The Office of the Ombudsman participates in Institute for Education Freshers' Day

The Office of the Ombudsman participated in the Institute for Education (IfE) Freshers’ Day, an event marking the beginning of the academic year. The main objective of the Ombudsman’s participation was to raise awareness about the role and function of the Parliamentary Ombudsman, with particular emphasis on the role of the Commissioner for Education, and to inform attendees of how the Office can support both individuals and public education providers.

The Institute for Education, a leading institution for further and higher education, offers Bachelor’s and Master’s degree programmes for those pursuing careers in education or related fields. In addition, the Institute provides professional learning opportunities through various short courses, delivered with a flexible, part-time, blended learning approach.

Freshers’ Day is a significant event for the Institute, offering new course participants the chance to meet their peers in person for the first time, especially as many of the courses are conducted online. It features introductory sessions, team-building activities, and social interactions, helping to build a sense of community among students as they embark on their educational journey.

The Commissioner for Education, Chief Justice Emeritus Vincent De Gaetano, was present at the event and delivered a short presentation on the work of the Ombudsman’s Office. He emphasised that the Office is  available not only to help individual with their complainants but also plays an important role in supporting institutions, including public educational institutions, to improve their services.

The participation of the Office of the Ombudsman at such events is part of its ongoing efforts to engage with educational stakeholders and to raise public awareness about its role in ensuring transparency, fairness, and justice in public administration.

European Ombudsman asks Commission how it works on ‘urgent’ legislative proposals, such as the recent amendment to CAP legislation

The Ombudsman has opened an inquiry into how the European Commission works on 'urgent' legislative proposals, such as the recent amendment to the EU's Common Agriculture Policy (CAP). The inquiry also concerns how the Commission assesses whether its proposals are consistent with the climate-neutrality goals of the European Climate Law.

Environmental organisations raised concerns with the Ombudsman about how the Commission prepared the CAP proposal, which was adopted earlier this year and aims to provide farmers with greater flexibility in complying with EU environmental protection rules.

The organisations questioned whether the Commission had sufficiently examined whether the changes affected the long-term environmental sustainability of EU agriculture. They also questioned whether the public had been appropriately consulted on the Commission’s legislative proposal. This step is required under the Commission’s internal ‘Better Regulation Guidelines and Toolbox’.

As a first step, the Ombudsman has asked the Commission to reply to a series of questions. These include whether it has internal procedures for deciding on whether to bypass impact assessment requirements for urgent legislative proposals and how it observes the principle of evidence-based decision-making in these circumstances.

The Ombudsman has asked the Commission to reply by 16 December 2024.

Transport d’électricité : le Tribunal annule la décision de la commission de recours de l’ACER en ce que cette dernière ne pouvait déroger au cadre juridique applicable dans le cadre de l’adoption de la méthodologie pour la répartition des coûts du « redispatching » et des échanges de contrepartie pour la région CORE

Parmi les mécanismes existants pour soulager ces congestions, on trouve des actions correctives coûteuses, notamment le « redispatching » et les échanges de contrepartie, dont les coûts doivent être répartis entre les différents gestionnaires de réseau de transport d’électricité (GRT) de manière proportionnelle.

Vigilanza prudenziale sugli enti creditizi: la Corte annulla la decisione della BCE del 2016 che negava l'acquisizione di una partecipazione qualificata in Banca Mediolanum da parte di Silvio Berlusconi

La BCE non poteva legittimamente opporsi alla detenzione da parte di Silvio Berlusconi di una partecipazione qualificata nella società Banca Mediolanum, situazione che risultava unicamente dalla conservazione, da parte dell'interessato, di una partecipazione qualificata che egli aveva acquisito prima del recepimento delle disposizioni del diritto dell'Unione sulle quali la BCE si era basata

La Fininvest è una holding italiana detenuta in maggioranza da Silvio Berlusconi. Tale società deteneva quote sociali della Mediolanum, società finanziaria quotata in Borsa che deteneva a sua volta il 100 % del capitale dell'istituto di credito Banca Mediolanum.

Nel 2014 la Banca d'Italia ha ordinato la cessione, entro 30 mesi, della partecipazione di Fininvest in Mediolanum superiore al 9,99 % e la sospensione immediata dei diritti di voto inerenti alle azioni corrispondenti. L'adozione di tale misura era motivata dal fatto che Silvio Berlusconi era stato dichiarato colpevole di frode fiscale 1 e, di conseguenza, non soddisfaceva più il requisito di onorabilità al quale è subordinata la detenzione di una siffatta partecipazione qualificata. La decisione della Banca d’Italia è stata annullata dal Consiglio di Stato italiano il 3 marzo 2016. Nel frattempo, nel 2015, la Mediolanum è stata incorporata dalla sua società figlia Banca Mediolanum.

A seguito di tale assorbimento e della citata sentenza del Consiglio di Stato italiano, la Banca d'Italia e la BCE hanno ritenuto che Silvio Berlusconi e la Fininvest avessero acquisito una partecipazione qualificata 2 nel capitale di Banca Mediolanum. Orbene, il diritto dell'Unione 3 prevede che una siffatta acquisizione debba essere preceduta da una notifica ed essere oggetto di una valutazione da parte dell'autorità nazionale competente, che trasmette successivamente alla BCE una proposta di decisione. Spetta poi alla BCE opporsi o meno all'acquisizione della partecipazione qualificata di cui trattasi.

Interpellata dalla Banca d'Italia, la BCE si opponeva all'acquisizione di una partecipazione qualificata di Silvio Berlusconi in Banca Mediolanum in quanto egli non soddisfaceva il requisito dell'onorabilità. (...)
