.

Una cabina di regia per affrontare i problemi di minori e adolescenti

Incontro promosso dal Garante Andrea Nobili per proseguire il confronto sulla condizione in cui vengono a trovarsi bambini e adolescenti a causa dell’emergenza Coronavirus. Protagonisti dell’iniziativa, attivata in videoconferenza, diversi amministratori e rappresentanti degli enti locali che aderiscono alla “Rete regionale delle città sostenibili e amiche dei bambini e degli adolescenti” (Comuni capofila Fano e Porto Sant’Elpidio) e funzionari del Servizio politiche sociali della Regione Marche.
Almeno tre le questioni che hanno animato il dibattito. “In primo luogo – fa presente Nobili – è stata avvertita l’esigenza di dare vita ad una Cabina di regia che affronti la problematica nella sua interezza. L’emergenza ha creato innumerevoli disagi, ma il graduale ritorno alla normalità imporrà scelte oculate, nonché nuove forme di supporto per i nostri ragazzi”. Altra importante questione quella della didattica a distanza che Nobili ha seguito fin dall’inizio della stessa emergenza. Opinione comune è che vada attivato un attento monitoraggio sullo svolgimento di questo tipo di attività, che non ha mancato di evidenziare lacune e difficoltà non solo di ordine tecnico – pratico. Determinante, in tale direzione, la collaborazione dell’Ufficio scolastico regionale per avere il maggior numero di dati e informazioni.
Terzo aspetto quello dell’assistenza ai minori disabili. Secondo il Garante “rappresenta uno dei principali versanti da attenzionare in relazione alle fragilità dei minori. L’emergenza ha posto ulteriormente in luce la necessità di un nuovo approccio e di azioni concrete da mettere in campo quanto prima”.

Statement by European Parliament’s President and leaders of political groups on the Schuman Declaration anniversary (9th May).

The celebration of the 70th anniversary of the Schuman Declaration comes at a moment when Europe is facing its most difficult challenge since the end of the Second World War: a health, economic and social crisis triggered by the outbreak of COVID-19.

The Schuman Declaration, which laid the foundations of our European Union, started a unique and genuine political project to guarantee peace and prosperity and to improve the lives of all European citizens. Already 70 years ago the Schuman Declaration contained the idea that “Europe will not be made all at once, or according to a single plan. It will be built through concrete achievements which first create a de facto solidarity.” This step-by-step approach led to the European Union we know today.

Since the very beginning, the European project has been about building a political and economic community, based on the values arising from our common European history, like solidarity, openness, freedom, tolerance, equality in diversity and respect for the rule of law.

Jean Monnet, the author of the Schuman Declaration, declared that “people do not change if it is not out of necessity, and they only see the need in times of crisis”. Each crisis is an opportunity to take a step forward. Likewise, the current crisis heightens the urgency for the European Union to start to work on how to become more effective, democratic and closer to citizens.

Over the last 70 years the world has changed dramatically and the role of the European Union is more crucial than ever. In a new emerging geopolitical order and in the context of an ecological emergency, our responsibility is to accept to become a global force of stability and peace, rule of law, sustainability and multilateralism.

This crisis has shown at a very high cost that the EU remains an unfinished project and that the failure to organize solidarity, or to counter the on-going attacks on fundamental rights and rule of Law are not theoretical debates.

Because we stand on the shoulders of giants, the capacity of the European institutions and all Member States to respond to current health, social, economic, environmental, security and institutional challenges should be at least commensurate with the political ambition contained in the Schuman Declaration. We need to strengthen and deepen the democratic legitimacy of the European Union, and ensure its policies and leadership are the expression of the citizens of Europe in a fully-fledged European parliamentary democracy.

We believe that it is time for an ambitious debate on the future of Europe with EU citizens and all stakeholders, in order to shape the Union in which we want to live together and to find an agreement among European citizens on the political foundations we want to build for the recovery of the European continent. Solidarity has become the main condition of our future common achievements.

In this context, we continue to believe that the planned European-wide project, the “Conference on the Future of Europe” is the appropriate forum to fulfil this ambition. The Conference needs to be convened as soon as possible and has to result in clear proposals by engaging directly and meaningfully with citizens, in order to bring about a profound reform of the Union, enabling it, above all, to take decisions in the common European interest so as to make the EU more effective, united, democratic, sovereign and resilient.

We reaffirm Parliament’s position and take note of the Commission’s position that the Conference process, its concept, structure, timing and scope should be agreed upon jointly by the three institutions. Therefore, we call on the Council to come forward with an ambitious position concerning the Conference.

Beyond the joy and gratitude at having been united and at peace for 75 years, we need to remember that solidarity does not end at our borders. The current pandemic reminds us of the importance of multilateralism in tackling common challenges and crises together. Instead of reverting to national egotism, a strengthened and more integrated European Union that collaborates closely with international partners in a spirit of mutual fairness and understanding should be the way forward.
